Tom Sizemore misses LA hearing after checking into rehab program

LOS ANGELES - Actor Tom Sizemore missed a probation violation hearing Tuesday after checking into a live-in drug rehabilitation program, his lawyer said. Meanwhile, officials filed new allegations that the actor skipped drug tests.
Sizemore's hearing in Superior Court was continued to July 22. A bench warrant will be issued for his arrest if he misses that court appearance, Deputy District Attorney Sean Carney said.
"He was in court (last month) when the judge ordered him to return," Carney said. "I don't know how Sizemore could not know he needed to be there."
Prosecutors have said Sizemore violated his probation by trying to falsify a urine test for drugs, failing to report to his probation officer, not advising authorities of his new address and missing drug rehab counseling sessions.
The actor, who played baseball player Pete Rose in last year's ESPN movie "Hustle" and had roles in films including "Natural Born Killers" and "Saving Private Ryan," has denied violating the terms of his probation.
Prosecutors allege Sizemore tried to use a prosthetic device to falsify a urine test for drugs. He later missed tests required once every three days, probation officials said Tuesday.
"We're in the middle of one violation hearing. That potentially triggers a second violation," Carney said.
Sizemore's attorney Gary Meastas declined comment on the latest allegation. He said Sizemore checked himself into a live-in rehab program on Monday in the Los Angeles area but declined to identify the facility.
The idea had been discussed by prosecutors and the court, and Sizemore "took it upon himself to go ahead and turn himself into a program," Meastas said.
Carney countered that the program "certainly wasn't one that the court had in mind."
"It's always convenient when the court orders you to do something and you do something else instead," he said.
If the court finds Sizemore violated probation, he could be sent to prison for up to three years. The actor was ordered into drug treatment after pleading guilty in October to possession of methamphetamine.
Sizemore separately was convicted in 2003 of domestic violence involving his ex-girlfriend, former Hollywood madam Heidi Fleiss. He has been allowed to remain free while appealing.
He was sentenced in March to 17 months in jail and more than four months in drug treatment for repeatedly failing drug tests while on probation in that case.
