Great post Sepher! :) You have given Kkat plenty of encouragement & food for thought! That is exactly what Kkat needs! She needs to be strong & positive (but i know that is so much easier said then done!) Kkat is good person, look at how many people care about her on this thread/site! <3 She really doesn't deserve all this crap!!! <3

He has to take it into account when he sentences given a prior psych assessment that says you're scizophrenic, same as he'll have to take into account Probation reports, evidence from addiction unit saying you're addressing your addictions, whatever. He can disagree with Probation / addiction unit recommendations all he likes but he can't argue against you having an expertly, indepently diagnosed mental illness pre-existing the whole trial thing, unless he's gonna rule your vulnerable mental state as an exploitable addict isn't even remotely relevant to the offence. It will be immediate grounds for an appeal against length of sentence if he dismisses a medical diagnosis out of hand I'm sure because it is expressly provided for in the definitive sentencing guidelines for drug offences as something to be taken into consideration.

See page 11 of that document for definitions of the role you played. It has to be a lesser one by the definitions there. Then what category of offence they talking about? If your brief is saying 5 years looks like it's being dealt with as a Category 2 Class A supply offence. Even with a guilty plea they still need to show that as someone playing a minor role not being directly involved in handling quantities of Class As and moving them elsewhere yourself, not standing to benefit out of the transactions having no major interest in the 'enterprise' or the profits being made a sentence at even the 5 year starting point that assumes you had full knowledge of the scale, with evidence showing why it's being dealt with as Category 2 offence and not 1 or 3 is consistent with justice. Being given a few bags for the use of a bank account and phone don't cut it.

Page 14 same guidelines gives a whole list of acceptable mitigations, your mental condition being specifically set out as something that needs to be taken into consideration. In practice judges will sometimes feel they wanna make an example of someone leaving the Appeals Court to decide if they overstepped the bounds at all but even so his hands are tied to an extent by the guidelines, and I can't see your case is even in the most serious categories, with ample mitigation as a vulnerable addict with mental health issues making very little out of this regardless of scale and money involved. I don't think he has to give anything like 5 years if he wakes up in a good mood and decides to be a bit more reasonable with the guidelines when you next come up. 5 years is the starting point, but could be 3 years 6 months, and that's assuming it's sentenced as Category 2 supply / concerned in the supply of class As, and couldn't have been dealt with using a less serious category. Your legal team / probation should already be doing this but give as much info as you can so they can gather as many independent reports as are possibly relevant. Do some donkey work yourself pulling in any supporting evidence if anything comes to mind worth considering.

He will also have to give credit for an early guilty plea. At this stage assuming a proper trial had yet to be set he should give 33% credit against length of sentence, 25% if you put the plea in a bit after things got properly in motion re: trial date. He can give less if he feels like it cos it's discretionary, but again grounds for an appeal if he doesn't give you the full credit. Even with a 5 year sentence as starting point in the guidelines that will actually mean 3 years 4 months, 3 years 8 if you get 25%. Then you'll only do half and might get HDC all chipping away at what you'll actually have to serve assuming a sentence at starting point, all mitigation evidence dismissed as irrelelevant.

Don't give in all to gloom and despair just yet, eh? Still room for optimism, and it ain't all over and done with inevitable you'll get anything like 5 years. Chin up. It ain't over till the fat lady sings. ;)

Maybe if you tell friends & family that you need their help & support! Surly if needed they could divide your belongings up & store them for you. Don't be ashamed to ask for help! you just can't deal with all this on your own! You need support NOW & after the court case you can show your appreciation to people who helped you! You can be there for them Then but Now its You thats needs all the help & support!!! <3

Look into finding out if the police are after messing up the dates of the offenses, if so they may have messed the whole case up!!! :)

I have been scoring since Thursday night (so much for not using!!!) No change at all in the gear, it is still very weak! I haven't taken my methadone since Wens, its great to have a break from that awful stuff!!! The gear is holding me well, but its not getting me stoned! GURrrrr..... its a real head wreck! More fool me for buying it!!!! Can i give the price of a gram? Or is it only points we can give prices on? (i thought it safer to check first!)

I have to give up my house-one thing i cannot do is leave all this shit for my parents to deal with
I know I will be gone a while so storage will be too expensive so better to sell then start anew after
I have very few friends and my family just don't have space to store my things or they would
They can keep a few important things for me but most stuff needs to go
there is no way I am getting away without jail time on this one-no fucking way
 
Just a quick update on gear situation.
Scored a little while ago. The gear is in rock form and is rock solid, very hard to break up.
Got sparkly bits in it and I think its crap. I've probably smoked about 3 bags worth so far and have only got the tiniest of buzzes from it.
Most disappointed indeed.

is it a dark brown
 
Yes mate it is a fairly dark brown colour. Darker than most of the powder that you usually get.
Have you got the same stuff going around your area as well then?
 
Had a good day tday - met up with a couple of mates and got some fairly good gear in
hackney just under .3 for a score and got a stone and as i
was 1/2 way through my feast i get a call from my normal fella (his partner) who has nt called in 2 weeks as the gear he
had was pretty poor and he only calls me now if he has 10/10 so luckily it was only 15 mins away - . He warned me it was
dear, a tenner a point ,but wikid gear just like i was getting normally until my fella got a bit of trouble.hence seeing his
pardner now. Best white ive had for ages as well so all in all an up and down day - in a good way.

@Kat good luck , please check out the date thing as if they are on court documents you may have been handed a very
lucky break. Speak to your brief on monday and see what he says. I think were friends on FB already so will pass
messages if worse comes to worse and will write if you get an addy out - and if you get sent anywhere down my neck of
the woods and want a visit .... to lift yer spirits, let me know. BUT i reckon if you do get sent down its months you would be looking at not years, the jails are full to bursting and without you all thinking im a nutter i am pre-cognative about
some future events if i concentrate on them and I see/feel good feelings (impossible to put in to words).

Yeah Griff that does sound like the crap that is going around over here!

So much for me not scoring! I have been using since Thursday, i haven't taken my methadone since Wednesday, its so nice to get a break from that! But the gear is just the same old rubbish! The bloke i scored off to-day is that fella that i have spoken about before, he is 50 years of age & has been using heroin for more then 30 years, so you would think he'd know better then to try bull-shit me!

But you want to hear him going on about how he has "the best smack in Dublin" They were his exact words! We just laugh at him now! He reckons that no one in Dublin has gear as good as his! & we keep telling him that his gear is the Verysame as Everyone else's!!! He keeps arguing the point with me, telling me wild stories of people fighting to get his gear coz they don't want to score off anyone else! Such Bull-shit! You can get this very same gear anywhere in Dublin!

As i said to him, look we are buying it off you anyway so you don't have to tell us all the wild stories! The gear is a bit better the last few weeks, but its still rubbish! This guy has been using daily through out the whole drought, so i reckon that he has just become totally used to this rubbish gear! & as i said it does hold you with-out methadone, it just doesn't get me properly stoned! I'm a complete & utter eejit for wasting my money on this crap when i could just take my methadone! 8(

How are things your end Griffin? Did you manage to stay clean? Is there any gear in Limerick? & if so what is it like? Or do you always have to come to Dublin?

I'd love to have a crystal ball so i could look into the future & see if i'm still sitting here this time next year moaning on Bluelight coz i have wasted yet more money on rubbish gear!!!! Holy Jaysus!!!! 8(
 
It's all fucking shit! Banging up one bag took the early cluck sniffles away for an hour, then they'd sneak back in, bringing the cold sweats with them.

It did get good, for a while as I was forgetting to go to the chemist to pick up my script and remembering just in time before chemist close and getting kicked off my program, but recently I've been using daily AND taking my script again just to get rid of the ills. I have a double habit though.

I had been enjoying the freedom from the green handcuffs, but I've asked to go back to supervised doses as I'm starting to fuck up and collecting my script form chemist, not drinking it and scoring more than once instead. I clearly still need the discipline.

I was starting to think that i was not going to see this stuff again .

The shortage has moved the goal posts so to speak about what is good n so on.

What was once considered a average score but nowt to shout about is now sought after stuff .

This is one of the only batches that pre 2010 i would of said yeah thats bangin gear.

I put a street bag on the jimmy n its still going strong n the tube is as it should be.

I bought both as is common for me n for once the Dark is the one n the light is darn good amonia stuff not bi carb .

I can see myself actually waking up with a nice bit left n a tube caked up.

This has been a proper eye opener , their is still really good stuff mind i was contacted not the other way n this one never does me a wrong but never over sellls a la " i got shit hot Stuff" just if is on tis worth having but this is the 1st that came with a friendly warning .

Yes i no the price seems v. cheap but it is sold like most stuff with a adequete profit margin.

Scored saw two different people, one was very good, and the other was ok, happy enough. I know of 2 other dealers with good stuff from Birmingham...... first time in 10 days.

So maydbe just maybe things will improve...... gotta keep postive,=.

It seems a few different batches of decent gear has entered B'ham, the best being the old school ' Scabby ' which according to my main has come via Bradford !
How long it's here for is anyone's guess.
If anyone quotes less than <snip> an 8 ball alarm bells start ringing !! The price just seems to keep rising, after every little mini-drought it goes up by £10-20.
Surely this can't continue? It seems lack of competition has let the dealers create a monopoly .
we need a new supply chain, maybe South America, Mexico, or just the good old Turkish back !!

Oh well, @ least i can just nod away ..............

Really think you shud get a second opinion on ur case, from a shit hot brief. Do some research in ur town and go to someone, pay them £200, more if necessary to review ur case and give their opinion, cos we all feel ur getting screwed.
