The US Supreme Court Monday upheld the search of a Kentucky man's apartment after police broke in without a search warrant because they said they smelled burning marijuana and heard sounds suggesting he was trying to destroy the evidence. The decision in Kentucky v. King overturned a Kentucky Supreme Court ruling in favor of the apartment resident, Hollis King, who was arrested after police entered his apartment and found drugs.

[image:1 align:left caption:true]Fourth Amendment doctrine holds that police must obtain a search warrant to search a residence unless there are "exigent circumstances." In the current case, the exigent circumstance was that, after they knocked on the apartment door, they heard noises they said suggested evidence was being destroyed.

The Kentucky Supreme Court had held that police could not use the exigent circumstances exception because they themselves had created the exigent circumstance by knocking on the door. The US Supreme Court begged to differ.

In his opinion for the 8-1 majority, Justice Samuel Alito wrote that people have no obligation to answer the door when police knock or to allow them to come in if they have opened the door. In such cases, police would have to persuade a judge to issue a search warrant.

But that's not what King and fellow apartment residents did. They started scuttling around suspiciously upon hearing police announce their presence. "Occupants who choose not to stand on their constitutional rights but instead elect to attempt to destroy evidence have only themselves to blame," Alito wrote.

Only Justice Ruth Bader Ginsburg dissented, arguing that in ruling for the police, the court was giving them a way to get around the search warrant requirement in drug cases. "Police officers may now knock, listen, then break the door down, never mind that they had ample time to obtain a warrant," she wrote.

Oddly enough, King was not the target of police. Lexington police had set up a controlled drug buy on the street outside the apartment building, but when they attempted to arrest the suspect, he fled into the building. When police arrived in the hallway, the suspect had vanished, and all police saw was two apartment doors. When they smelled the odor of pot coming from King's apartment, they chose that door. The original suspect was in the other apartment. They arrested him later.

Now ain't that some bullshit =D

I live in kentucky.
imo thats some shit that they broke down the door because of a sound.
which the sound could have been anything..

so now the police can just bust in your house...
and say they heard a sound, even if they didn't.:p

I'm still convinced that most police officers don't even know the smell of burning cannabis/growing cannabis, or can tell the difference between the smell of burning/growing cannabis vs. another, perfectly legal plant.

this is straight bullshit.

"But that's not what King and fellow apartment residents did. They started scuttling around suspiciously upon hearing police announce their presence. who wants to define to me what suspicious scuttling sounds like compared to normal scuttling...
I'd like an definite answer so I know how not to move in my own home next time I decide to smoke inside on the off chance an officer arrives at the door... wouldn't want o risk sounding suspicious.

now the police can enter your home based on evidence that is impossible to prove--smells and suspicious scuttling. because they are the police, that means they can and will enter your home whenever the fuck they feel like it.

and the gun-control crowd goes silent.

How about if upon entering a house because they smelled supposed weed & kicking your door in, you shoot them with a shotgun because you think its a criminal, or at least thats what you tell the judge & jury.

911 bullshit brought on the patriot act that took away a lot of our rights & the leaders of this country love it. Unless we stand up & do something about it (revolution) this bombardment of our rights will continue.

that would make you a cop killer in custody. they would probably skullfuck you with a baton while promising you they have partners doing the same to your daughter in the next room.

but this thread is terrible for my mental health.

The case involved a dispute over whether police in Lexington, Ky., were justified in the events that led to the arrest and conviction of Hollis King for drug trafficking.

Police were in pursuit of an individual who had just purchased crack cocaine during an undercover sting operation. Uniformed police officers followed the suspect into an apartment complex, but did not see which of two apartments he entered – the door on the right or the door on the left.

Strong odor of marijuana

As they approached, police noticed a strong odor of marijuana coming from under the door on the left. They assumed the suspect was hiding in that apartment. (In fact, he had entered the door on the right.)

Police knocked on the door on the left, announcing their presence. When no one answered, they pounded on the door. After hearing noises suggesting evidence was being destroyed, the police kicked the door open.

Once inside the apartment, they noticed marijuana and powder cocaine in open view. A subsequent search revealed crack cocaine, cash, and drug paraphernalia.

Mr. King was convicted of drug trafficking and sentenced to 11 years in prison. On appeal, his lawyer argued that the police violated King’s Fourth Amendment rights by failing to obtain a search warrant before entering the apartment.

This is the most important point, I think, for those of us who would like to avoid being arrested:

Justice Samuel Alito said in his opinion for the court that people have no obligation to respond to the knock or, if they do open the door, allow the police to come in. In those cases, officers who wanted to gain entry would have to persuade a judge to issue a search warrant.

But Alito said, “Occupants who choose not to stand on their constitutional rights but instead elect to attempt to destroy evidence have only themselves to blame.”

So, it seems that it's better to answer the door and tell the cops they are not welcome to enter, I guess?

that Puerto Rican bitch that Obama put on the Supreme Court is such a fucking sell out. Why was Ginsburg the only dissenter? Fuck that PR cunt, whatever her name is.

drugs will never be legal

I almost edited out your offensive comments, but I decided to keep them instead, as a way of memorializing your ignorant sexism and racism. Maybe, hopefully, you will stumble onto these comments in a decade and be mortified that you ever made them.
Your attitude is disgusting to me and to many others, though the KKK would probably think you are right on.
In the future, please refrain from making such small-hearted comments here.

what the hell are you talking about? Sexist? Racist? I have no idea what the fuck I said that was racist or sexist.

You are a real pain in the ass sometimes.

It's not caucasians that are gonna be abused because of the supreme court's decision. Rather it's blacks and hispanics. This is why I called this Puerto Rican justice a sell out.

if I had made a racist remark I'd admit I made a racist remark and I'd apologize. I did no such thing.

Think before you react. You bruise too easily. All you academic types bruise too easily.

That's not what I gathered, it sounds like you are safer to sit the fuck where you find yourself, or quietly duck behind a couch if you have a window open. Don't take one step or they could say you were running to destroy evidence.

God save you if you happen to be in the can when they show up. That's one situation where the old classic 'if it's yellow, let it mellow, if it's brown, flush it down' could save your life. Every time you flush the toilet you could be inviting cops illegally into your home to beat the shit out of you your family and friends (and lets not forget shoot your pets on sight).

This is what we have to look forward to.

Here in Florida a while back I read about an arrest where a guy asked a cop if he saw his cat cause it got loose. The Piece of shit smelled weed comeing from the guys houses, searched it and arrested him instead of helping him which is what the police are for.

The problem with this is that there's absolutely nothing a defendant can do to prove he wasn't making noises or moving around.

If a cop pretends to smell pot smoke they search, and if you don't have anything, you're free (usually) and if you do, you go to jail. In this situation if they come in they break down your door and terrify your children, and damage property. If you have nothing you get stuck paying for repairs and therapy. If you did have something, you're double fucked.

I mean, if they hadn't smell pot smoke, would they still have broke down the door? Is just moving around reason enough for them to think you're destroying evidence when they have no reasonable suspicion that there even is evidence to destroy? It's an interesting but thoroughly scary precedent to set. Who knows, maybe a few of them will retire or die in the next year and we can get a few more liberals on the bench.

No sexism or racism in referring to a human being the way you did?

You are either joking or playing games. I don't care which it is.

If you want to continue with your foul-mouthed ignorance, with your language that reveals bias, ignorance, hatred, and disrespect, take it elsewhere.

If you think it is okay to refer to human beings that way, I am very, very proud to be a pain in your ass. =D

End of discussion.

Seattle cop free to continue beating the “fucking Mexican piss” out of people

Last year, Shandy Cobane, a racist thug employed by the Seattle Police Department, assaulted Martin Monetti, Jr. while he was lying on the ground compliantly. “I’m going to beat the fucking Mexican piss out of you, homey. Feel me?” Cobane taunted. Then he and a fellow officer, Mary Woollum, began stomping on Monnetti’s head and arm. Several other officers were present, but none intervened. The stomps left visible marks on Monetti’s forehead.
