How to - Deal with LE.

Hi Fortehlulz. Quick question. Just got a fine from highway patrol (a guy who is notorious in the area i am in, for being a complete hard arse towards small traffic infringements) tonight for no P plates being displayed on my car, but the fine isnt quite accurate, it has the wrong name in it.
I had no p plates on cause I am a delivery driver, and heaps of the time my plates get nicked at the places i deliver to/ by other drivers etc, and I was completely unaware that I had no P plates on.

It is a $197 fine, which is exorbitant, and over a weeks pay for me. How do I go about challenging this fine? Do I have a chance at winning?

I am taking this to court, thats for sure, not just going to pay for it.

It doesn't matter that you were unaware. You were driving a vehicle with no P plates when a condition of your licence says you must. The name issue probably wont matter either. If you took it to court the officer would just identify you as the driver. This is no different to saying "but officer I didnt know that there was a bag of drugs in my pocket". It wont hold up. Teh fine sucks, but thats just life.

You have no chance at winning and you will also have to pay court costs as well.

I just dont want to have to pay the fine now, its going to fuck my credit card even worse than it is. Any way to delay payment? Like $200 for no P plates, pretty excessive hey

Just apply to pay the fine off in installments via the fines payment unit. All you need is to provide evidence it would cause you financial hardship to pay it now. Eg show your bank account and how much you earn per week.

Can pay as little as $10 a week off.

geez how unlucky to get caught in the first place - did he know you? or was it a random license check that lead to discovery of no P-plates?

i'd encourage you to seek legal advice on the fact that it has the wrong name on it. I was let off on a 'manner dangerous' charge after taking the CIB prick to court - my guy hammered him on the details (time, place, weather, speed blah blah blah) and discovered so many discrepancies that the judge chuckled and that was that...

Yeah you can get off on technicalities like that. A friend got a legit speeding fine, with the details correct however the cop forgot to sign his name at bottom. Friend went to court instead of paying fine. I can't recall any details but I know he didn't have to pay the fine after going to court. I presume judge ruled ticket was invalid as it had no signature of officer.

Was a "random" rbt. The car in front of me even pulled over when they saw a cop following, then continued on after me and the cop went past. Suss as and they picked me. This cop is well known around here for hassling delivery drivers and young people.

Yeah, think im taking it to court, cant hurt. Is it possible to get legal aid for something like this?

You have to wear P Plates on your P's. You weren't wearing P plates. You got fined.

Sucks hardcore, especially that you have to pay 200 dorrars, but you pretty much have 0 defense against that claim. Legal aid will cost you money, and probably tell you the same thing.

Unless someone else has any ideas...? Just suck it up and pay for it in a few 50 dollar installments or something.
 
You have basically zero chance of getting off, just pay it off $5 a week, that's fuckall and you won't even notice. Going to court etc will be a huge pain in the ass and probably easily cost you the $200 in fees anyway.
 
Id like to hear fortehlulz input on people and presentation at court. Now if I was ever to go to court id try and give myself every chance I could and go in a suit trying to look respectable. Yet I hear of so many people that just go it every day clothing with thongs.

If I was going to go to court iv always thought id hire a damn good lawyer and do what ever he tells me to do or not do.


I know it shouldn't offically make a difference but I believe in reality it does. What's your view fortehlulz? Noticed any difference between street presentation and a suit when it comes to court? What else should we know about court and what to say and what not too?

My question is, have you ever heard of a musician (or other artist) being investigated, arrested or otherwise involved with the law based (at least to begin with) on their lyrical content, particularly related to drugs?

I.e. Someone singing or rapping about doing drugs, selling drugs, making drugs etc, having an investigation being initiated because of those lyrics?

Thats if there being cunts. Ive actualy heard of a guy getting jailed because they found a thc crytal on his shoe sole at an airport which is invisible to the naked eye lol

Yeah, definitely being cunts. I got nailed by the dog for coke, there were traces on my credit card. I just owned up to it, gave them as much assistance in searching my bags and person as possible and I was on my way within 20 mins or so. Had a good old chat with the customs lady, told her about my ayahuasca trip and when I told her I'd been to Colombia she told me about the coke manufacturing tours she'd seen on youtube and I told her I went on one. She even even told me to keep quiet when she found bits of yerba mate in the bottom of my pack, otherwise I would have had to go back and clear quarantine again.

Presentation is a HUGE component, and I've seen it many times. I know of one gent who fronted court, against the advice of his counsel, wearing an open shirt, footy shorts and thongs. Had he actually made an ATTEMPT to dress reasonably, he may have avoided the jail term he copped. Show the court the respect to which it believes its entitled - you may not respect it, but it demands it, and penalises, either formally or informally, those who flaunt the court's authority.

You may be able to put forward an excellent case in your own defence in court - you may be factually correct, and you may present well. There are several 'mays' there. The question is, depending on the nature of the charge faced, do you really want to take the risk when you're facing possibly life altering ramifications?

There's an old maxim in law. 'He who represents himself has a fool for a client'. I know barristers who've been at the bar for 30 years and they still wouldn't attempt to defend themselves. The lack of objectiveness is one component. What may seem relevant to you, a legal practitioner may see as ancillary or tangental.

My personal view - if you're going to court, get representation. Even if its the 'duty lawyer' for the day if you're skint, or a proper representative.

Eminem faced issues regarding suggestions that his implied encouragement of drug use in songs could give rise to criminal charges, owing to certain UK legislation regarding the 'proliferation' or 'suggestion' of taking drugs. This was in the UK if I recall correctly, and his set was altered on the night to accomodate police requests. Find a piece of sister legislation and you may run into issues, though off the top of my head, I can't think of any.

As for an investigation being initiated - wouldn't surprise me at all. Rap about killing Presidents in the US gets police (nay, Secret Service) attention. Rapping about drug taking, trafficking or killing in Australia would probably warrant some level of scrutiny, though I have no direct knowledge of it occurring.

this isnt strictly a drug related question but i thought you might be able to spare a few secs to answer a question for me

a while ago when i was on acid i was pulled over driving my car with a few friends in it. (first time taking acid) and i got brethalised and caught with a blood alchol content of under .05 (im on my p's). Somehow the police didnt pick up that i was ridiculusly off my head. to be honest i didnt think i was driving, i thought i was in a big dream and my friends in the car were my concience. (hope you get some lolz from that)

anyway i just did a google search and theres a website with faq's for drink driving loss, and he/she suggests its easy to get off diy's, and i should challenge it and go to court and get the fine. (contacting him to be my layer after i have a court order) I was wondering if this is utter shit, or if there is some way to get out of it.

Somehow the police didnt pick up that i was ridiculusly off my head. to be honest i didnt think i was driving, i thought i was in a big dream and my friends in the car were my concience. hey guys, recently my mate got caught at a music festival with a pill, only had 1 pill on him, and cops have gave him a court notice , what are the possible outcomes of the offence? he only got done 4 possession
