Pennsylvania Allows Syringe Sales Without Prescription, Effective Immediately!

Just got denied

I've had no problems buying them from the local Walgreens. I went back home a few weeks ago and went to a Rite-Aid to buy some; the guy was initially unsure if I could (said he knew the law changed but wasn't 100% sure about the details, so he phoned another branch and confirmed it). Today, I went to another Rite-Aid (24 hrs) and tried to buy some. The girl asked the head pharmacist and he told me he would not sell syringes unless they had a prescription. I told him the law changed and he told me that it was his policy to deny me for whatever reason he wished because I didn't have proof I needed them.

Are they allowed to do this?

"(s) Sales of hypodermic needles and syringes shall be made by a pharmacist or under the direct, immediate and personal supervision of a pharmacist in accordance with the following:

 (1) Hypodermic needles and syringes may be sold without a prescription."

I don't see anything about pharmacists following the new law however they wish. I almost told him "So basically, you are against harm reduction and are not following the law?" but wasn't sure if he actually is allowed to make the decision he came to. Now I have to re-use a syringe (4th time for it, have no others :|)

I'm not sure if the pharmacists have any discretion, but I haven't read it in any articles, so I doubt it. Since you're talking about a chain pharmacy, ask for the pharmacists name and for their corporate phone number. Then just take out your cell phone and give them a call. Do this in front of the pharmacist, making sure he knows what you're doing.

Good to hear that PA has stepped their game up in the name of harm reduction. I live in NJ, and its such a pain in the ass that its not legal to get syringes without a script. I either have to go to Staten Island to get them, or I gotta buy em in the hood when Im coppin. Also, when I go to the CVS in Staten Island, they will only sell you one pack of ten with an out of state ID, which I think is rediculous. They might as well not sell to out of staters if theyre going to put a limit on how many you can buy. It just doesnt make any sense to me. I hope Jersey makes it legal sometime soon. I am always forced to use my syringes MULTIPLE times. Ive used them to the point where the rubber pops off of the plunger and gets stuck in the barrel! Definitely a pretty shitty situation. :(

i am bumping this to ask so what about holding them on you is that legal now, i mean it seems like common sense but the keystone state is anything but sensible, also anyone from pa do you find easier to get them to sell you them in smaller drug stores or the chains like riteaid , wallmart etc, thanks ash

I think PA is on a good way, syringe sales without prescription will help to reduce cases of HIV. Let's see how this new law works and if it needs some changes or adjustments. There is also a new poker law in Pennsylvania that is a great novelty for gambling freaks and poker players and I hope the government will continue this progressive way.
