in general, i don't think the messages are what's going to get you caught. however, they can use them as evidence for conspiracy charges, which is why it's still a good idea not to say anything incriminating (even in code) via text message. and if they're listening in on your phone calls, you're either fucked already or high enough up in the game to know what you're doing.

any regular drug user or small time dealer who thinks that their cell phone is being tapped thinks way too highly of themselves. it comes down to a cities money and resources, and if you think a municipal police department is going to waste either on your daily habit you're honestly trippin.

It's no USA, illegally obtained evidence is still useable in courts too.
Honestly this is a quite selfish attitude for a buyer... What if you incriminate the guy you're buying from on the phone because you just didn't give a shit and made it clear he's selling drugs to you? I never understood why people absolutely HAVE to talk about drugs, doing them, buying them, selling them, whatever over the phone, often rather explicitly. I mean ffs, if you insist on using a phone you could always use some voip software with encryption or something. We have the internet these days if calling up to simply meet is inadequate.

Ofcourse they won't arrest someone who doesn't use drugs, but you know, they might still search their homes if they feel like it. We actually had a huge fiasco where the police would go over the sales records of a legit gardening store selling equipment for greenhouses, and they did a search to EVERY single address they had sold something, searching huge amounts of homes with nothing but chili and tomatoes growing under HPS lights...
Anyway, you never know, so why not play it safe? I don't put an antenna on my head every time I go outside and there's a lightning storm even though the risks of getting hit by lightning are still somewhat minimal.
