But I think it means if they catch you with a white powder they will have to arrest you while they test what it is. Once you're arrested regarding drugs you can kiss goodbye to ever visiting the USA etc.

So while it's "good" that it won't be an offence, being caught with it will still be perfectly capable of fucking up your life.

^^ This is a fair point, but this legislation doesn't affect that for better or worse, since it's still a suspicious looking white powder either way.

Though, I'm not sure how it works state-side, but iirc in the UK your arrests are not on your criminal record, only anything you have been charged for - so while technically you're breaking the rules by saying you haven't been arrested when applying for a visa - there should be no way of anyone knowing, provided you weren't charged :D
 
While this specifically isn't the worst piece of legislation, it sets a bad precedent or how they deal with these things. And you can bet that they won't just leave them unscheduled after 12 months. The banning will lead to a spike in popularity but no drop in availability, which will make it easier for them to push through a full ban.
