I've seen a link on here before which was very interesting, it contained links of cases and what sentences were given for various crimes and why they were given, taken from the remarks of the judge himself.

Example: "I understand you had a troubled childhood, this by no means excuses your actions, however I can see how it could have contributed to your state of mind at the times of your offenses. I have seen genuine remorse for your actions and I believe you have a great chance of rehabilitation. Since being arrested you've managed to undergo treatment for your issues, find full time work and are regularly attending counseling. I also took into account the many glowing references from respected members of the community and that this is your first offence. However, I must deter this kind of criminal offense, therefore, I sentence you to X, fully suspended. Don't let me see you again."

That kind of stuff.

I am interested in recent Victorian specific drug cases, is there any website online which lists this kind of information? I seem to remember the ones I read were from SA.

Thanks.

Thanks RaveOne and Mel, just what I was looking for. Wish I didn't need to browse these.

Anyone have experience with extra charges being added on the day of court, and whether or not that allows for adjournment?

sounds like you may be in some sorta trouble with the boys/dogs in blues opi8.

I hope everything works out for you in the end dude.

Some advices for you bro

1. if it was a drug related crime, check your self into a rehab facility asap, and try your best to make the councilors in there believe you are a changed man, etc and try and get em to your charactor witness etc

2. Get a good lawyer yo! Every money spent on a good lawyer is money WELL SPENT!

3. Get a Full/Time Job YO. Having a fulltime job a time of sentencing will make a huge difference between getting a sentence and actually serving it or getting a sentence and get suspended sentence ontop of it so you dont neeed to do any time inside.

<3 best of luck bro !

Are there any NSW court cases? A good friend went down a while ago and would love to know what actually happened:S

I think the "traffickable quantity" bullshit needs to change. When you've got a decent habit, 3 grams of ice, coke or heroin is not going to last you more than a couple of days. You don't want to be buying every day or two, especially if you've got to work it around life such as work, appointments, family etc. Even more so if you need to travel a fair distance in order to score. That's what really shits me, courts don't take into account the circumstances of why someone would be caught with a traffickable quantity, especially heavy users.

I'm fully aware a paid lawyer is 100 times better than one appointed to you by legal aid, or whatever the equivalent in other states. However, money is hard to come by for a lot of drug users who get caught up in the legal system, especially if, for example, all the money they had was spent on drugs, which was confiscated by law enforcement when they got busted.

I agree opi8. A friend of mine had his house raided for an unrelated offence, and in the process they found 40 ecstasy tablets. They wanted to charge him with supply/ trafficking but his lawyer argued they were for personal use (all in one bag) and the reason he had said amount was because they were strong pills and got them cheaper. Charge downgraded to possession. If you don't have a history of dealing/ supply and you're caught with a decent amount you can always argue that they are personal use. Me on the other hand, if I'm caught with a few (over 5) I'll be charged with supply as this is already on my record.
