SA's anti-bikie laws used against Finks

The Finks motorcycle club has been declared a criminal organisation by a South Australian government using its landmark anti-bikies laws for the first time.

The Rann government on Thursday handed police tough new powers to dismantle the Finks, affecting the club's 48 known SA members, ex-members and associates.

Police can now apply for court orders banning the Finks from meeting or contacting each other under laws the SA government has hailed as world-first measures.

The laws are being considered by several other states and territories following a spate of recent bikie violence.

SA Attorney-General Michael Atkinson has budgeted for the Finks to challenge the declaration, and the law in its entirety, in the High Court.

"They can hire the best and the brightest in the legal profession. I am sure they will take this all the way in the courts. They have signalled their intention to do so," Mr Atkinson told reporters on Thursday.

"And it will be tested ultimately, I think, before the High Court."

Mr Atkinson said he had been "sporting" to bikie lawyers by publishing 50 pages of reasons for the declaration, detailing Finks links to drugs, extortion, rape, and ongoing violent feuds with other SA bikie clubs, notably the Rebels and Hells Angels.

"The Finks are an organisation which projects such fear in sections of society that they are able to make a mockery of our criminal justice system," he said.

"There are citizens in South Australia who will not seek the protection of the criminal justice system because the Finks motorcycle club projects more force, in their environment, than the state."

SA's move on the Finks wasn't designed to encourage other states to follow South Australia's lead on anti-bikie laws.

"I am not trying to convince other territories or states or the world to adopt our legislation. I don't really care if they do or don't," Mr Atkinson said.

Under SA's Serious and Organised Crime Control Act, gang members can be officially 'declared' in parliament and then become subject to a control order restricting their contact with nominated people and places.

Under the Act, police can issue 72-hour public safety orders which ban individuals or group members from going to a public place or event.

The laws also created several new offences, including one of criminal association, with a maximum penalty of five years' jail.

Bikie club members and their associates who engage in group violence face up to ten years' jail under the Act, which passed parliament last year.

NEW laws which can imprison anyone caught recruiting members to a bikie gang have been passed by the New South Wales Parliament, in the government's latest moves against the outlaw groups.

Under the laws, passed by parliament on Wednesday night, those caught recruiting members to a bikie gang once it has been declared a criminal organisation could face up to five years jail.

The measure is part of a second raft of laws aimed at the gangs in the wake of spiralling violence throughout Sydney.

The crackdown on bikie gangs follows a brawl at Sydney airport in March between the Hells Angels and Comanchero gangs which resulted in one man's death.

Legislation was introduced last month allowing police to apply to the Supreme Court to have bikie gangs become declared criminal organisations.

However, police have not yet made any such application.

The second round of legislation would make it difficult for bikie gangs to recruit new members, NSW Attorney-General John Hatzistergos said.

"Criminal organisations use feeder groups, which are usually made up of younger members, to replenish and renew their ranks,'' Mr Hatzistergos said in a statement.

"This new offence will make it more difficult for declared criminal organisations to recruit new members.

"These new laws build on the legislation we have already passed and go further toward our aim of dismantling bikie gangs.''

The laws passed by parliament on Wednesday will also allow police to make a public notice when placing a control order on an individual of a declared gang.

This will be used when other means of serving the order have been unsuccessful, Mr Hatzistergos said.

she lost one son from being beaten to death by hawi and then hawi sends his boys to take out the other hells angels brother ...

poor poor hawi .... I hope they dont let him out to see his child born in hospital and can never see his child outside of a jail ... lock the dumbfuck up for life and take all his houses and cars as proceeds of drug crime ..

COMANCHEROS boss Mick Hawi has been granted bail on an affray charge related to a fatal bikie brawl at Sydney airport.

Yesterday, the heavily pregnant wife of the Comancheros boss said she just wanted her husband home to "do all the things a man does".

Carolina Gonzales pleaded with the Supreme Court to set her husband free, claiming she was in danger of going into premature labour and saying she needed him to take care of her.

She said she was admitted to hospital with contractions earlier this month on the day her husband was last refused bail.

Ms Gonzales, who is 31 weeks pregnant and living with her mother while Hawi is behind bars, said her family was too busy to help if she needed to go to hospital.

"My mother is offering me support when she can but it's not the support I need," Ms Gonzales said.

"What support do you need exactly?" Crown Prosecutor Cecilia Curtis asked her.

"I need my husband," she replied.

Ms Gonzales said that on the day she was admitted to hospital she had to drive herself there.

"The day Mick was refused bail, I started getting contractions," she said.

"I picked up my son from school and drove myself to hospital."

She said she was "living out of a suitcase" and needed Hawi at home to take their son to soccer and "do all the things a man does".

Gynaecologist Dr Greg Davis confirmed Ms Gonzales had a complication with her pregnancy and required Hawi at home.

"I'm very concerned she's going to deliver before 37 weeks," he said.

The court heard that Hawi had been in isolation at Silverwater jail since police charged him with affray over the March airport brawl in which Hells Angels associate Anthony Zervas was bashed to death.

Ms Curtis opposed bail on the basis that Hawi was "in a position to direct and control" Comanchero club members.

"Any violence towards the Hells Angels is likely to be orchestrated by this man as leader," she said.

If bail was granted, Hawi would have to abide by strict conditions, including not associating with any of his club members.

If he sneezes in public police will arrest him for a pathetic reason which will breach his bail ..

he wont be out for long unless of course he stays home 24/7 and only leaves the house when his so called wife gives birth or has to drive kids to soccer practice.

He has alot to lose ... a pregnant wife and children .... I'm sure if the hells angels had the chance they would blow them all to hell .. He is not allowed to contact anyone in his gang but I'm sure he will have someone sitting out front of his house 24/7 incase someone tries something ..

Imagine looking over your shoulder and worrying about your wife and kids because of the life you have chosen and having many enemies.
 
I can see shit is going to hit the fan even worse then it already is. Is it having a major impact in quality in sydney? im from melbourne and found it hit us slightly, I know of suppliers who also jumped there prices. But everything seems stable at the moment

Five people are being questioned by police after the shooting of former Gypsy Jokers motorcycle gang president Lennard Mark Kirby yesterday.

Kirby and an associate, Alexandro Scilio, were shot at a Jandakot property yesterday afternoon in what police say was a dispute over drugs.

Both men are in a serious condition in Royal Perth Hospital.

Assistant police commissioner Wayne Gregson said the gunman was known to his victims. Police began interviewing five "persons of interest" about 1.30pm today.

Scilio received a single gunshot wound. Police said both he and Kirby were convicted criminals who had records of drug offences.

"There was obviously a conflict involving firearms, the details of which are currently a key focus of our ongoing investigation," Mr Gregson said.

"The conflict resulted in both victims being conveyed to Murdoch Hospital by another person who was present at the time.

"At this stage of our investigation it would appear the parties are known to each other and the matter is a dispute over drugs."

Kirby suffered multiple gunshot wounds during the shooting at a house in Peppworth Place about 4.20pm yesterday.

Police would not confirm whether the injuries were life-threatening.

Kirby is still a member of the Gypsy Jokers, while Mr Gregson said Scilio was an associate of his.

Nearby streets were closed off yesterday as police hunted the gunman, while the Tactical Response Group was placed on standby.

Police were continuing several lines of inquiries and Mr Gregson said a blue Subaru Impreza sedan was seen speeding away from the scene and racing north up the Kwinana Freeway in the Jandakot area about 4.30pm.

Mr Gregson did not expect any violence to escalate from this shooting.

"However, it must be remembered that outlaw motorcycle gangs are organised criminal groups that are unpredictable," he said.

TWO men with links to the Gypsy Jokers bikie gang have been shot at a house in an isolated street in the south of Perth.

The wounded men were taken to hospital in the back of a ute by club associates.

Police were called to the house in Peppworth Place, a semi-rural street in the southern suburb of Jandakot , after reports of gunfire at 4.20pm (WST) yesterday.

A witness told Seven News two men ran from the house to a nearby car and drove off.

The gunshot victims were taken in the ute to St John of God Hospital in Murdoch and were transferred by ambulance to Royal Perth Hospital.

One man was shot three times in the chest, the other man was shot in the arm.

They are both in a stable condition.

Tactical Response Group officers completed a search of the property about 9pm.

Police say they are yet to determine who was responsible for the shooting or how many people were involved.

Bailed Comancheros boss Mick Hawi has yet to be released from jail, with his lawyers still finalising his $200,000 surety.

Hawi, 28, has been held in custody since his arrest at the beginning of April, over a brawl in Sydney airport's domestic terminal which claimed the life of Anthony Zervas, 29.

On Friday, Hawi was granted bail in the NSW Supreme Court so he could be with his wife Carolina Gonzales, who is 31 weeks into an "at risk pregnancy".

However, Hawi's lawyer Lesly Randle says the bikie has not yet met one of the bail conditions imposed by Justice Megan Latham, a $200,000 surety, and remains in jail.

"Mr Hawi will not be released until his bail is met," Ms Randle told AAP.

"What is to occur is the nominated acceptable person is to provide our office with necessary paperwork so that we may attend to drafting mortgage documents.

"Those documents will then be filed with the Supreme Court. That may take some time."

When granting Hawi bail, Justice Latham also set a strict curfew which means once released he must not leave his home between the hours of 8pm and 8am each day.

He has also been forbidden from talking to his co-accused and witnesses, and must not visit the Comanchero clubhouse in Milperra.

Hawi, who is facing one charge of affray, will next appear in Central Local Court on May 27.

Hmmm yes I must agree with you their for the NSW territory. But who do you think would win overall in an all out battle nationally?

I reckon it would be a throw up between the Rebels and the Hells Angels, couldn't pick which one would win but it would be bloody close and a bloody battle it sure would be...
 
Why would you want to be in a Bikie gang anyways? Yet alone be the President of one, you've got to know that people are going to be out gunning for you so why would you want to play a game of cat and mouse with your life...8) Like sure it would be great to have some awesome connections but that isn't really a very nice life to live is it :\ having to look over your shoulder whenever you don't have other members with you and always wondering when the next shoot out or brawl might be.

Actually they might really enjoy that and get pleasure from it or something lol, I don't know cause I'm not a Bikie and don't want to be one...
 
I believe it is the perceived 'prestige' that would attract them to such a lifestyle.

i.e. the desire to be well & truly "bad-ass" as far as popular perceptions go.

maybe there is some love of motorcycles thrown in there, too. to a certain extent.
but it would be undeniably easy to get hooked on the image as well as the chemicals that are part & parcel of the 'bikie gangsta' life... or the sorts of women that can see this as a lucrative meal-ticket for such substances. the further you dabble, there's no real going back... it's not like it's going to sit well with the rest of the pack if you just up & leave after everything you've been privvy to, you'd be expected to 'commit' to life on the edge.

those who have families etc, may not have had them before rising through the 'ranks'. and when the shit hits the fan & you're in too deep, i imagine it would be like being stuck - with the crooks, for better or more than likely, worse.
