If you're on supervised probation, and the conditions of the probation include UAs (which supervised probation almost always does indiscriminate of the crime), then it doesn't matter what you've been charged with, the only factor that matters is whether or not the PO feels like making you piss in a cup or not, which is up to his totally arbitrary discretion. If the conditions include random warrantless searches, they'll probably say they will search you and even tell you an approximate date or range of dates they'll show up, but in the end it tends to be too much of a hassle for your PO's lazy pig ass to even do it once; not saying that it won't happen, but you have a pretty good chance there of not actually getting searched, better than your chances of not getting a UA at least.
Don't quote me on this as I really don't know for sure, or if this only applies to North Carolina, but I think if you're on random UAs and you fail one, the most that would happen is basically more intensive UAs and/or some kind of drug deferral program, or if you're lucky, a slap on the wrist. What I know for sure is that they can send you to rehab for failing a UA (but if I'm right about the previous thing then that would only happen if you fail another UA), and it's a horrible fucking place from what my friend who had that happen to him says. Not only that, but if the rehab center is full, then you have to wait in jail while you wait for a spot to open up, my friend had to wait all summer (3 months) until he could finally get in. Before he went in, he had a good amount of muscle mass, looked healthy... when he came out, he looked like complete shit, he lost all his muscle, was pale, just looked sick as fuck in general.
What I'm saying is, unless you know for damn sure you're not getting piss tested, shit can happen if you do this, and when it does it's probably gonna suck major ass. Now, if you're def not having to piss in a cup, like if you're on unsupervised probation (well, hypothetically the court could still order you to be drug tested while on unsupervised probation, but I've never seen this actually happen, seems like it's easier for them to just give you the full supervised probation if they want your piss tested), or if it's supervised but the conditions happen to not include drug screening (unlikely), then you're free to smoke as much as you want, just as long as you don't get caught in the act.
