So A friend of mine asked me a very good question. you see this friend isnt a heavy drug user but several close friends have substance problems. One night they were driving home from the bar and got pulled over by police. Said friend was driving and was found to be within the legal limits. (Only had two cocktails within a 4 hour period) The police let him drive home with no issue. He dropped two friends off at home and one slept at his house.

Three days later while at work this friend had to go search for some documents in his car. While looking in the pocket behind the passenger side seat he found two oxycodone pills and on alpazolam bar. He knew in his heart that these belonged to a friend that was in the car that night. In fact this friend was a heavy pill user and had a major problem mixing copious amounts of alcohol with sedatives and is constantly in possession of these exact pills that were found behind the seat. This friend has NO prescription and obtains them illegally.

SOOO, if this friend were to have been pulled over and searched AFTER this night, with no one else in the car would there be a way out of a possession charge without throwing anyone under the bus? I mean if this were to happen this friend would have no way of knowing if these drugs were in the car. It seems rather unfair that ones record could be ruined for someone elses blatant fuckup and disrespect. Also take into consideration that this friend has no serious prior run ins with the law. Some tickets, traffic violations and I believe a DUI from about ten years ago. Thsnk you folks kindly!

EDIT: The suspected individual also is known to use heroin, it would be beneficial to know if there would be a difference in severity of charges for a small amount of heroin as well.

We don't have legal discussion anymore here at Bluelight. I'm confused though, if it's a hypothetical situation or this actually happened. If this happened for real, your friend should seek advice from an attorney.
