How to - Deal with LE.

Its going to come back to reasonable grounds. Lets say there's a knock at the door and they have a warrant for your mate's arrest - would it not be of interest that he came so quietly and being so adamant that you didn't need to trash your place? What's that smell? The odour of cannabis? :)

In theory, yep, shouldn't be a problem. In practice, it depends how bad they want to look in the house.

Just something worth considering, whether it is law or not in australia. A mate got himself convicted for growing weed indoors, how he got caught was still questionable.

Mate had just moved into a new house/rented, staying for 2 months, started a grow, next thing police are at front door with search warrant for previous tenant! even though mate showed them his tenancy agreement with his name on it and not the previous tenants. They stated a law where they can search a house to make sure that the person wanted is not hiding in 'the waredrobes' and such!!

So yep he got busted, after all that it was just a $400 fine, but anyhow quite cunning if you ask me!

i caught the train in on sunday(we usually get a bus) and was pulled aside for a "random" check. i had 1.5 pills on me at the time and handed them over without the officer having to search me. I was told im going to get a letter with a court date. Is it like other minor crimes where i can just plead guilty on the form and send it in? avoiding court, Am i going to get a criminal record? i dont know wat to do! do i need a lawyer? plz help

Don't know which state you're in, but you do need a lawyer. If its not a summary charge (depending on jurisdiction and the police member's mood) you will need to front. Adverse findings for drugs can hurt a whole lot of careers.
 
What's the deal with drug diversion fortehlulz. Many friends have been given the magical 'drug diversion' with no criminal conviction. Does this mean there will be no criminal record when a prospective employer does a police check?
 
From the moment you are arrested, you should be yelling long and loud for them to call your lawyer. If you can't get YOUR lawyer, get A lawyer. If they're planning to remand you and its after hours (hence you are unable to reach your lawyer), a bail justice will be called, and you want A lawyer there to argue why you shouldn't be remanded in custody.

I'm Joe Average in the street. I've never needed a lawyer.

I enjoy the odd big night out - and that would be the only potential way that LE would get to me - arranging and going out on my big night out. Otherwise, I'm pretty much a cleanskin.

You advice is get Your / A lawyer. I don't have one. How do you arrange one in a hurry - and hope they're decent?

Mobile phones as LDs is a touchy area. The FBI in the United States has admitted that it has the capacity to do use them for live monitoring. There are other uses for mobile phones, either off or on, to police beyond monitoring conversations. Whether or not this is in use in Australia at the moment is not something I'll be discussing - such a question is WAY beyond harm reduction.

ha i'll answer this - the answer to whether or not cops can monitor mobiles is yes yes and yes.

Hell the dudes who work in the centre where the switch is housed can do it themselves...
 
when they do a police check for work/careers what info is given over? like a list of everything or just a this guys alright? do they give over only relevent info or "he's had a drink driving charge" ect

The whole point of a diversion is that it stays off your civilly available 'Criminal History' sheet. It is still, however, an 'adverse finding', and will show up for stuff like joining the military, police etc. Police will also know about it.

Its neither a conviction nor a finding of guilt. It does not have to be disclosed to a civilian employer. That's the whole point - allowing pissy offenders to get the piss scared out of them, have it formally in the system, hopefully scaring them straight by dragging them through most of the formality without the crim. record.

If you're in the UK, yes, legal aid is the way to go, or, if you have some money, go and put a reasonable one on retainer. \

Stay the fuck away from those volunteer advisors some police stations may offer you though. Not much good to civil suit them later if their advice destroys your life.

In Aus, the laws (or lack of em) varies from state to state re what's released.

A loose rule is that if you've done over three years jail in one go, or you've been convicted or found guilty of any offence in the preceeding ten years, it will be available, but each state has its own rules, exceptions and peculiarities. Some states also allow 'pending charges' info to be released. I'd encourage you to seek clarification with your state's police force - usually, forms and info are available online for civil crim history checks.

On the spot fines, cautions, warnings and diversions DO NOT APPEAR ON A CRIMINAL HISTORY CHECK FOR CIVILIAN EMPLOYMENT.

Victoria - just an old username from an old country! Does Victoria even offer this service?

And what are the grounds for getting legal aid - I'm probably going to be ruled out for a reason or two?
 
How does paying a retainer to a lawyer work?? Does it mean they'll be on call if and when I need them? Can you get legal aid funding for a private lawyer?
 
The Vic police check info can be found here. Basically all findings of guilt will be released - even "without conviction", good behaviour bonds and community based orders. If you've had any finding of guilt in the last 10 years (adult - 5 yrs for child), then all findings of guilt will be released regardless of how long ago they happened. Big sentences (over 30 months jail time for a single charge) will always get released regardless of how long since your last guilty finding.

Also new change in Vic - it gets sent only to you, rather than to your prospective employer.

fortehlulz didn't state he wasn't going to say whether they could or not, he said he wouldn't say whether it actually happens here in Oz as it's not within the scope of harm reduction.
 
fortehlulz, with Police and sniffer dogs showing up at a couple of events in Perth recently I am interested in any W.A. specific laws regarding this. I read somewhere recently that police have been given permission (might not be the right term) to use sniffer dogs on lines for nightclubs in Northbridge etc.

Is all that is required for them to force you to be searched a signal from the sniffer dog?

If they pull you up at the gates to an event or train station what parts of you can they search on the spot?

Can they strip search you then and there?

Can they cavity search you?
 
^ I'm pretty sure thats been answered a few pages ago..

Someone on the grape vine may have been using a device and software to listen to the polices scrambled signal. its basically a trunker system. also when police are behind you and enters your details i have heard that he/she can view what is displayed on the screen of inside the police vehicle by intercepting a signal.
Is this practice illegal? Even though they would be just recieving a signal?
Also with radar detectors. They are illegal here, yet this year the new range of car GPS systems have Radar Detectors built in. What does that mean in line with the law?

hmm i'll re-read it in case i missed it. But the first time i read through i didn't see any thing that was specific to western australia.
 
i just have 2 questions regarding an incident involving me and 2 friends about a month ago.
I was walking through a park at about 10 30pm with J and R (16 and 17yrs old). Unmarked police car pulls over and demands to search our bags, i asked what their grounds were, they said they were from the homocide squad following up on reports of gang violence in the area. Grabbed J's bag found spray cans and proceeded to search the rest of us. They then requested we follow them to the station, not under arrest, but if we refused they said they would arrest us. J and R were interviewed first and admitted everything :X
i gave a polite no comment but they said they were charging me with possesion of graffiti instruments because J and R had confessed.

If J and R had kept their fat pie holes shut could they hav charged me? Because stencils by themselves arent really graffiti instruments if they cant prove intent to use them on public property. We hadnt done anything that nite so there was no paint on clothes, fingers, stencils and none of us had any incriminating photo's on our phones.

J was only 16 so got a formal caution, R and me went to court, R got $400 fine no conviction and i got $100 no conviction... was my judge just feeling nice?
