Amendment 64 Passes: Colorado Legalizes Marijuana For Recreational Use

Awesome news! Really hope that the Federal Government doesn't manage to squash this before it gets to the point people can actually purchase it legally. Seeing as how 2 states have voted to legalise, I am guardedly optimistic that the Federal Government will have difficulty enforcing cannabis laws there without a lot of criticism.

I have a feeling we won't be seeing DEA cruisers pulling over cars at random to search them for marijuana. The only way the feds would enforce their laws would be through threatening landlords of the properties on which marijuana stores operate (ie what they've done to California's medical dispensaries). So if you live in Colorado and simply grow your own bud in your own home, you should have nothing to worry about.

yeah for you guys in washington and colorodo; yall better start plantin some crops you lucky bastards!! ;)

Honestly i'd rather the federal government fight this so that it goes to the Supreme Court, and the constitution is truly upheld, be made federally legal for the entire U.S.A.!!!!!!!

I think this would be a loser in the Supreme Court, because of the Constitution's supremacy clause:

This Constitution, and the Laws of the United States which shall be made in pursuance thereof; and all treaties made, or which shall be made, under the authority of the United States, shall be the supreme law of the land; and the judges in every state shall be bound thereby, anything in the constitution or laws of any state to the contrary notwithstanding.

just imagine -
when prohibition (of alcohol) was repealed many probably celebrated in the streets; the party would have been epic; the next day the country reeeked of piss and vomit...

Now that prohibition (of marijuana) has been repealed in two states there was probably similar partying in the streets; the enxt day no one woke up hungover; there were no puddles of vomit in the streets... and everyone carried on with their day to day.

You can always grow your own... Other than that you have to buy from a licensed shop. These shops have to have security, provide documentation of where there supplies come from etc... Existing dispensaries get preference towards the licensing process as well as other providers that already have a history of working with the state agencies.

I'm very excited. This has always been the best place I could think of to live and it's only getting better.

Actually, you can't grow your own. That's why I was making a fuss in the other threads. They're only letting you buy it from Government licensed shops and after you pay a fatty ass tax on it

good. i know potheads cant normally see past their own self interest but our state really needs the revenue. you know, for schools and stuff

This is a cool victory, but I am concerned. In 2005, the Supreme Court struck down a California law that legalized medical marijuana in the state. The Court said Congress had the power to criminalize marijuana under the Commerce Clause, which means there is prior precedent for it to happen again.

In an ideal world, the DEA would challenge the State laws and then the Federal Supreme Court would settle the issue in favour of State's rights, but it doesn't seem it would end that way. And you just know that the pharmaceutical companies are already pressing government to come down on this.

Colorado, Washington state legalise pot

In Washington it will no longer be illegal for adults aged 21 and over to possess a small amount of cannabis.

Colorado and Washington have enthusiastically leapt into history, becoming the first US states to reject federal drug-control policy and legalise recreational cannabis use.

The vote puts Washington and Colorado to the left of the Netherlands on cannabis law, and makes them the nexus of a new social experiment with uncertain consequences. National and international media watched as vote counts rolled into Initiative 502's election-night party in Seattle amid jubilant cheers.

"Today the state of Washington looked at 75 years of national marijuana prohibition and said it is time for a new approach," said Alison Holcomb, I-502's campaign manager and primary architect.

In both Washington and Colorado, voters backed legalising cannabis by a 55 per cent to 45 per cent margin. The third state with pot on its ballot - Oregon - turned a similar measure down by the same percentage.

In Washington, as of December 6, it will no longer be illegal for adults 21 and over to possess an ounce of marijuana. A new "drugged driving" law for marijuana impairment also kicks in then.

Tuesday's vote also begins a yearlong process for the state Liquor Control Board to set rules for heavily taxed and regulated sales at state-licensed cannabis stores, which are expected to raise $US1.9 billion ($A1.83 billion) in new revenue over five years.

Many legal experts expect the US Justice Department to push back and perhaps sue, but Seattle City Attorney Pete Holmes said Seattle's US Attorney Jenny Durkan told him on Tuesday the federal government "has no plans, except to talk."

Initiative 502 ran a disciplined campaign with a tightly focused message, criticising what it called the failed "war on drugs" without endorsing marijuana use itself.

I-502 spent heavily, raising more than $6 million, including more than $2 million from Peter B Lewis of Ohio, chairman of Progressive Insurance.

A broad group of mainstream leaders - including former top federal law-enforcement officials, the King County sheriff, the entire Seattle City Council, public-health experts, African-American leaders and the state labour council - backed the measure. John McKay, US attorney in Seattle under the George W Bush administration, became a public face of the campaign.

The initiative faced surprisingly little organised opposition. The Washington Association of Sheriffs and Police Chiefs and a state drug-treatment-prevention group were opposed, but did not raise money to counter I-502's $2.8 million TV-ad spending in October.

The loudest opposition came from some in the medical-marijuana industry, who said they feared being ensnared by I-502's DUI law, which does not exempt patients.

I don't use anything now not even alcohol but I think they should decriminalize it like it is in Spain where you can have a small amount for your own personal use in your home or somewhere not in public, and you can grow some plants.

Maybe in Washington. The Colorado amendment allows individuals to have six plants in their home.

'in their home' as in enhanced hydro growing is ok? It's not 6 outdoor plants?

That's cool tho.

man i really hope this is allowed to go through without being halted by the federal government. have any time tables been laid out on possible times for this to take effect? i'll be in colorado earlier next year and would love to toke on some nuggets and add to colorado's revenue.

Im pretty sure i read they have 30 days to actually sign the bill (its already passed though) but it could take several months to a year to get this shit going... hopefully not though but either way its a good huge step for humanity!

the federal gov may not be able to flat out stop it but they can refuse vital funding for other state needs along with continuing to prosecute marijuana offenses on a federal level

If I were the people in CO, I would avoid growing plants until it seems like the law is going to stick around. You wouldn't want a full blown crop happening if suddenly it becomes criminal again.

Thizz is correct, an adult 21 years of age can posses up to six plants, with a maximum of three flowering at one time.

I'm really excited about this law, provided that all passes and the feds don't swoop in and screw us over. For me, it's not even so much about the legalization as it is the decriminalizing - so many resources are misspent arresting petty criminals for trivial amounts of weed...not to mention the tremendous tax revenue this will provide our state, with the first 40 million annually going to fund public schools.

I just wanted to pop in and congratulate you guys in the states that managed to pass this, this has been a looooooooooong time coming and I hope y'all enjoy the benefits. The biggest win in my opinion is for all the people out there that will be avoiding a stint in jail/prison for a minor crime like holding a bit of cannabis.

As a citizen of a southern state where it's going to take 20 more years to get anything like this even on the ballot I gotta say, I'm jealous and I'm considering sucking it up and moving to a place where it is too damn cold. ;)

Good for you guys, and I hope that this will get other states (and eventually the feds) to take notice and change their ways. As bad as things are right now in this country it's refreshing to see it getting a little better for some. Come first of the year I hope all of y'all exercise your right to buy and smoke legally, just please be responsible, because now that we're making real progress you can bet your ass the media is going to be looking for anything to put up on the screen to point at and say "See! We told you! Pot is bad and those dirty dopers are out there driving around high!".

Again, congrats to y'all and thank you for getting out and voting.

I think it's apparent that the laws were passed to take money away from growers and sellers and put it into the hands of the government. I'm glad we still have medical marijuana only in California to be quite honest.
