I do not live in Cali, but I do hope prop 19 passes.
My question is, if Prop 19 passes how does one go about buying the one ounce of "Legal" marijuana with out a MM card? Where would one go to buy it?
Thanks.

It may be a while before you will be able to do this. Basically each municipality will be able to regulate who, where, when and how cannabis will be sold within it's geographic limits. So some cities may say "We do not want cannabis to be sold within our city limits." which means that you will not be able to legally buy cannabis in that city but you will still be able to grow and posses it.

Basically entrepreneurs will have to take it upon themselves to start negotiating with their cities to get some type of system in place. I imagine it will be very similar to medical dispensaries we have now except anyone will be able to go in and make purchases.

I wanted to ask this too but assumed that as it is still illegal the discussion is technically sourcing.

Now that we have that out of the way; I am planning a holiday to the states as a direct result of this, when will I be able to buy some Cannabis and tour all of your crazy theme parks whilst eating hot dogs?

Just realised Damien is not an Admin anymore. I assumed the sourcing discussion was ok due to his reply.

What about municipalities that already allow medical marijuana for sale such as LA or Oakland? Why wouldn't you be able to go into a MM shop and buy an ounce without an MM card?
Will it still be illegal to sell to individuals without an MM card, but legal for that person to possess?
Would the sale of that "legal" ounce to someone without a MM card still be illegal?
Bear with me as I am in Texas and have not read the whole Prop 19 bill.

As long as you don't discuss when, where, or how to obtain illegal substances then it should be okay.

I'm pretty sure theorizing when the pot-market in Cali will be open-air and open to tourists wouldn't be considered sourcing.... I don't think.

Let me just clarify that I am only discussing the Marijuana law if prop 19 passes.
I am not asking for a dealers name or a specific street corner to buy weed.
The same questions were raised when MM passed. The courts ruled that if MM was legal then the right to sell and buy MM by MM patients was also legal.
I would assume that if prop 19 passes and one ounce of marijuana was legal then the right to buy that ounce would also be legal.

^ I hope so, don't want to get an infraction. ;)

Good questions.

1. It would depend on the cities laws. LA for example may say "We don't want any "P19" shops but we wish to maintain our MMJ dispensaries in which case it would still be illegal for those dispensaries to vend to anyone without* a MMJ recommendation. I've heard that Oakland already has some underground shops that don't even bother with the MMJ recommendations and will sell to anyone due to Measure Z (not sure how true that is). I could see some cities allowing current MMJ dispensaries to sell to anyone once they've modified their business model to fit the new law e.g. obtaining the new permits (whatever they may be) that a "P19" shop would require.

2. Yes it will be legal to posses anywhere in the state of CA for everyone over 21.

3. The sale would only be illegal if it occurred outside of the local guidelines. e.g. buying it off of your neighbor who is unlicensed and is not paying the appropriate taxes.

The bill is actually a pretty easy read, check it out: http://yeson19.com/node/6

Thanks for the link. That has answered my questions.
Just a few high lights from the prop 19 bill.

7. Ensure that if a city decides not to tax and regulate the sale of cannabis, that buying and selling cannabis within that city’s limits remain illegal, but that the city’s citizens still have the right to possess and consume small amounts, except as permitted under Health and Safety Sections 11362.5 and 11362.7 through 11362.9.

(b) retail sale of not more than one ounce per transaction, in licensed premises, to persons 21 years or older, for personal consumption and not for resale;

(c) “Personal consumption” shall not include, and nothing in this Act shall permit cannabis:
(i) possession for sale regardless of amount, except by a person who is licensed or permitted to do so under the terms of an ordinance adopted pursuant to section 11301;

I was just reading something interesting.

Recreational use is not able to be addressed by this kind of bill and so it is possible that if 19 passes, it will be negated for recreational use. . . Doing nothing to allow adults without medical cards to use cannabis and instead all of the regulations in prop 19 will then apply to medical cannabis use in Caliifornia. Which would be completely fucked, and limit medical users to a 5x5 area, one ounce in possession, etc.

No on 19, at the very best you have huge money behind it looking to sell out cannabis to Monsanto and mega corporate control.

^ Where were you reading that? That is completely, 100% inaccurate. Please read the bill for yourself before spreading misinformation.

I was amazed to hear the growers here express a similar sentiment.

Can one of the mods please add a poll to CD asking "How would you vote on Prop 19?" With 3 answer fields; "Yes", "No" and "undecided". Then we can get some reasoning behind the decisions below.

I cannot add a poll or I would do it myself.

For christ's sake, just look at beer and wine and booze -- we have a million different varieties, big corporate flavorless swills like Bud Lite and Miller, and delicious microbrews everywhere -- and nobody gets busted. It's called the Free Market because the BUYER must remain free, to buy or not buy, and so the competition among sellers and manufacturers encourages a better, more affordable product. If you don't like McDonald's crap or Mafia Mexican pot, don't buy them.

Of course making it legal will drive the price down, and therefor the profits. But not much. There is no monopoly in the alcohol industry. No Monsanto.

And don't bust the schmuck buying or selling a bag o' weed. Just treat it like alcohol and end this prohibition hassle.

Bump. Less than a month to go now.

Message the CD mods and it'll happen much faster.

They don't always catch every single mod question that doesn't get sent to their inbox. :)

It's been sent but only today, I thought I did it last week when I asked the question but you know how that is ;)

Less than 7 days till the vote and this is on page 4. . . no more.

For those curious about what the opposition is doing check this out.

Third result in my daily google alert.

This is the source of the video which I'm pretty sure is not being aired on TV.

Is Prop 19 not a big deal for people in the States? I know that I have been trying to learn as much about it as I can.
