Aus - Schoolies downing drugs to avoid being arrested by Queensland police

SCHOOLIES fearing they will be caught red-handed with illicit drugs are taking all their stash at once to avoid police detection.

An ambulance source said she treated one teen who hyperventilated from shock after consuming 18 ecstasy tablets before hitting celebrations in Cavill Mall.

The Courier-Mail witnessed two school leavers who had collapsed with violent seizures after suspected drug overdoses.

A 17-year-old girl was rushed to hospital after collapsing outside the Wendy's ice-cream shop in Cavill Mall on Sunday night.

Friends told paramedics they believed she may have overdosed on cocaine.

Jasmine King, 17, from Brisbane, said a lot of schoolies drink large amounts of alcohol and take drugs before leaving their hotel rooms to avoid being caught by police.

"Everyone knows it's not worth taking a bottle or drugs out on the street so they take it all beforehand," she said.

"You see lots of people swallowing their stash as police go by because they start panicking."

One unnamed schoolie said a lot of teens were having adverse reactions to illicit drugs because toolies were selling low-quality drugs to desperate teens.

"There have been some really dodgy drugs going around," she said. "Because they can't get their hands on them, because of busts or whatever, people are getting really desperate and taking whatever they can get.

"Drugs this year are just really s---, the MDMA that's been going around is more likely to get you a bed in the hospital than a high."

Gold Coast Hospital operations supervisor Gavin Fuller said a number of teens have presented with drug-related symptoms and many did not know what they had taken.

"It may be harmless for one person, but another may have an unknown underlying condition which could result in seizures, heart problems and life-threatening consequences," Mr Fuller said. "Not knowing what they are taking is dangerous."

Acting Chief Superintendent Des Lacy said there had been several arrests for minor drug offences including possession of marijuana and ecstasy.

Yeah this is crazy use some common sense first off eating a stash is gonna get you killed depending the drugs and packaging.
Secondly I agree with nsam end this war on our citizens so they dont kill themselves out of fear of persacustion.

You aussies got your own tongue down there. Ies seem to be popular. And not the ones you pop either. ;)

Every body is getting bunk everywhere unless you know what your doing which I doubt these highschoolers really do.

Seriously do these kids not research anything? Its obvious what they are talking about in this article is directly related to the bullshit nasty ass research chemicals people buy of the internet and then pass them off as safe drugs like MDMA, LSD, etc...

This is ridiculous and I know exactly what the kids are talking about.

When I was in high school, I had 3 medium dose caps of AMT on me because I was going to go trip after school. My friend was giving me a ride home and she floored it through THREE school zones (there is a high school, a tech school, and a community college all within a mile of each other on one road). We got pulled over and I panicked, swallowing all three capsules. 90mg of AMT for my second time with a real psychedelic. I didn't die but she ended up getting a ticket and dropped me off at the bus stop and I figured I had an hour and a half before anything would happen... Yeah no, high doses of AMT kick in around 30 minutes. I ended up pulling the bus cord two stops early because I got so nauseous I was afraid I was going to throw up on the bus and it was a hot day outside. I ended up having to walk the last half mile home while coming up on a strong +++ - everything was morphing in broad daylight and I was paranoid because I had to pass a public elementary school and the public park behind the school to hit the road that would take me home.

I lucked out but that could have turned into a disaster very easily. At the time AMT wasn't illegal but it would be kind of hard to explain what I was doing with 3 capsules with just a little bit of powder in them to a police officer. I shouldn't have taken them to school in the first place but I was only there to register for classes and I was planning to take the bus over to a friend's house so we could all trip but I wasn't going to refuse a free ride.

I've had plenty of friends that have done similar things just from seeing a cop. I was driving one time and we hit a sobriety checkpoint and I didn't know that my friend had a half ounce of mushrooms on her - next thing I know, I see her rip them out and frantically chew them up and swallow them... She had never tripped before and I ended up having to babysit her dumb ass all night.

Prohibition needs to end. I've heard that they're much harsher in Aus than the US too.

Reminds me of being in a private house party, the house is surrounded by police and council officials with noise meters, I've had a trip and have a few more in my pocket. For some reason I can't persuade anyone around me to join in an impromptu acid party. Something about "set and setting" being a bit wrong?

I've heard that they're much harsher in Aus than the US too.

You are the second American on this forum I have read making this sort of claim in the last month or so, I really don't know where you guys get the idea things are harsher down under than in the States but I can assure you that you are wrong. In most, if not all, States here you can get cautioned twice for possession of cannabis and only the third time will you even see a court, in my State the amount I can possess and face nothing more than a caution is almost two ounces. People go to gaol fuck all here, even for shit they should, but the one benefit to that is you don't see people doing time for minor to moderate drug offences very often. There seriously is no comparing the US system to ours in terms of harshness.

I ain't having a go at you man but it baffles me that people have this idea and I am really curious where they are getting it from.

This website points a good picture of how much a money making thing the drug war is in the US.. I know we see allot about people getting harsh sentences in the US here on Blue Light but the numbers in this website point a different picture.. check them out and I would like to know what your opinion of the US system is then compared to Australian one.

I guess the laws in certain areas - I went ahead and looked up QLD since that is the subject of this thread - would lead one to assume that the penalties would be quite harsh as well.

Can the police search me or do other things without a warrant if they think I've got drugs on me?
Yes, they can. They have the power to:
search you (including a strip search as long as it is done by an officer of the same sex) or your vehicle if they have a reasonable belief that drugs are present - they must state their name, rank, station and number to you
search premises if they reasonably believe that delay would allow evidence to be destroyed or hidden
use drug detection dogs in certain places
require you to give your date and place of birth (as well as your name and address)
The police need a court order to use listening devices, and while the police can order a cavity search, the actual search has to be done by a doctor.

The police here can not do an illegal search and seizure, especially a cavity search, just because they feel like it. In the cases that they do, the case almost always gets thrown out here.

Then there is this:

Dan Rogers from the Caxton Legal Service says trafficking can encompass smaller offences.

“It can simply mean a person supplying drugs on two or more occasions and receiving a profit on both occasions,” he said.

The maximum sentence is 25 years for schedule 1 drugs including ecstasy, amphetamines, cocaine and heroin or 20 years for schedule 2 drugs including marijuana and synthetic drugs.

If you are selling to a 16 year old, the sentencing is even tougher and the maximum sentence for selling schedule one drugs is now life in prison.

“(Under these laws) young people will go to jail for at least two years for minor trafficking,” says Rogers.

Most drug crimes in the states get probation for the first time. I have a friend who got busted selling ecstasy and LSD to an undercover at a rave who got 5 years and 2 years of probation afterwards even though he had 120 pills in his possession, a vial of LSD, they found 200 more pills when they searched his house and recovered over 8k in cash. It was his second offense too. The first one was a drug-related offense as well but this time he got busted with two ounces of weed. They gave him diversion for that one so its not even on his record anymore.

I guess from the outside looking in, it looks worse than it is but then again, you guys over there probably think the same thing when looking at our articles that talk about extreme sentencing as well. It really depends on the state here too. California will lock you up for just about anything but Colorado tends to be a lot more lenient than most places.

Publishing or possessing instructions for producing
dangerous drugs
(1) A person who unlawfully publishes instructions, or
unlawfully has possession of a document containing
instructions, about the way to produce a dangerous drug
commits a crime.
Maximum penalty—
(a) if the dangerous drug to which the instructions relate is a
thing specified in the Drugs Misuse Regulation 1987,
schedule 1—25 years imprisonment; or
(b) if the dangerous drug to which the instructions relate is a
thing specified in the Drugs Misuse Regulation 1987,
schedule 2—20 years imprisonment.

Wow. So if they catch you with TiHKAL or PiHKAL you go to jail?

I have been looking at the rest... Those laws are a LOT stricter than they are here.

No, the police here DO NOT have the power to randomly stop and search you. You have the right to refuse and unless they produce a warrant they can't force you. (This does get voided with the new powers granted during the G20 summit, but that is 'supposedly' temporary). Strip search is out of the question in a random search. The searching premises without a warrant is also a power only granted during the G20, and both are only permitted in specific areas of the CBD and 2 surrounding suburbs.
Police do not have an automatic right to search you and your personal property. They can search you or your belongings only if:

you agree to the search
they have a search warrant
a law specifically allows them to conduct the search. Such powers are limited and apply only in certain circumstances.

http://www.qld.gov.au/law/crime-and-police/being-arrested-and-police-custody/being-stopped/

You also don't have to tell them anything beyond your name and address (there's no reason that they'd ever need your DOB/place of birth) unless you're already being written up.

As for trafficking:

What the police must prove

In order for the Police to prove their case at Court, they must prove each of the following matters beyond a reasonable doubt.

That the accused "carried on a business". Proof of carrying on a business requires the police to establish several transactions done for gain over a more than a brief time span, but a person doesn't need to trade indefinitely before a person can be said to carry on a business. Nor is there the need for the venture to be profitable.
That the accused "trafficked". This means trading in or dealing with and includes selling.
It is a dangerous drug.

No, owning a published book is not 'unlawful possession of a document containing instructions, about the way to produce a dangerous drug'. This would more cover the PDF's of instructions on syntheses.

That's much better, I figured there had to be something missing from the picture.

Trafficking is an easy catch though because they don't have to arrest you the first time that you sell to them on an undercover basis... That would be entrapment here.

So with the synthesis stuff then couldn't you technically have charges brought against you for the Rhodium archives? Because I'm no chemist but I like reading and trying to understand as much about synthesis as possible. It gives my brain something to chew on but it doesn't mean I'll ever do it.

Also, when it comes right down to it, the US does whatever it wants now so I think its pretty much universal that you can get fucked no matter where you live.
