Two plead guilty to having LSD look-alike, likely first case of its kind in Coles County

CHARLESTON (JG-TC) — Two people admitted to having an LSD look-alike in what the case’s prosecutor said is the likely the first of its type in Coles County.

Sara E. Douglas and Michael A. Imburgia both pleaded guilty to charges accusing them of having a substance, which has a similar effect as LSD, in Charleston during April of last year.

The chemical compound they had is a hallucinogen as LSD is but isn’t actually listed as an illegal substance in Illinois law, according to Assistant State’s Attorney Bryant Hitchings, who prosecuted the cases. However, Douglas and Imburgia were charged under laws that make it illegal to have and distribute a substance they represented as a narcotic, Hitchings explained.

Douglas, 20, for whom records list an address in Chatham, and Imburgia, 22, whose address on record is in Mount Prospect, pleaded guilty to charges of possession of a controlled substance analog, a felony offense. Hitchings said they were Eastern Illinois University students when they allegedly had the substance in Charleston on April 13, 2012.

With the agreement reached in the two suspects’ cases, both were sentenced to two years of what’s called “first offender” probation. The sentence allows for no record of a conviction if there are no violations of the probation requirements.

Hitchings said the compound the two suspects were accused of having is manufactured as a narcotic but its relatively recent appearance means it’s only illegal in a few states. The first time police in the United States encountered it was in 2010, he said.

“It’s kind of a recent synthetic that’s entered the U.S. from Europe,” Hitchings said.

Officers with the Mattoon-based East Central Illinois Task Force drug investigation unit arrested Douglas and Imburgia after an investigation that began based on tips to police, Hitchings said. He added that Douglas and Imburgia were suspected of having the drug and providing it to others but not manufacturing it.

Douglas was originally charged with possession and delivery of LSD but those charges were later dismissed, and Hitchings said that was because lab results showed the actual makeup of the compound. New charges alleging the look-alike substance were then filed against her and against Imburgia.

Hitchings said the substance the suspects had was placed on perforated paper squares, the same way LSD is divided into doses.

The charge to which Douglas and Imburgia pleaded guilty could have resulted in a prison sentence of one to three years. A charge of distribution of a look-alike substance against each suspect, which could have resulted in two- to five-year prison sentence, was dismissed with the agreement reached in the cases.

Probation terms for both Douglas and Imburgia included substance abuse treatment and payment of just more than $6,000 in fines. Each also received a six-month jail sentence but that was stayed, meaning the jail time won’t be imposed now but some or all of it could be ordered later if there are any violations.

Circuit Judge Mitchell Shick sentenced the two suspects under the terms of plea agreements that Hitching and defense attorneys recommended. Springfield attorney Daniel Fultz represented Douglas and Bret Rich of Clayton, Mo., was Imburgia’s attorney.

I think they said all they needed to. 8)

Fake drugs lol smarts there

Nobody needs to get busted you Fed.

Chemical$ Welcomed

Those laws against fakes dont bother me when they charge people for Piperazine "xtc" or baking soda "crack" or lettuce "weed" because rip offs suck. Those are 3 things less dangerous then the the real thing though. But when its something like PMMA in the ecstacy supply people need to be warned. Someone is asleep at the switch there to not recognize that nbome blotters are much more dangerous than LSD. Someone read those test results and warned no one. Its probably out of ignorance though. The MDMA supply has been crap for so long with such a variety of crappy chems the people who got the print out probably didnt even know what nbomes even were. The police where i live are the opposite, if they find you with meth laced weed they issue a public warning, even if you added meth to your own weed, not for sale, just for you.

i don't think either are that safe really

these kids got a pretty light sentence and probably made enough money doing this. Just the result of prohibition though, and assholes, unless they were telling people what the chem was, which is unlikely, because most people are afraid of chemical names and won't buy it.

where do they get their info for these articles? it's not a narcotic for one and it comes from China (for the most part). You can order shit loads of it from China directly. Not Europe, they likely get it from China too. China's research chemists and labs must be making a ton of fucking money. I don't know any RC company in NA that has a domestic lab that manufacturers such chems, especially in the US with that analog act bullshit. It's just easier to import it.

Still missing the point about fake drugs...

The wrong drug being sold to you still doesn't equal a fake drug, it means wrong drugs...

I want powdered coke but get sold mephedrone, is it a fake drug? I most certainly think not...

If you say it's LSD and it isn't then it's "Fake" because it isn't authentic LSD. Just like fake rolexes, sun glasses and so on. It doesn't mean the fakes aren't sunglasses, it just doesn't make them real Ray Bans.
I think you're just taking it too literal.

Ill eat my RCs as long as they are represented truthfully.

So much 'acid' is fake. Good luck if youre looking on the streets.

Federal as fuck

so the drug wasn't illegal in that state and they were charged with selling fake LSD? and like rickolasnice said how do they know they were marketing it as LSD does the drug typically come on blotter paper?

pretty sure the article is just being vague either out of ignorance or on purpose; but they are going to be charged with selling an analogue to a scheduled substance, under the analogue act, which is a pretty rare occurrence and as you can see, doesn't really get you in much shit compared to selling the real deal anyway.

it really doesn't matter what drug they were trying to sell it as (there's nothing saying they weren't representing it truthfully) they are still in possession of what is now an analogue to a schedule substance. I guess 2c-i, if it was 25i-nBOME. I'm not up to date on US drug policy but i don't think 25i is banned federally, just in a few states if anything but 2c-i is schedule 1 right now isn't it?

^ This.

But did they actually sell it as LSD?
This was in Illinois. I guarantee they were intending to sell it as LSD to some kids. I can't remember the site but you Can check out peoples cases online to the poster who wanted to know more but you need a first and last name.

Therefore it is not fake, it is something else...

^ so you accept being sold piperazines as "ecstasy"?

I don't :|

If you say you have some acid for sale, it better be LSD or I'm going to be upset after buying it and having it misrepresented as LSD.

I like to know what drug I'm actually taking... I don't have a problem drugs that are labeled properly. Don't call a duck a squirrel just because they are both animals..
