Yopo is illegal! AMA

Were your seeds discovered amongst drug paraphernalia? Or even near a way to prepare the seeds for use?

Also, did you argue your case, and how?
 
Yes lotss of paraphernalia was found but none in relation to the yopo seeds.

My lawyers said there's no way my case was gonna get dismissed since the seeds were containers for an illegal substance [I got charged for felony possession of a schedule 1 drug (bufotenin).]

After a lengthy and expensive legal process, today I accepted a plea bargain of 2 years probation and substance abuse counseling with no chance of appealing.

I got the stuff off ebay for like 8 bucks.

Bufotenin has been illegal for many decades my friend! These are the kind of things you really want to learn before ordering. Yopo has always been a risk. However, I'm going to have to add to the question how were they discovered? Simply containing a schedule I substance is not instantly enough to make it illegal, there are ways to get yourself out of that depending on the situation. Yopo itself isn't illegal, just like San Pedro isn't.
 
First off, what's the "AMA" about, aside from American Medical Association? Secondly, looks like you got railroaded by some small town justice system. Surely this didn't happen in a major city? Where's the analysis showing the bufotenine content of the seeds? How did they even know they were Yopo seeds unless you told them? How the fuck do cops know about Yopo seeds? You could have said it was a snack from the health food store. Was the label still on them or something? You could have got off from this so easy. You are the first and only person ever to be convicted for Yopo sees in America. That's how hard it is to convict anyone for it. You must have had the worst lawyer in town. The search of your car alone probably could have been ruled illegal and all evidence thrown out, unless you were crazy enough to agree to the search. The plant is legal to grow as an ornamental anyway, like opium poppies. All you had to say is that you were planning on growing them in your yard for decoration.

I can't believe you let this happen to yourself. You have a record for fucking Yopo seeds now. WTF? You will never live this down. Also, never plead guilty. Always drag it out to a full trial. Chances are, it would get dropped or you would at least have time to research the case yourself and not do what stupid layers tell you to do.

Oh, I guess I should have looked up a list of texting abbreviations. hadn't seen that one before. Okay here's a question for the OP; where did your lawyer come from, court appointed? He must have been an idiot to actually let you plead guilty for something that's not even illegal. The fact that you said the process was lengthy and expensive pretty much shows that the lawyer was using you as his golden goose. I suppose you could have been convicted for the paraphernalia but I don't see how you could have been convicted for yopo seeds. I checked ebay and there are sellers based in the US. If yopo seeds were illegal obviously those people would have been jailed long ago. Sue his ass for malpractice or whatever it's called when a lawyer gets you convicted for a non-crime.

Also, from now on whenever you come into contact with the police you should say nothing other than your name and date of birth, just like a prisoner of war says nothing but his name and serial number. Show him ID if he asks for it. Aside from that just stand or sit still and do or say nothing whatsoever. Without you feeding them information, the entire onus is on them to prove your guilt. If they ask if you mind if they search your car or home don't even reply. Like I said, just fucking sit there and keep your mouth zipped. It will pay off bigtime if it ever gets to court.

Under what circumstances were said seeds found?

State troopers searched my car without consent or a warrant. They found a backpack in the trunk of my vehicle where the spare tires goes. They found the seeds and brought me to the state police barracks for processing.

You're correct, I was rail roaded in a small town, in the smallest state in the nation, Rhode Island.

Good question about analysis showing proof of bufotenin. After an 8 month legal process, I was never shown any proof and the topic was never brought up.

Unfortunately, the species name of yopo was on the bag containing the seeds.

So you really think I'm the first case in America.. What about the world? It seems so. 8(

Approximately 6 officers arrived and searched my car because the first state trooper at the scene said he smelled marijuana.

My lawyer said the plant is absolutely illegal, no matter what the reason or excuse for having it is. Due to it containing an illegal chemical, bufotenin.

I didn't plead guilty, I pled nolo contendere.

Had I gone to trial, the prosecutor said she felt she had an overwhelming amount of evidence to prosecute me and I would have been sentenced to 1 year in prison.

The judge said the maximum penalty for my charge is 5 years in prison.

I had a private lawyer which represented me on my past 2 court cases. I accepted a plea bargain so technically I'm not 'guilty,' still got screwed though.

You may very well be correct about being a golden goose. :X

I mentioned how I got the smallest amount of seeds possible off ebay for 8 bucks and my lawyer didn't care about that.

If i were to sue my lawyer for malpractice, that would probably cost even more money than my court case, no?

As for just saying your name and date of birth to an officer, they'll still search and arrest you if they want to. I pled the fifth, that just really pissed them off and they arrested me after patting me down and searching my entire car, including the hood and tires.

I was pulled over a few days ago for speeding and again the state troopers told me to get out of my car. They interrogated me, asked if I had any explosives, asked what drugs I've done in my entire life and searched my vehicle again. Just for going a few mph over the speed limit. Now I have to go to a hearing at the Traffic Tribunal next Thursday.

You also say that the police searched you illegally. Despite what anybody from the court told you, if the search was truly illegal, the court could not have proceeded in the trial.
 
The seeds still aren't illegal in the U.S. unless intented for human consumption. Poppy seeds aren't illegal, they contain morphine but they're sold in grocery & flower stores. Also HBWR & morning glory seeds aren't illegal either & they contain LSA, a schedule 3 drug plus they contain schedule 1 precursors to LSD. Tell the court you wanted to grow them there's absolutely nothing illegal about that. Or is it too late? What was ur sentence?

& hasn't bufotenin been illegal since 1969? It's 5-HO-DMT right? The seeds also contain DMT & 5-MeO-DMT. It doesn't matter if the seeds contain illegal drugs they're still legal. You got fucked over & ur lawyer is ignorant.

Wait... 5 years in prison maxium for yopo seeds & paraphernalia!! What state are you in? 5 years is the maximum for manufacturing & distribution (not intent either) in NJ. Unless you have like 10 ounces of Heroin or other or a huge amount of another schedule 1 drug than it's 10 years maximum. Even if you were manufacturing 1000s of kilos the most you can get is 20 years.

My lawyers and the State of Rhode Island insist the seeds are illegal due to containing an illegal schedule 1 substance (bufotenin).

They said bufotenin is illegal under the Controlled Substances Act.

No matter what argument or excuse I had, they were intent on penalizing me.

I had to go to court almost 20 times after an 8 month legal process.

I got sentenced to 2 years probation with substance abuse counseling.

Originally they wanted to give me a 3 year suspended sentence.

Sounds like they were intent on pounding you in the butt. I really hate the judicial system in this country at times. You know, those times when it seems like one big greedy scam.
 
Sounds like BS to me. Unless there was proof that you intended to consume the seeds they shouldn't be able to charge you under US law. You just as likely could've been an exotic plant collector, or just thought it was cool to grow a plant that tribes in south america hold as holy. Not sure what you can do now though, since you already accepted that plea bargain.
 
Sounds like everyone involved from the cops to the lawyer to the court are a bunch of corrupt motherfuckers.

This country's drug laws need a 100% makeover from top to bottom, in fact, more like a facelift.

But it will never happen.

The fact that it's so hard to even get weed decriminalized shows there's no hope for anyone ever coming to their senses concerning legalization/decriminalization of even MORE substances.

Hell, even Amsterdam went back and made shrooms illegal again.

The world wide issue of a person's right to consume mind altering substances other than alcohol is permanently fucked.

Even those substances which slip under the radar, from Kratom to nitrous to RCs...it's still just a matter of there not being enough of a stir for them to be made illegal.


World wide, even including Amsterdam and the most liberal countries and parts of the world, there's literally zero political understanding or acceptance across the board that anyone should be allowed to use any drugs other than alcohol, caffeine and nicotine with the sole intent being to explore consciousness.


Even mind altering prescription drugs can't be obtained by simply being honest that one just wants them to explore consciousness (IF that is the reason in this case).

I wish we could go back to perception of drugs the way the Native Americans saw them...as either good or bad "medicine", but still never outlawed.

No chance of it ever happening in this fucked up world so there's only two things a person can do about it:

1) try to take some kind of political stance on it (good luck and I don't even know what's involved)

2) do your best not to get caught doing it

The craziest part is it's because of us (the USA) that drugs are illegal in all countries around the world!!

Some just choose to look the other way.
