Caught

Yeah let the lawyer do the best they can.

Check this guy, he got caught with 9 KG's of pot and got off with Community service not that long ago.

And he pleaded guilty to dealing initially. Dunno how he got so lucky? Good lawyer perhaps?

The acid and the txt may complicate things tho a bit. Good luck and let us know what he gets given.

Sounds like me. I made the unwise decision of using a lot of meth on the night before my sentencing date in court (I was charged with possession of methamphetamine, among other things). The next day when I appeared in court, I was dressed in dirty clothes, hadn't showered, and was on a bad comedown. The judge looked at me and said "clearly the defendant is a raging addict" and sentenced me to supervision. No diversion, and I got an impressive record. :\

all up they got about 7g and the 4 tabs?

Ur friend made the biggest mistake by saying its his mums car and also about the house. Should not have said one word til u have seen a lawyer and just say "I refuse to say anything without a lawyers pressense" Thats why they were asking as they had no right to do so without a consent. Maybe they would of got a warrant maybe they wouldnt of u never know but if u agree then they dont need one.

In the ens it all comes down to has he ever had any prior convictions? What are they charging him with, with just possession? intent to supply? If its his 1st conviction they will put him on a drug program as long as he admits being an addict and it was for his personal use. I am not lawyer but this is what i would do. Then would prob get 12-24 months suspended or a fine to cover the court costs again u get the idea of which route to pick. If its his 2nd conviction even if it was unrelated then the matter is worse as they will bring up his past convictions and they put all the offences/crimes together in one. Good luck to him. Re: the dress issue - just dress well. If you feel the need to convey to the judge/registrar that you have an addiction, do so verbally.
 
1 - No one SWIMs here, dont fucking do it it's annoying

2 - If you're dumb enough to have weed, acid foils in your mums car, you deserve to be caught. Use anything in a nice secure environment, or you are just asking for trouble.

3 - No one on here can give you legal advice, best bet it to speak to the best lawyer you can find, and see what happens.

IMO, if you are a cleanskin (never been in touble before), you will get a slap on the wrist and told your a naughty boy and to go and plant flowers on a round about for a couple weeks. If you have a rolling list of similar offences, be prepared to get a short custodial sentence (somewhere between 2 weeks - 2 months), as an attempt of the Aussie justice system to rehabilitate you.

Regarding a warrant, excuse my rudeness, but SWIM (ie YOU), is a fucking idiot. They cant approve or apply for a warrant over the phone in ANY circumstance. If this was the case, it would happen every day. All warrant are approved by a magistrate, I recommend you read up on law and rights if you feel like driving around with naughty things on you. Mentioning mummy, and giving a sob story, will just make the cops a lil more cheeky. They love games and can spot a dumb fuck a mile away and play the game VERY well.

You seem to have been caught with a TINY amount (depending if the tests the tabs for a per mg readingor not), so in MY HONEST OPINION, you will have a fine (if the charge is simply for posession), perhaps community work, and a conviction,

^^ the acid wasn't in the car, just the weed.

How do you transport weed from one place to another that is a long distance? I always use my car..

However I woulda put the weed down my pants and got away with it, lol.
 
^^ Wherever it was found, obviously it was left in an obvious spot, as cops on a quick sticky beak arent going to be looking in hard to reach spots for a gram or two... [snip] :)

Second, If you are moving ANYTHING around via a car, put it somewhere safe (boot under the tire, somewhere similar), wipe all prints off the bag, and plead ignorance. See if the cops can secure a conviction once you have 6 statements from various people saying they have driven the car in the last week, and it could have been one of 50 people who put it there.

Like I said, be smart people. It's not hard to outsmart cops, you just need to know how to play the game as well as them.

That would work, however finding people may be difficult for some and when a car is searched (here in SA anyways) it does not matter where it is hidden, they WILL find it. They are quite pro at it. However they can't search your underwear ;)

And the OP said it was in an obvious spot so he handed it over to police without them asking, which wasn't the brightest idea either.
 
Just say it was all perso and that your mate goes halves with you in weed so it dont cost that much for you all. I would not worry about anything, you'll be fine, its nothing, i know people that have been caught with craploads more and just got a fine.
 
Another thing to remember is to always delete any drug related txt messages as soon as you have read them.

I've heard of so many stories of people getting into my strife with the cops after they had a quick look at their phone when caught with a small amount of weed or a pipe
 
Or you could just lock your phone so the cops can't go through it. Not like they can hold a gun to your head and force you to enter the pin.

It would be silly to keep them on there anyway, unless you have problems with memory.
 
The cannbis weight is 11.4 grams. But that would be in the bag. I was thinking the pot will get a whole lot lighter by now and the court date on the 15th of march. They weighed the acid up as a gram because it was in the foil? So not too sure what the go is with that. 20 years old Nsw brokenhill His step father has served jail sentence for supply and is known by police. Not sure if that means anything but thought id mention it. Yeah i didn't think they could but they was waiting there why they got it. He thought it would go better against him if he was corporative. He has already seeked drug and alcohol counseling and admitted he has a drug promblem. Il get back on the 15th march
 
The cops that searched my room didn't do a good job. They didn't even look under the mattress i was sitting on.
 
have you talked to a solicitor yet? basically its the best thing you could do if you want to get the best possible outcome.

the '1g' of acid that will be your main drama. since the cops and courts do not need to take purity into account they have an option of charging you with 5000 'doses' of cid. (they consider a dose to be 0.0002g)

since they are tabs though, it would make more sense to charge you with how ever many discrete dosage units were in the foil. 4 tabs is a personal quantity, any more and it becomes an indictable/supply offence.

but many of us know that cops rarely make sense when dealing with such matters...
