Caught with Class C; Ketamine. What's next?

Yes, I was not looking for sympathy. I am a not a master criminal nor a terrible person. I do no harm to anyone but MYSELF. I don't rob old grannies, shoplift or commit any fraud to pay for my addiction. I have been a "functioning" addict for many years.

Regarding the lawyer would the legal aid brief they offer be acceptable or should I actually pay someone to represent me? The one I accepted last time because I didn't know whether I needed one (having never been arrested before) seemed fine. I don't know if I have her details still.

Well I've only gone and managed it again. This is like 2.5 years later. I had a massive panic attack and basically collapsed in a train station and they took me to A+E said i was screaming or summat. No idea tbh. Think my nose was blocked and I wasn't breathing properly. Something was going on in my head that's for sure. I don't "k-hole" far too much tolerance for that.

You've just explained the ideal circumstances for "blackholing". I know this cos my tolerance enviez yours at best, certainly can't be far different at worst. Add in benzos and the fact you were apparently found "screaming" and I'd put money on you being holed in public. Happens to the best of us... and we will always deny it cos none of us remember it and notice not a damn thing due to having such high tolerance it's all or nothing if we don't hit it dead on... and we don't half as often as we think we do :|

Indeed. Dissociatives are finished for me, I just can't get a good hit anymore. I was far too often "found screaming" when I blacked out after pushing into hole territory, couldn't remember a thing. My nose really isn't in great shape anymore either. Eh, not a very useful post this. In any case, my personal hunch is that 3g of class B will not get you in any substantial trouble and I reckon you could keep it off your records if you play nicely. Have you spoken yet to the legal aid they put you in contact with?

I have played nicely and will. They said I can get the solicitor when I answer bail though I may contact the station and ask if it is something that I can do beforehand...


Shambles: I agree with everything you said. The thing is I do actually remember what was going through my head at the time and remember 95% of the situation (apart from the screaming part) but didn't want to say it to them else I would probably have ended up locked in a padded room for the night I'd imagine haha.

If only I'd realised I was freaking out somewhat and remembered I had benzos on me then the whole (hole? :P) situation could probably have been avoided. I mainly get them so I can sleep after finishing my supplies for the night.

Whoever else asked why I had them in public; I had gone to pick up in person. I have been through the train stations 1000 times with personal bits and have never had a problem becuase I normally don't lose the plot as it were :o

It depends on whether you're going guilty or not guilty. Here's what happened to us :-

When we were arrested the duty solicitor told me there was no point in going not guilty cos they had stacks of evidence against us (house raided) so he advised me to 'no comment' the whole interview, which was quite difficult when being bombarded with questions for over 2 hours! My OH declined the duty solicitor and gave a full interview which worked out well cos it meant we didn't contradict each other.

The solicitor had no idea about RCs regarding quantities etc so I spoke to these people http://www.release.org.uk/ who put me in touch with a solicitor that specialised in drug offences. I had a 30 minute phone consultation with the solicitor who said that as we were going guilty there was no need to have a solicitor in court unless there were mitigating circumstances to be argued, which there weren't. He gave me a bit of advice and charged me £90 !!! as we weren't entitled to legal aid.

After 4 very worrying months on bail they charged us with possession of 3 class As and a class B which was a result as we'd had 64g of speed. We actually had 12 drugs in the house, they found 6 but 2 weren't illegal at the time. We went to court and pleaded guilty. It got adjourned 3 times for various reports and eventually we got 12 months probation with 6 months drug counselling. Both of which were a complete joke because they just couldn't get their heads around weekend recreational drug use. As far as they're concerned if you use drugs you MUST have a drug problem, as well as relationship, family, financial, employment, educational and every other problem they tried to throw at us and failed miserably.

The only thing we were worried about was getting in the local paper and somehow, despite 4 court appearances, we managed to avoid it. So apart from the financial loss due to seized drugs and days off work (about £1000) and the absolute pain of going to probation it all worked out ok in the end. I even managed to wangle a dexedrine prescription as a result of being nicked which kept us going for years so it was worth it just for that.

I wouldn't worry too much as you've been caught with a relatively small amount of personal use class Bs but it's worth speaking to Release to see what they say.
