Would you smoke weed if you were on probation and not getting piss tested?

If you are able to to do that, it won't matter. If you plan on using outside of your home, or have a propensity toward acting reckless I'd stay away for marijuana.

Yea... well this is the first time i ever got arrested and I am 24.

Only thing possible would be DUI (which technically is not a crime, but a traffic citation in my state). I mean I dont drive if I shouldnt, but shit happens, etc.

If this is acceptable for you, I'd stay away from smoking. If you set out smoking while on probation... shit CANNOT happen, and everything you do MUST reflect that.
 
If you're freaking out enough to ask then don't. If i knew I wasn't supervised then I'd be smoking but, that's just me. I'm just saying you're obviously worried about it so why put yourself through it every time your phone rings or you check your mail.

If yest then, yeah I would 100%-just do it like you said. Be safe, only smoke at your apartment in your room/safe indoor places.. don't smoke in the car or out on the street etc..
 
I've been on probation for two years, (finally getting off in June yay). I haven't been tested once, it didn't worry me because I was not convicted of a drug charge and I always made sure to make restitution payments on time. Hope this helps with your anxiety :) I say go for it like some others here but it's your choice.
 
I actually continued to smoke after I got busted. There are some fairly easy ways around it...at least in my situation. I was in a drug deferral program and had to go to classes that randomly tested, and I passed all of them after I figured out what to do. But of course, what I did may not work in all situations.

i was on 2 years felony probation and smoked while getting supervised test randoms... and yeah while i'll jump on the bandwagon and say "dont smoke while you're on probation"

I just got off of 3 years of probation and I have smoked almost all day every day the whole time. I was put on randoms towards the end and the one UA I had to drop was hot. I went in for my probation appointment the next time and my PO screwed up some court stuff and my probation was over
 
If you're on supervised probation, and the conditions of the probation include UAs (which supervised probation almost always does indiscriminate of the crime), then it doesn't matter what you've been charged with, the only factor that matters is whether or not the PO feels like making you piss in a cup or not, which is up to his totally arbitrary discretion. If the conditions include random warrantless searches, they'll probably say they will search you and even tell you an approximate date or range of dates they'll show up, but in the end it tends to be too much of a hassle for your PO's lazy pig ass to even do it once; not saying that it won't happen, but you have a pretty good chance there of not actually getting searched, better than your chances of not getting a UA at least.

Don't quote me on this as I really don't know for sure, or if this only applies to North Carolina, but I think if you're on random UAs and you fail one, the most that would happen is basically more intensive UAs and/or some kind of drug deferral program, or if you're lucky, a slap on the wrist. What I know for sure is that they can send you to rehab for failing a UA (but if I'm right about the previous thing then that would only happen if you fail another UA), and it's a horrible fucking place from what my friend who had that happen to him says. Not only that, but if the rehab center is full, then you have to wait in jail while you wait for a spot to open up, my friend had to wait all summer (3 months) until he could finally get in. Before he went in, he had a good amount of muscle mass, looked healthy... when he came out, he looked like complete shit, he lost all his muscle, was pale, just looked sick as fuck in general.

What I'm saying is, unless you know for damn sure you're not getting piss tested, shit can happen if you do this, and when it does it's probably gonna suck major ass. Now, if you're def not having to piss in a cup, like if you're on unsupervised probation (well, hypothetically the court could still order you to be drug tested while on unsupervised probation, but I've never seen this actually happen, seems like it's easier for them to just give you the full supervised probation if they want your piss tested), or if it's supervised but the conditions happen to not include drug screening (unlikely), then you're free to smoke as much as you want, just as long as you don't get caught in the act.

if its informal probation, which ive had before, why not smoke? they arent going to be checking up on you or knocking on your door in the middle of the night
