How to - Deal with LE.

yes things are bad in qld with police the sunshine coast from what i hear is even worse alot of people gettin a knock on the door again and again and again i am astonished to know how they get warrants when there is no evidence found in half the raids they are either bored or have to much cash in there budget

Put it this way - 9 times out of 10, its because someone, be they someone in an interview room after the tape is off hoping to make a charge go away for a bit of quid pro quo, fully registered informer or crime stoppers caller, is a Gary Giveup.
 
Queensland Police Services can't tap phones, not unless they contact the Queensland Crime and Misconduct Commission whom have more coercive powers than state and local law enforcement bodies.

Not for long. QLD's legislation will be ammended by mid next year to allow them to comply with the relevant record keeping legislation and the Telecommunications Interception Legislation Amendment Bill (No 2) 2008 is already under way.
 
im sure that this does not have to be a police station but can also be a proclaimed place aka sobering up shelter.

Get done for drunk anywhere near Melbourne's CBD (even out to some suburbs) and you're going to the Melbourne Custody Centre under the Melbourne Magis Court, or, if you're out in the suburbs, you'll get put in the cells for a while. This is fun for all, as you can have all sorts in here - white collar drunks, punk arse kids through to very serious offenders who've been remanded pending a formal bail application.

There's serious liability issues with this stuff, and it ties up police resources, so they subby such jobs out (eg, the MCC is staffed by private security guards).

If you are of Aboriginal or Torres Strait Islander descent, you'll be dropped off at one of their sobering centres.
 
fortehlulz my last post was deleted more then likely because I had too many references. Sigh, second time i've been censored, first time by the government no less.

I was, in a working relationship (not drug based), with a direct manager boss who has been accused and charged due to their involvement in major drug trafficking.

Anyway my question is this, I am aware, because of the media release that their emails were being intercepted and due to the nature of our relationship (work that is) I am guessing my emails at the very least were also intercepted.

I want to know is there anyway I can find out what was intercepted and if so gain access to this information.

Also I am certain that they my have heard me arrange purchasing the odd item or two from (very occasional and very personal arrangement) other parties not involved whatsoever in the smuggling (or known to my former boss).

I am wondering therefore why i was never charged after they charged my boss? Would they not have bothered?


Lastly I reckon your either a serving or former public prosecutor. You talk(write) like a lawyer, so its either that or your a defense lawyer.

Seems to me you've answered your own question :) If you're a drug crew working on someone for imports (which is a federal issue), why would you waste your time on some piddly personal use matters?

a while back whilst waiting in the queue at the methadone clinic lol - I made a friend with an oz guy also waiting in the queue, he told me the govt sent him to nz to live due to a court case, hmm I do know that the nz govt have sent 'informers' etc to aus to live more than a few times and vice versa..

this is a very interesting thread but the posts in here are anonomous and should be regarded as information rather than qualified legal advice. even if the advice is good, im sure it would not stand up in court that you read it on bluelight.ru :)

You most certainly can apply under FOI, but if its deemed predjudicial to ongoing intelligence or operational matters, your request wil be denied. If they know, they already know :D

You can try re the jail time issues with direct application to your state's department of corrections (but you are unlikely to succeed), or, if you are a victim of a jailed offender, some states have programs which will keep you informed of their progress through the correctional system (eg release date), but you have no hope of getting their crim history without being LE or having their consent.

I'll point out that questions like this are bordering on being inappropriate... as the only reason you'd need info like that is to check someone's 'crim credentials'... and for the record, U/Cs are backstopped with such information and documents to such an extent as to be completely verifiable even if you were lucky enough to know a copper who could do an IBR for you.
 
Quick query, this is probably answered- if presented with a search warrant (house/property), if one requests a lawyer to interpret the warrant for them, does that hold off the search? Also, does a search NEED to be filmed by LE? Thanks anyone who helps :)
Edit: will police allow one to secure their dog, ie. lock them in a car etc.???

Question for the OP:

If I am found to be carrying a testing kit in public, either on the streets or in a venue (say during a random police checkpoint where it's just a basic pocket empty), is this cause for a further search? If so, how detailed of a search would it be, and could authorities take the kit from me? Assuming that I am not carrying any drugs, this is. What is the worst that could happen here?
