Drug driving limits announced
Legal limits to prevent drug driving have been set out for the first time by ministers in new laws which will come into force this autumn

By Nick Collins,
27 Mar 2014

Drivers will be allowed to get behind the wheel if they have traces of illegal drugs such as cocaine or cannabis in their system under new drug driving limits being set by the government for the first time.

But motorists who exceed certain thresholds of eight prescription and eight illegal drugs including cannabis and cocaine will be prosecuted for being “over the limit” in the same way as drink-drivers.

Ministers also accepted they would have to re-examine a proposed limit for amphetamine to avoid the risk of prescribed medicine users being unfairly penalised.
The limits for each individual drug reflect the speed at which they are broken down by the body, and are designed to prevent people being prosecuted for taking medically approved quantities of prescribed drugs or having tiny traces of illegal substances in their body.

The government decided to set permissible amounts, rather than a “zero” limit, because certain prescribed medications can leave trace effects in the body.

A limit of zero for illegal drugs would have risked people being penalised for accidental exposure such as inhaling cannabis smoke in a public place, or for having traces of substances in their system long after all effects have worn off.

The new limits, set by the government following a consultation on advice of doctors, include 10 micrograms of cocaine, two micrograms of cannabis and one microgram of LSD per litre of blood.

For prescription drugs, limits include 80 micrograms of morphine, 500 micrograms of methadone and 550 micrograms of diazepam per litre.
In comparison, the legal limit for alcohol is 80 milligrams of alcohol per 100ml of blood – the equivalent of 800,000 micrograms per litre.

The laws are part of the first legislation making driving with specified limits of drugs in the body an offence.

Ministers said they would have to revisit a proposed limit on amphetamine of 50 micrograms per litre of blood, because there had been “significant concerns” raised during consultation.
Doctors feared patients taking medically approved levels of attention deficit hyperactivity disorder medication could have crossed the proposed threshold.

Robert Goodwill, the road safety minister, said the limits sent “the strongest possible message that you cannot take illegal drugs and drive”.
“This new offence will make our roads safer for everyone by making it easier for the police to tackle those who drive after taking illegal drugs,” he said. “It will also clarify the limits for those who take medication.”

David Bizley, technical director of the RAC, said the limits were “clearly good news for law-abiding motorists”.
Edmund King, president of the AA, added: “Official figures show there are around 200 drug-related deaths on our roads each year but we believe that the figure is much higher as victims aren't always routinely checked for drugs after crashes … it is heartening that progress is being made towards taking drug-driving off our streets.”

thats quite the limit for LSD?

thats way to low for grass.. i think the sates are at five micrograms and people were seemingly driving fine at almost three times the legal limit. but really why do we need to drive high?

I think this is good as it could be looked at as a step in the direction of legalization.

500 micrograms of methadone.. How much would you need to have to go over that limit?

This is what was included in the proposal to parliament, I assume it will all make it to legislation

LSD is out of your blood the next day, since i wouldn't drive on it ever i don't really care. Pot on the other hand scares me. Can't you smoke a large amount and be over 2 micrograms for pot days or even weeks after use? I was under impression it is impossible to prove how long ago pot use was. I still haven't seen anything that can prove I am stoned on pot right now and my use wasn't a long time ago.

Interesting recent blog post by David Nutt on this. If I am reading this right, it seems the gov has backtracked somewhat and is actually using limits instead of zero-tolerance machoism. I don't have good browsing access where I am now. Does anyone know how the new limits listed above compare with the original research?

No this video shows hopw it works.

Here's a (very simplified) pharmacokinetic analysis with the help of DrugBank:

It seems like the limits, for these four drugs at least, are not unreasonable.

I thought the oral bioavailability of methadone was much higher than that.

So long as the other info is correct, over 400mg's is reasonable, thanks for finding that SJB.

Morphine is a slight worry though, 65mgs orally isn't much, that means the limit would be 20mg IV? That would barely make most addicts well, compared to over 400mg of methadone, which is huge, it's a bit low.

everything i have looked at seems to suggest that it will be detectable in your saliva for 4-8 hours after smoking a j

Regarding cannabis, we (Aus) have had road side drug tests (saliva tests) for years and from what I have been told it is only weed in your system from approx the last 4or 5 hours that will show up. One BL'er once said he was tested 3 and a bit hours after smoking bongs and he was apparently still under the limit.

This is a long way becoming law in the UK the information is a response to proposals, see government link to full paper :-

https://www.gov.uk/government/consultations/drug-driving-proposed-regulations

I'm no law expert but I've read a number of times in the past that such legislation presents a significant legal problem in that it effectively states a 'legal' level of an illegal substance.

Current law only requires that you are deemed unfit through drink or drugs to drive, technically even if you pass the alcohol level test you could still be prosecuted.

The UK seem no closer to even decriminalising cannabis having switched it back to a Class B substance from the previous Class C classification.

I always assumed it could be considered possible for, if this law is to be enacted, to be prosecuted for being in possession of illegal substances but not be prosecuted for driving while under the influence.
Impaired driving and possession of illegal substances are two separate crimes.

I thought the oral bioavailability of methadone was much higher than that.

From DrugBank:

"The bioavailability of methadone ranges between 36 to 100%."

I took the lowest values for bioavailability, I meant to change the bioavailability values to the median (which would have been 68% for methadone) but forgot. All of the other values are medians, when a range was present.
