A judge in Virginia has been sentenced to 30 days in jail for growing more than 40 marijuana plants in his home, according to the Associated Press.

Attorney and substitute judge James H. Allamong Jr. was sentenced on Monday after the felony charges were knocked down to a misdemeanor.

The marijuana plants were discovered by fire fighters last year who had responded to a blaze at a building near Allamong’s home. He said the plants were purely for personal use and that he used to drug to treat the pain from injuries he sustained in Vietnam.

“That’s the only reason I had the stuff,” he told NVDaily.com in 2011. “Obviously, I wish I had an opportunity to go another way, where you can get medicinal marijuana in Virginia, but that’s not an option.

“I was wounded in Vietnam from a severe concussion blast and had severe joint and hip problems that just are debilitating.”

Allamong was also received a $500 fine, two years of probation and 200 hours of community service.

he got off light for growing in virginia. minimum sentence shoulda been 5 years

hmm 30 days for 40 plants? yeah thatll give him time to change.. or wait, itll give him time to do absolutely nothing, and then go back to the courtroom and resume convicting people for drug possession. horray!! liberty and justice for all of the 1%!!!

This is typical for Virginia...and for most of the South I hate to say it.

If you're connected in the political system (which a judge is - even though they're supposed to be just part of the justice/"justice" system) - you can get away with anything you want.

There's no way he was growing 41 plants for personal use...

I got the same sentence in georgia for having less than a dime bag and a gas mask... This is bullshit.

Pffft. 40 plants is definitely a personal amount. If he was growing quickly and only vegging for a few weeks he would probably only be looking at 2 ounces of trimmed bud per plant. 80-90 oz sounds like a lot, but I am sure I smoke that much every year myself.

^ Really?!
That means almost 2 oz per week.
8 or 9 grams / day.
Every day.
For the whole year.
And I don't know about you, but the guy was in a lawyer's office or at trial for at least 8 hours a day (most lawyers and judges work more than 8 hours), which left him around 8 hours of awake time...
= A gram an hour, 8 hours a day 8o

I know that some people roll 1-gram joints, and smoke them every hour.
It is not impossible. Even with good-quality homegrown weed, people can do it.
But those are the very serious smokers.

As a comparison, when I am addicted to weed, I smoke around a gram a week (of high-quality weed). I am high nearly all my waking hours.

And, your assumptions that he was growing quickly and getting a minimal amount from each plant , and that he was only growing one crop a year, easily could not be true.

So, to call it "definitely a personal amount" seems a bit silly to me!

I don't think he got of too lightly. Consider his age and the fact he was a veteran with (probably) no priors. Not to mention the fact he had money and/or contacts. Hell, I've bought my way out of a few jams in my life when I had the money, when I didn't I got burned. Plus he got 200 hours community service which stinks. I'd rather do time than community service. His 30 days will probably in single cell confinement which also is not pleasant.

I watched a nat geo special on solitary. solitary confinement is one thing, and id be pissed, but come on 30 days? thats pretty weak. some of the dudes doing life sentences are only in there for breaking stupid ass rules in prison. and you can tell after a few years in a small room for 23 hours a day, your psyche starts to deteriorate. and forget about rehabilitation, youre not free when you get out, youre warped. its a lengthy process of psychological reintegration back into society thats taken so much away.

If you consider the very real possibility he could be making himself edibles, which can be consumed while at work, and the fact that oral dosages are higher than smoked, it isn't impossible.

The quality of his weed may not be the best either.

I did 6 years in North Carolina and 3 years in Angola (LA) throughout the late 80's and 90's and I can tell you 30 days in hole sucks.....really!! Don't know bout supermax life but after 2..3 years your mind probably gets kinda(?) right.

no youre totally right. i really dont know what im talkin about. when i said weak i meant theres an obvious disparity between a month in prison for 40 plants and the 30 years that most average drug related crimes will get you in for.. that dudes lucky.

All true, or possible.
But likely?
Eating weed makes the trip last longer.
If I ate 2-3 grams of decent weed, I would be completely off my rocker all day, despite 25 years of experience with weed.
He needs to eat 8 grams a day to use up that many plants in a year!
