A Bay City man could spend the next 15 years in prison for molesting a 9-year-old girl then trying to buy her silence with spare change he said she could use to buy candy.

Joseph P. Klemm was sentenced today to 35 months to 15 years for each of two counts of second-degree criminal sexual conduct with a victim younger than 13.
Second-degree criminal sexual conduct involves touching.

Klemm, 25, pleaded no contest in January to the charges that involves touching. A plea of no contest means the defendant accepts punishment but does not admit guilt.

The incident occurred in late June at a home in on Madison near 11th Bay City.
Klemm’s attorney, Bruce K. Mannikko, said his client has no clear recollection of the events that led to the charges.

“He did not dispute the details and he had no interest in putting the victim on the stand and putting her through a trial,” Mannikko said.

Klemm told officers he was drunk and high on marijuana and psychedelic mushrooms, records show.

The fact that he was on mushrooms makes this even more heinous. What kind of deeply sick fuck finds molesting children an attractive prospect while in a psychedelic state.

I have been drunk, high, and taken mushrooms many, many times.
Never once has the thought of molesting a child come into my mind.
The sick fucker may be trying to get some kind of sympathy, I suppose, as in "he wasn't in his right mind, so maybe that is not the real him".
But if he really was on mushrooms at the time, I think he may even be sicker than if he wasn't (agreeing with Transcendence here).
Lock him up and throw away the key, I say.

15 years? That's it? Fucking pedophiles and sex offenders are never fixed, never cured, the re-offending rate is like 80%. Sick fuck needs to be sterilized and locked up indefinitely. He's going to need some serious protective custody, I guess we can take comfort in knowing 15 years with charges like those is pretty much a death sentence.

It really shits me to see such light sentences for bloody kiddy touchers and other sex offenders. They deserve to cop the harshest of punishment! Blaming it on the drugs is a cop out, I don't care how far gone you are, drugs don't make you touch up kids you do that shit because your a sick fuck.

Perhaps they should inquire as to if he had read the bible within the last day to ensure it's listed on record or perhaps see if there was some other under 10 year old sexually teasing him prior to that event.

Oddly enough, well, okay, it's not odd my view does not vary. Intoxicated or not, I find such crimes easy enough to find euthanasia as the most humane option.

It's to bad that it's generally many times cheaper to imprison them for life over death due us part.

If only they could request to be OD'd as a choice. Oh well.

I have been deeply, deeply mentally twisted by taking mushrooms. While I don't condone what happened I can see how it might have happened, especially with alcohol involved.

It also says that it's the second degree which does not include penetration. This doesn't make it OK by any stretch of the imagination but it could've been worse.

The 'ol blame it on drugs defense, I hope he rots in jail.8o

It says He pleaded no contest, I don't think he was trying to blame anyone or anything.

If he was on drugs he can't really be held responsible for his actions. It's just not fair to do such a thing. He should be given MDMA therapy and a punishment not involving prison (community service perhaps) and long term treatment. Putting living creatures in cages in not acceptable.

It's the same responce I have to people who act violently on PCP, it's not their fault because they didn't choose to act violently. The big difference here is whether or not they would do it sober, and that's what should be looked into with this guy. Still, prison is evil and inhumane.

Yeah he pleaded no contest, he didn't plead guilty. He is obviously looking for a lenient sentence because he wasn't in his right mind because he was on drugs. Sorry that doesn't fly with me.

if you molest a little kid and fuck its head up potentially for the rest of its life, you get 15 years. If you sell a little kid an ounce of coke, you get 20...

lol ya let's give the fucking pedophile who molests little girls on drugs some more drugs as a punishment. 8) Please, are you serious? Ya ok prison is evil, good normal citizens don't go to prison, people go to prison for a reason. I went to prison, yah it was shit, but I went there because I did something to deserve to be there, it's not supposed to be fun it's supposed to be a punishment.

If someone had a cage in their basement in which they locked people that they thought had done something wrong then you'd consider it wrong in all likelyness. Prison doesn't help people for the most part, so why use it? Just to torture people you disagree with? Why not actually try and make the situation better instead of reverting to childish and barbaric means of making people do what you want? Prison simply doesn't work in its current state. People who do things that are wrong need rehabilitation, not punishment, and most people released from prison return to committing crime after their release.

Most people in prison don't deserve to be there, but that's a subjective argument. Most people in prison are there for victimless crimes. Normal citizens are also not good in my opinion, I find most of them to be horrible people.

The simplicity of your post is funny. MDMA wouldn't be given to him as a drug, it would be given to him for therapy. Pedophiles don't choose to be pedophiles, humans aren't neccesarily in control of our sexual desires (gay people don't choose to be gay, people with foot fetishes don't choose to have them, pedophiles don't choose to be attracted to young people), and if he was intoxicated it's understandable (although still not acceptable) that his behaviour could get out of hand. Would you feel that the system was justified in harming you permanently (I wonder how easy it is to get a job while in the sex offenders registry) if you had taken a drug, blacked out, and woken up having done something you never would have dreamed of doing sober?

How would prison help more then intensive therapy and rehabilitation coupled with a punishment that wasn't inhumane? What good will come of this guy being locked up that couldn't come from treatment?

The bottom line is that this guy is mentally ill, and mental illness should not be punished. He didn't choose to be a pedophile, and he didn't do anything wrong until he was not his normal self. He didn't have control over this situation, so why should he be hurt over it? It's not like prison will make him stop being attracted to minors.

If no other treatment works and he committs a similar crime again then he should be sterilized. That way there is a humane solution that's guaranteed to work without denying him basic human rights. We as a society should be more compassionate and less barbaric in the way we treat people. We're all human, put yourself in his shoes.

The headline from the source article does not mention "mushrooms". The word doesn't appear until the final sentence where it is listed after "drunk"l and "marijuana". I agree with the forum rules that the original headline should be used. But I don't want to blame the OP, it could be that the news site recently changed the headline.

A comment to anyone arrested: Don't tell the police anything. Don't admit to any illegal activities. Everything you say will be used against you.
