Opioids Probation and MMT

I am currently enrolled in a MMT program for my heroin addiction. CRC Allied, to be exact. I am also currently on probation. I overdosed about 6 months or so ago and was charged with felony possession of heroin. I took the guilty plea and was sentenced to 18 months supervised probation. I got on the MMT program before I was sentenced to probation. The first meeting with my PO, she made it very clear that she does not like methadone or Allied. Not the least bit. Each meeting she keeps adding more and more things I must comply to, otherwise she said she will rip me off the program and throw me in to jail to detox.

Now, I've been doing a lot of research - and I just want to ask you all for your thoughts on the matter. Does she have the right to do this? I am complying with her orders. I've read up through multiple sources that I am qualified under the ADA ( American with Disability Act) under section II. Is this true? Would I be able to file a lawsuit if she were to take it upon herself to force me off this program? This program really has saved my life, I have not used since I began it. I know though, that if I am forcefully taken off the program - I will relapse as soon as I get back on the street. Thus, my probation will be revoked and I will be sent to prison. To me, death is better than any amount of prison time - so essentially, she would be sending me to my death because I would surely take my own life before being sentenced to prison time.

Please let me know if I am worrying over nothing, or if there are steps I am needing to take in order to prevent this from happening. Getting in to this program has been the best thing that has ever happened. For the first time since I got myself addicted to opiates - I want to live. I have a medical history of depression, and this MMT program has been the only thing that was able to cure it. It's starting to come back though with the threats from my PO, and I really hate this feeling. I want it to go away so I can continue focusing on getting my life back on track.

By the way, I live in, and am currently doing my probation and MMT in Washington County, in Oregon. IDK if that information helps at all, but yeah.

Here's the problem with it. You pleased guilty.

Technically if your PO wanted to ban you from wearing pants, they could do that. They could then arrest you for wearing pants, charge you with violating probation, and throw you in jail. You'd then end up back in front of the judge, and thats where you could make the argument that it was unfair.

Technically you would be guilty of violating probation, but if it's something crazy, then you could get off, however, you're relying on how the judge interprets it. Regardless, they can still make your life miserable and lock you up for violation before seeing the judge.

So it's complicated to say what will happen, however, you kinda are the cops bitch. It doesn't make it right, but they can still arrest you for whatever bullshit they want, they are cops. You might get off in the end, and maybe even sue the cop, but it's going to be hell getting to that point.

Just saying from a legal point of view..
 
The problem isn't that I plead guilty. Pleading not guilty would have made matters worse. I failed to mention that not only did I overdose, but the officers who reported to the scene also found the other 2 1/2 grams of dope I had left. I really don't think I could have gotten away with that at all... so pleading guilty just made the sentence less harsh than it probably would have been if i pleaded not guilty.
 
^ What? Have you ever been on probation? Lol you make it sound like the kid is on ISP or parole. You can be on any medication on probation as long as a valid prescription is given. As long as your doctor knows your history and still says " you need this medication" then what the fuck is probation to do? They don't have a degree in medicine thus they can not say what you can, and can not take. They may not like it, but they have no choice.
 
i would have to agree with the person that said if your PO wanted they could violate you for any infration of your probation terms. i would read those terms to make sure you are not in violation. once you agree to the terms of probation i don't believe they can add other conditions to it like you can't be on a MMT.
if she is really being a problem i would go behind her back and speak with her supervisor to let them know that she is trying to give you a hard time.
i was on probation before and saw many of people walk into the doors but leave in handcuffs for the stupidest shit.
remember, your probation officer hates her job, she probably wanted to be a police officer or a sherriff deputy but couldn't get a job. so now she has to babysit a bunch of punks like you and me.
