BATTLE CREEK, Mich. (WZZM) - Now that medical marijuana is legal in Michigan, can an employer fire a worker who tests positive for the drug?

WalMart says it can, so it did. "I was terminated because I failed a drug screening," says former WalMart employee Joseph Casias.

In 2008, Casias was the Associate Of The Year at the WalMart store in Battle Creek, despite suffering from sinus cancer and an inoperable brain tumor.

At his doctor's recommendation, Casias says he legally uses medical marijuana to ease his pain.

"It helps tremendously," he says. "I only use it to stop the pain. To make me feel more comfortable and active as a person."

During his five years at WalMart, Casias says he went to work every day, determined to be the best.

"I gave them everything," he says. "110 percent every day. Anything they asked me to do I did. More than they asked me to do. 12 to 14 hours a day."

But last November, Casias sprained his knee at work. Marijuana was detected in his system during the routine drug screening that follows all workplace injuries. Casias showed WalMart managers his state medical marijuana card, but he was fired anyway.

"I was told they do not accept or honor my medical marijuana card," says Casias.

In an e-mail from headquarters, WalMart spokesman Greg Rossiter explained the company policy. It states: "In states, such as Michigan, where prescriptions for marijuana can be obtained, an employer can still enforce a policy that requires termination of employment following a positive drug screen. We believe our policy complies with the law and we support decisions based on the policy."

Casias says he never used marijuana before work.

"No, I never came to work under the influence, never," he says. "I don't think it's fair. Because I have a medical condition I can't work and provide for my family?"

Casias has been collecting unemployment compensation since he was fired in November but this week he says he was notified WalMart is challenging his eligibility for benefits.

"It's not fair," he says.

Wow, that is blood boiling.

I am truly offended by this! My girlfriend was severely injured in a car accident more than 2 years ago by her drunk driver of a boyfriend... (he is now serving a long sentence with long probation and 2 years without license)

My girlfriend will never work again, at least I can't imagine it... possibly an online business in 5-10 years, but that is at best.

IF she ever found the will to get back to work, she would not be welcome to work at wal-mart because she uses cannabis under doctors prescription?

What about all the people that are probably prescribed (and deserve) oxycontin for their pain they indure everyday, are those people also fired?

How about all the people with anxiety disorders who take benzos.... amphetamine for ADD? Wouldn't a drug test pick up on those prescription drugs also, is it safer to work under the influence of clonazepam or marijuana? Wal-mart should not have any say in what is and is not safe to work under the influence of.

This is sad... I think that a much more fair and smart business (fantastic publicity) should hire this man full time in spite of wal-marts bullshit claims.

The man needs and wants to work... someone offer the dude a position!!!

There was a lady here in ontario who was working at a national coffee shop, she gave a small donut to a young child when the child was having a fit, the customer/mother was glad and thanked the woman... these donuts are often given to dogs at the "drive-thru" and the lady was fired for theft... very unjust.... it was all over the local media and there were companies offering her different jobs left and right....... The man with sinus cancer should get a fantastic job offer!!!

What cunts.

Idiots too. They don't have to tell you why you're being fired: all they have to do is hand you a letter saying your services are no longer needed.

Or is that just Florida?

In either case, humanity is an enormous cunt.

wow! our government needs to step up and federally mandate medical marijuana so this kind of shit doesn't happen.

No. The federal government has no constitutional authority to regulate drugs. That's the domain of the states. To be constitutional correct, the federal government should back off and repeal all federal drug laws, abolish the DEA, FDA and the HSS (and most other federal extra-constitutional agencies). That will never happen though.

The government wants "this kind of shit" to happen. Big pharma, alcohol and tobacco lobbies tells politicians what to do. So the common people get ass raped just for excercising personal choice.

This issue rises time and time again. I feel the groups organizing to push for new MMJ laws in non-MMJ states should start to include employee protections in to the law. I can't see how people who would vote for MMJ would be opposed to a provision in the law protecting people from workplace discrimination. Why not treat MMJ just like how other powerful prescription drugs are permitted in the workplace due to medical necessity?

It is to unreliable to simply hope for better laws to be enacted once the initial law is passed. California, 14 years after passing prop 215, still does not have an employee protection law.

Walmart is a shitty, worthless, parasitic entity. If you haven't realized that fact yet, you've been living under a rock (or in Arkansas).

I haven't stepped foot in a Walmart in ten years. There are more important reasons to boycott them than this.

Walmart is a faceless cooperate machine, I expect nothing more from their intolerable decisions and poor service.

I once worked for this Company and you wouldn't believe the amount of bullshit that flows through its veins. In fact a few months ago I received a settlement check for $100. 8)
