Questions Re Cannabis and Cash Seized

hey bluelighters recently police came to my house an siezed 14 grams of cannabis (personal use) and $100 in cash which had nothing to do with the drugs an was in a complete dif spot to were the drugs were found.
im a 17 year old male and live in nsw and i have had no drug chargers in the past but have used 2 cautions an been charged twice an just got off a good behaviour bond my 2 ? are?
wat will most likely happen wen i go into the police station for a interview?
and is there any chance of getting that $100 bak (it is a fair amount of money for me) not happy at all they took my money just because i smoke cannabis i think it is fucken rediculous the government an police how they can just go in some1s house an just because they have found a bit of cannabis they decide to take all they money in the house to that belonged to me now i am behind in rent coz of this.
how dare the government ban one of gods best creation this makes me so outraged i wanna do somethink bout it. but i doubt ill be getting my money bak :(

if you can prove its for personal use they can't claim the money was proceeds of crime...

and if the money does not show up as evidence in the case against you than you can file charges against the officer for well theft i'd think, if not that then taking bribes.


Definitely bring it up in the interview, they must record all of that, so state your case that you recieved it from work/ the dole and bring any evidence you have ie: receipts of your recent expenses too prove that you're not spending money beyond your income.
 
even if you have been charged with the outcome being a good behavior bond, plus the 2 cautions, it will all be priors if the prosecution wanted to bring it up.
i cant see you going to jail, but anything could happen, as well as the $100 being seized.

hopefully thats not the case though and you get off lightly.
 
As previously stated if you can prove that the 100 dollars had nothing to do with the cannabis I think it's ludacris for them to take that from you.

Being a 17yr old with no priors I think you should get off pretty lightly, I'm sorry to hear that happened to you man, The damages of a permanent record well and truly out weigh the damage of a tiny bit of budd.

Plead guilty, say that your stash was for personal use and the 100 bucks was for buying more weed, and that you are a habitual smoker of the ganja and the judge will send you straight over to a rehabilitation program/no criminal conviction.

U are very lucky u are under 18. U will more than likely just get another caution worst case a suspended sentence but if u can choose then choose to go to drug rehab and pay the fines/court fines etc instead of getting a criminal record. As to the money it will be seized until it has been established that it wasnt the proceeds of crime. Good luck with it.

DON'T say that the $100 was for buying more weed. That will just make them want to keep it. Much better if the $100 was money you had set aside (or best of all, recently withdrew from the bank and can prove that by showing a bank statement) for groceries or for a planned night out.

Especially If you haven't been charged/convicted with supply/trafficking. Was the 14 grams bagged up?

Why did they visit? Warrant or suspicion from traffic stop or something?

Did you say absolutely nothing apart from your name and that it is your address, and the rest can go through your lawyer?

yea it makes a lot of difference whether they found scales/it was in gram bags etc. evidence of dealing.
also if they caught you with a weapon or something to get a warrant you will be treated differently for certain.

context and how you play your cards is paramount, but definitely for textbooks and i reckn you should get it back. shithouse man, sorry to hear about it.
 
Why were they in your house in the first place? Did they have a warrant? What for? All those things are very relevant to the outcome.
 
Isn't that with the terrorist laws though? If you had a decent lawyer and the police could provide no evidence that there was any suspicion of terrorist activity I'm sure it would get thrown out
 
When I was in Melbourne last year I saw ads on the side of trams advertising the news laws to stop and search anyone on the streets at any time. That is fucked. :\
 
Queensland has something similar, they can say they "smelled drugs" or thought there was important evidence of a crime that you would destroy or whatever and then search your house without a warrant, and then get the warrant afterwards. It's called an 'emergent search warrant'.

If they have reasonable suspicion they are allowed to do that, the problem with 'smelling marijuana' is that it's almost impossible to prove whether they smelled it or not.

Can a mod update the name of this thread to something more meaningful.
