Caught with drugs in prison - what will happen?

One point they know who you were going to see, so any defence will involve that person in the investigation. At that point a true mate would offer in the very least a witness statement to say you were coerced and bullied into bringing in the drugs. As mentioned in a previous post best track is the truth, but don't say anything until you are advised to do so - You feared for your own personal safety as well as his. Alas inevitably that means longer sentence for the mate inside and no doubt an investigation into why he himself was in fear etc. He asked you to do it, you blindly did it because he told you he had no option. you won't get off but you can plead diminished responsibility.
 
How do you know he was manipulating him? He could have been telling the truth n may have copped a beating.

Your options in this case are limited - You know drugs are illegal and you were caught smuggling them.

You either did so on your own free will -so you put your hand up and say I'm guilty OR try the line of somebody was manipulating you to do something out of character for you, never done it before and you have learnt your lesson. I'm guilty but... then insert Julies post.
 
Ummm not sure I agree. I think he should take responsibility, put his/her hands up n accept responsibility. Explain that he was concerned his friend would be beat up etc.

If he claims s/he was manipulated court may think he's trying to shift responsibility n take a dim view.

I could be wrong but I feel he's better admitting wrongdoing as there's evidence against him.

I had a mate ask me to do this.. I told him to get fucked.

I did end up handing over £100 of my own money to some shady cunt in Kings Heath on his behalf and let someone else - who was probably more likely to succeed - sort the smuggling out.... or he played me for a cunt :D

Hope they don't come down to hard on you mate..
 
It's too much of risk, it's like a mate asking to smuggle gear abroad for him - if you get caught your fucked. Unfortunately his mate knows this, sadly whatever trouble he got himself into is his doing, if he was actually in any trouble. It may be cold and harsh, but when it boils down to someone going to prison themselves or getting into serious trouble then surely that changes things.
 
Probably would've been easier just paying his debt instead of taking the risk of smuggling.

Yep. But then people lie about all sorts of shit on here, always get tolerated/believed and often venerated for it.

I thought this case might be one where the benefit of the doubt might be worth it. Particularly when it's not even the OP being accused of lying.

firstly, solicitors always give you the worst case scenario - though custody is a genuine possibility, its more likely to not be - uk prisons currently running at or
around 98% capacity. judicial guidelines are - if at all feasible - to utilise alternatives. however, youre always gonna
get the odd judge who woke up on the wrong side of his most riteous bed that morning
also, this, unfortunately is just

one of those crimes that both the government in general & courts occasionally single out to make an example to others

alas, precious little can be done about this
the important thing is to stack the odds as far as possible in your favour.

effectively, the assault thing being aeons ago in court terms - youre a law abiding citizen. you need to play on this;

a law abiding citizen who has made/was duped/tricked into making (up to you which you go with) a terrible mistake, that

youve been wrought with guilt & regret over ever since & that you wanted to back out of from the start but couldnt for

whatever reason, just make it dramatic, feed their preconceptions. if you havent got a job - getting one would help your

bid for avoiding prison, massively. get your brief to stress how work keeps you out of trouble & all your aspirations

that you realise youve stupidly put in jeapordy - need to be laid out. even if you dont want a mortgage & 2.4 kids - say

you do anyway. additionally, character references are your ammunition, spray the fuckers with 'em. literally, any

any professional person who knows you willing to write somethin decent - get it down. go with an armful. it can swing it

He's in the army. He's going to Colchester military nick. Which kinda negates most of your prattling.
 
Aye, a character reference will work wonders no doubt..

That little prick who mowed down that copper should turn up in court tomorrow with a note from his old geography teacher saying what a lovely lad he is. Or his old driving instructer saying that he didn't hit or even attempt to hit anyone during his lessons, completely outta character 8)
 
A good set of character references from credible people in your area certainly does go a long way if it's well known members of society. And you genuinely do appear to have changed your ways. I would say in this case it will be hard to escape custodial but it might lessen the damage.

If you seriously don't want to do jail then it would also pay to emphasize the trying to help a friend in need. Try and get those character references to say what a caring guy you are and how this was completely out of character. Also if your legal representation can say you no longer speak to said friend who influenced you would probably have a positive effect on your outcome. I am just telling you all the things they would have to hear to seriously help your case.

Completely different. You're comparing a murderer here, to some chap who was supposedly just trying to do the right thing by his friend.

2.4 kids? Are you counting handicapped kids? If they do count for less than a full kid, who then decides which number in ℝ is assigned to a handcapped kid? Or is this some sort of Solomon's Judgement?

Yes they are completely different, unfortunately a character reference would be, imo,about as much use in both situations unfortunately ( well, not unfortunately for the cunt who killed that copper)... This isn't a job interview, this is crown court and still a fairly serious offence which the establishment take a very dim view on. Unless he knows someone with some serious clout I can't see a character reference making a scrap of difference. He has no viable defence imo, the channel the court and prosecution will say that matey who is already serving time should of made the warden know he was in danger, which is clearly not a good idea if you are actually in danger, but that's what they'll say.

Chances are the guy who is already inside won't tell them who was threatening him incase of reprisal. It'd be safer for him to say it was just for financial gain which again, fucks over the OP who took the drugs in...
