So I apologize if this is in the wrong forum. I doont know the process for moving it, or deleting it, but if this is in the wrong place or not allowed I would not be offended if it got moved/deleted. This is something ive been wondering.
Currently mephedrone is temporarily schedule 1 in the United States. This is a federal law, and to the best of my knowledge the only people allowed to make arrests for federal crimes are federal agents. Currently there is no state law against mephedrone in my state (Massachusetts) so in theory would the state or local police even be able to make an arrest for possession of 4mmc? I understands that they could potentially detain me for possessing a suspicious substance suspected of being an illegal drug, but then would they have 48 hours to either call in the feds to charge me or cut me loose?
Does a drug have to test positive via reagents for them to arrest you for it? Basically I'm wondering if any one knows what the potential consequences are if someone were found in possession of mephedrone in the United States.
This question is completely theoretical, I'm not looking for legal advice, I'm just wondering if anyone has a better understanding of the law and could fill me in.

And what about methylone? Methylone was left out of the recent dea scheduling, presumably due to a lack of evidence that it is in fact dangerous. If my state has no laws against methylone, and it didn't make the list of drugs to be emergency scheduled, does that mean it is legal again? I would appreciate a reference to the actual law that states methylone is illegal. Not the federal analog act, since this appears to be rarely enforced and largely without precedent.
