Actor Tom Sizemore fails drug test

LOS ANGELES, California (AP) -- Actor Tom Sizemore has violated the terms of probation imposed for abusing ex-girlfriend and former Hollywood madam Heidi Fleiss, a prosecutor said Monday.

Prosecutors allege that Sizemore "tested dirty" for drugs in early March, according to defense attorney Mark Werksman, who filed a response under seal Monday.

"We're asking the court and the public to withhold judgment 'til we have a hearing and have the opportunity to prove that this allegation is bogus," he said.

Deputy City Attorney Robert Cha said he alleged the probation violation in a motion April 29. He declined to provide specifics, saying only, "I didn't file this motion for no reason, with nothing to support it."

Sizemore, a star of "Black Hawk Down" and "Saving Private Ryan," was sentenced in October to six months in jail on misdemeanor charges of harassing, annoying and physically abusing Fleiss during the two years that they had a relationship.

The judge postponed the jail term to allow Sizemore to complete a live-in program at a drug rehabilitation center.

He is tested for drugs regularly under terms of his probation.

Sizemore is currently in Canada shooting a new police television series, Werksman said.

The 42-year-old actor has been tapped to play Pete Rose in an upcoming made-for-television movie called "Hustle."

Tom Sizemore wants the world to know he does not use drugs--at least the illegal kind.

The Saving Private Ryan star has denied allegations that he was hepped up on methamphetamine, a violation of his probation that could land behind bars. Instead, his camp says the embattled actor had been taking the prescription drug Eldepryl for legitimate medical reasons and that the medication triggered a "dirty" test for the illicit drug.

"[The allegations of drug use] are not true and the city attorney knows that," Sizemore's publicist, Nancy Seltzer, told E! Online.

Seltzer was responding to court documents filed Monday by the Los Angeles City Attorney's Office claiming the 42-year-old Tinseltown tough guy failed live up to the terms of his three-year parole stemming from his 2003 conviction for battering and harassing former lover Heidi Fleiss.

In an earlier motion, prosectuor Robert Cha claimed Sizemore repeatedly called the 38-year-old ex-Hollywood Madam, showed up at Fleiss' home uninvited, and has used the illegal stimulant.

Prosecutors are hoping to convince Superior Court Justice Antonio Barreto to either withdraw Sizemore's probation and make him do time or send him back to rehab. Sizemore has already done one stint for an admitted addiction to crystal methamphetamine.

Sizemore's attorney, Mark Werskman, filed a statement on Monday from a doctor, saying the actor's positive drug test resulted from Eldepryl, a legally prescribed medication that the body metabolizes similarly to methamphetamine, and did not violate his probation.

But Cha claimed that Eldepryl's use was approved by the Food and Drug Administration specifically to treat Parkinson's disease, an infliction for which Sizemore has not been diagnosed.

Seltzer, however, disputed that assertion.

"[Cha] said it is FDA approved for Parkinson's disease but that doesn't mean it doesn't have other uses that are widely known," said Seltzer, who declined to specify what medical condition Sizemore may have been taking it for.

Sizemore was found guilty on seven misdemeanor counts, including physically abusing and harassing Fleiss during their stormy two-year affair and was sentenced in October to six months in jail, three years' probation and a $1,200 fine. He was also ordered to undergo counseling for domestic violence and anger management and submit to random drug tests.

Baretto postponed the jail term to allow Sizemore time to complete a stint in rehab, which he entered last fall. The judge also said he was willing to cut the actor's jail time in half should he stay away from Fleiss.

Sizemore didn't listen, prompting a stern warning in February from Baretto.

By April, however, the judge was pleased enough with Sizemore's progress to delay his 90-day jail and allowing Sizemore to travel out of state to Nevada and Canada to work on Dr. Vegas, a new TV series with Rob Lowe that is currently filming in Canada. He also has signed on to play play disgraced baseball legend Pete Rose in the ESPN TV movie Hustle.

But he continues to be dogged by legal problems. Fleiss just sued him for undisclosed damages for domestic violence and property lost during their explosive relationship.

Seltzer had no comment on that civil case, she noted that Werksman is expected to file a petition soon requesting a new criminal trial for Sizemore.

The next hearing in the criminal case is scheduled for June 25.

LOS ANGELES (Reuters) - Actor Tom Sizemore, convicted in 2003 of beating and threatening ex-girlfriend and former Hollywood madam Heidi Fleiss, was arrested on Wednesday on felony charges of possession of a controlled substance.
Sizemore, 42, was booked at the sheriff's station in the city of West Hollywood, police said. Bail was set at $10,000 and he was free as of Wednesday afternoon.

Syndicated entertainment TV show "Access Hollywood" reported that Sizemore was arrested at his home in the early morning, and that drug paraphernalia also were discovered. It was not immediately clear what the controlled substances were.

Earlier this year, prosecutors accused Sizemore of a parole violation after a positive test for methamphetamine. His attorneys argued the positive test was due to a prescription drug.

Best known for parts in movies like "Saving Private Ryan" and "Black Hawk Down," Sizemore has been cast in the upcoming CBS television series "Dr. Vegas."

A spokeswoman for Sizemore was not immediately available to comment on the arrest.

Black Hawk Down Star Tom Sizemore Jailed On Drug Charges

Troubled action man TOM SIZEMORE is behind bars in Los Angeles after a judge declared his drug use was "out of control" at a probation hearing for the BLACK HAWK DOWN star.

Judge ANTONIO BARETTO ordered police guards to arrest the actor in court yesterday (10FEB05) and take him into custody after hearing he had violated his probation terms by failing a drug test.
In his defence, Sizemore told the court he was destitute and living in a garage in Whittier, California. He also claimed to be an expectant father, but Baretto was far from sympathetic, stating, "I had hoped and wanted to see a positive performance."

Last month (JAN05) Sizemore had requested permission from the courts to go to Cambodia to shoot a new film. Baretto had agreed, on the condition that he undergo and pass a drug test every day prior to his departure.

According to the City Attorney, Sizemore failed the test on the very first day.

Meanwhile, Deputy City Attorney ROBERT CHA has told news show CELEBRITY JUSTICE that officials recovered what appears to be a prosthetic penis attached to a pair of Sizemore's underwear with a plastic container filled with clean urine.

Cha states that this device is commonly used to try and falsify the results of urine-based drug tests.

Sizemore has reportedly been caught once before trying to use a similar device.

Bail for the actor, who was convicted in 2003 for domestic violence involving his then fiancee HEIDI FLEISS, has been set at $25,000 (£13,160).

"There are two ways for you to go," superior court judge Antonio Barreto Jr told Sizemore at a hearing. "One is to recover. The other is to die."

Sizemore faces up to four years in jail when he is sentenced next month on charges of methamphetamine possession and violation of probation for a 2003 domestic violence conviction stemming from a short-lived relationship with former Hollywood madam Heidi Fleiss.

Prosecutors said Sizemore, 43, had failed court-imposed drug testing seven times this month alone, despite living in a drug treatment centre.

In one case, he was caught trying to use a prosthetic penis sewn into his boxer shorts and filled with a clean urine sample to fake the results.

The judge rejected a prosecution request that Sizemore be taken into custody pending his March 24 sentencing date.

LOS ANGELES - Actor Tom Sizemore was sentenced Thursday to 17 months in jail and four months in a drug treatment facility for repeatedly failing drug tests while on probation.

Later in the day, he was sentenced in a separate felony methamphetamine case to additional inpatient drug treatment. Sizemore, 43, was allowed to remain free while he appeals a domestic violence conviction.

Sizemore failed seven drug tests, admitted methamphetamine use twice and failed to show up for further testing while on probation for a 2003 domestic violence conviction involving his ex-girlfriend, former Hollywood madam Heidi Fleiss, a prosecutor has said.

Sizemore sobbed, gestured and begged for another chance as he delivered a rambling speech before being handed the first sentence Thursday by Superior Court Judge Antonio Barreto Jr.

He pleaded with the judge for leniency, saying he had broken his parents' hearts and felt like a 12-year-old child. Sizemore also said he was "engaged in a struggle right now to regain the better part of who I am. ... I never thought I had this disease."

"I assure your honor that I'm not acting now. I'm not acting, I'm begging, I'm beseeching you. I can't imagine my future without performing."

Outside court, he gave a high five and directed an obscene gesture at the press.

Sizemore, best known for his roles in "Saving Private Ryan" (1998) and "Black Hawk Down" (2001), was back in court later Thursday for sentencing on the felony conviction for methamphetamine possession.

Judge Paula Adele Mabrey ruled that he was eligible for a drug treatment program and ordered him to submit proof that he was enrolled by April 14.

It would have been in his best interest, and that of his fans (myself included, he's a damn good actor...he has gone from $14 million to $4 million in debt) to have abused Adderall. Hell, that's what every other celebrity has done for the last 60 years. You'd think he would have figured it out instead of doing shitty meth. It is probably one of the most addicting drugs (psychologically), and I know from experience that it's hard to stop longer than 3 days...but with all his money I wouldn't be doing that shit in the first place.
 
Anybody see the special that Dateline or 60 minutes [I forget] did on him...? Pretty entertaining if you like whating a person wallow in self-induced pity. The show made him look like a complete punk.
 
I never thought he was a very good actor, seemed like all the characters he played were 'assholes'. Similar to himself it seems, I don't have a lot of pity for guys who beat women. To go from $14mil to -$4mil you must have to be pretty god-damn stupid. Whatever happened to a longterm savings account ? I know if I was a rich actor i'd definitly have at least 4-5Mil in an account just racking up interest while trying to live a modest life. Screw spending all your cash in a few years just to live the 'high' life.
 
I still don't understand how he went from riches to rags in such a short amount of time, if you were a rich actor you think you'd be smart enough to just buy a couple pounds and not worry about reupping or spending exhorbitant amounts of cash on smaller deals. Either way, this fucker needs to go down. Meth abuser and wife beater, what a fucking loser.
