United States Attorney David R. Dugas announced today the unsealing of a federal grand jury indictment that was returned on July 14, 2004, against Michael Burton, 3712 Zenia Street, Las Vegas, Nevada 89103. The indictment alleges that Burton is the operator of the Internet website
WWW.AMERICANCHEMICALSUPPLY.COM and charges Burton with four counts of using the website to distribute analogues of controlled substances in the Middle District of Louisiana, in violation of 18 U.S.C. § 841. Count One of the indictment further charges that James Edwards Downs, age 22, died as a result of using 2C-T-21, one of the chemicals allegedly distributed to him by Burton. Burton was arrested yesterday at his home in Las Vegas, Nevada, and a search warrant was executed to seize evidence from his residence.
As a result of additional evidence gathered during the arrest of Burton and the search of his residence, DEA agents obtained a criminal complaint yesterday afternoon against Burton's roommate, Keith Russert, charging Mr. Russert with four counts of distribution of analogues of controlled substances.
The investigation and indictment of Burton are part of "Operation Web Tryp," a nationwide Drug Enforcement Administration (DEA) initiative targeting multiple Internet web sites that distribute designer drug analogues under the guise of being "research chemicals." The products sold by these web sites are synthetic substances chemically identified as tryptamines, piperazines and phenylethylamines. Some of these substances are specifically restricted under the Controlled Substances Act (CSA) while others, when intended for human consumption, are controlled under the Controlled Substance Analogue Enforcement Act (CSAEA). The products are often purchased and consumed by young people because they can produce stimulant and hallucinatory effects similar to designer drugs like Ecstasy or LSD. A total of ten individuals were arrested today as part of Operation Web Tryp, with arrests also occurring in Georgia, California, Arizona, and Nevada. In addition, Internet domain names and other assets associated with these enterprises were seized.
U.S. Attorney Dugas said: "The sale of designer drug analogues over the Internet is a growing and disturbing trend. These chemicals are dangerous and can easily be misused to the point of an overdose that results in death or serious bodily harm. Young adults and adolescents are particularly vulnerable because they can learn of these chemicals through Internet chat rooms and web sites and be deceived into thinking that the substances are both legal and safe. It is important for the public to know that these chemicals are dangerous and that the distribution of analogues for human consumption is illegal and can carry stiff penalties, particularly if death or serious bodily injury occurs as a result of the use of the chemicals."
The case was investigated by the Zachary Police Department; the West Feliciana Parish Sheriff's Office; the Louisiana Attorney General's Office; the U.S. Secret Service; the U.S. Postal Inspection Service (Las Vegas and Baton Rouge); the DEA New Orleans Field Division; and the DEA, Las Vegas. Other agencies that are a part of the DEA/High Intensity Drug Trafficking Area Task Force in this area are the Ascension Parish Sheriff's Office, the Baton Rouge Police Department, the West Baton Rouge Parish Sheriff's Office, the East Baton Rouge Parish Sheriff's Office, the Gonzales Police Department, and the Louisiana Department of Alcohol & Tobacco Control.
If convicted on Count One of the indictment, Burton faces a sentence of imprisonment of a minimum of 20 years up to a maximum of life. If convicted on Counts Two through Four of the indictment, Burton faces a maximum sentence of 20 years imprisonment for each count.
NOTE: An indictment is a determination by a grand jury that there is probable cause to believe that offenses have been committed by the defendant. The defendant(s), of course, is presumed innocent until and unless he is proven guilty at trial.
