A Daytona Beach man selling marijuana out of his home shot and killed a customer after he complained about his purchase and left without paying, police said Saturday.
The Friday night shooting at Martin Luther King Jr. Boulevard and Magnolia Avenue left Lakeefe Lee dead about four blocks away, where he crashed his car and apparently succumbed to a gunshot wound under his armpit just before 8 p.m., according to a police report.
The shooter, 26-year-old Emanuel "Emma" Laboy Rivera, was charged with delivery of a controlled substance and use of a firearm in the commission of a felony.
Rivera did not face any homicide charges Saturday, and Daytona Beach Police Chief Mike Chitwood said earlier that could be because of an interpretation of the state's Castle Doctrine, which allows people to use deadly force in self-defense.
Yet the justification does not apply to a person who "is engaged in unlawful activity or is using the dwelling, residence, or occupied vehicle to further an unlawful activity," according to state statute.
Police said Rivera agreed to sell three ounces of marijuana to Lee for $900 Friday night. Lee, who had no cash on him, initially took two ounces and left behind his .380 semi-automatic handgun as collateral.
Lee returned to Rivera's house about a half-hour later, and the men began "discussing the weight and quality" of the marijuana. After the discussion, Lee took the remaining ounce of marijuana, grabbed his gun, shoved it into his waistband and walked to his car, police said.
Rivera followed, trying to collect his money, and the men argued. The argument ended when Rivera fired his Glock at Lee's car, according to his arrest report.
Chitwood said the bullet shattered a rear passenger window and struck Lee, who managed to drive four blocks west down Magnolia before crashing into a power pole.
Police, who found marijuana and a scale at Lee's feet, believed he died of the gunshot wound, but an autopsy was scheduled for Monday.
