Ontario judge declares criminalization of pot unconstitutional

I live in Canada this is good news except now my future plans of getting rich are down the shitter lol.

I have always thought that Canada was a bit more "down-to-earth" than the US.
Criminalization of cannabis - and of other drugs - should be unconstitutional in the US as well, where the freedom to pursue happiness is protected.

An interesting note and if I'm wrong, someone please correct me but Canada had relatively stiff penalties in all provinces and territories with the exception of British Colombia (were people would move out to in order to escape more stifiling territories.) through the 80s until the 90s when a change in conciousness in Canada regarding cannabis began occuring. When a friend of mine visited relatives in Quebec and Ontario, the laws stiffer than CA @ any rate.

The Freedom to pursue happiness is a right enumerated in the Decleration of Independence which is unalienable (is protected by a higher law than the Constitution- its a Right given by The Creator. The judeo-christian God as the Founding Fathers understood him wouldn't put a plant such as Cannabis to tempt people to sin.

They taxed Cannabis in 1937 because a tax was the only way the federal government could effectively outlaw something- there was a time when personal income taxes were unconstitutional in the USA- this country was founded in part on taxation issues (no taxation without representation), and the first 4 rebellions in this countries history (shay's rebellion, whisky rebellion, ect... involved excise taxes.)

The CSA and Harrison Narcotics act are so unconstitutional its not even funny. Having said that, the first state to drop all penalties for the growth and sale of Cannabis was Alaska in 1975, the year before Holland instituted their soft drug tolerance approach. Several states including CA had lowered penalties against cannabis making possession a misdemeanor in the early 70s.

The first place to outright legalize cannabis after it had been criminalized was actually in the USA though not part of any particular state. It was a strip of American Civilization that once existed in the steamy jungles of Central America called the Panama Canal Zone. After illegalizing the herb as a result of enourmous pressure from the miltary which maintained many bases there at the time. This was enacted during the prohibition happy 20s. The story is a fascinating one that I had started a thread on here on BL with the article. The civilian leadership of the CZ conveened a committe to investigate whether or not the law should be upheld. In the course of their investigation one of the most humorous moments was when, in order to assess the effects of the drug, investigators had a group of physicians and Canal Zone PD officers smoke ganja and were theen observed by trained observers from this commission. Ultimately the commision found cannabis to be relatively harmeless, whose effects were much less injurious the alcohol and the laws were repealed in the zone and the Republic of Panama a year latter. This was probably one of the factors that led to the development of the legendary strain Panama Red that seemed to thrive in the mucroclimate of the Canal Zone and the Panamanian pacific Islands named the pearl islands.

Its too bad this issue wasn't settled in court (the Canal Zone actually had a Federal circuit court), or a precedence could have been set which might have lasted to this day.)

Anyway, this is an example of what happens when law makers, not brainwashed by years of anti drug propaganda examine a substance as innocuous as cannabis impartially. Of course the short approximately decade long legal cannabis for Canal Zone residents came to an end with the passage of the MJ tax act- which is a great example of insantity in the US government when you read the history behind it including law makers calling a medical expert- the represantative of the AMA called to give testimony regarding cannabis- who was a trained, very well respected physician, essentially an imbicille and quack when he suggested it wasn't very harmful. The passage of the MJ Tax Act was passed without much testimony in contrast to the repeal of Cannabis prohibition in the Canal Zone which was passed after months of careful consideration, research, and deliberation.

Another factoid about the US and harm reduction/drug policy was the consideration of heroin maintenace in NYC in the 50s. After years of success with medicalized maintenance of addicts in the UK, serious discussion of Heroin Maintenance Therapy (HMT) was discussed as a sane treatment modality to adress the growing heroin problem in NYC. This was endorsed by both the American Medical and American Bar Association. Were was it derailed- by politicians were private interest groups hold sway and real world solutions are distorted by propaganda and pseudo morality to seem non-sensical, impractical, and downright sinful, instead of pragmatic, humane, and in line with the principles this country was founded on. Not the policies of today which are decidedly "unAmerican."

Its like the government of this country has been hijacked over the last 100 years by hysterical nuns on the one side and self-serving jackals and hyennas on the other.

^^ this was a very well thought out and informative post. kudos to you. I had no idea bout the canal zone legalization. That's just about the first time I've heard of a legitimate way to consider cannabis laws... sit a bunch of people down and have them smoke whilst be observed... you sure aren't going to see them getting in to brawls, harming others, being loud obnoxious and causing a pubic nuisance, destroying their livers, etc. etc....

This shits been done before and on a bigger scale. Hell we came close to decriminalization right across the country but well Harper got in and that was the end of that
I'm wondering if your talking about Hertz, the newspaper mogel who talked Harry Ass-slinger into slinging his own ass to inflate his agencies budget (Bureau of Narcotics or Bureau of narcotics and dangerous drugs), whatever the predecessor of the DEA was called while it was still part of the Treasury Dept, before it became part of the Justice dept with the passage of the CSA. In 1937, cannabis grew on the banks of the Potomac. But he got us into the Spansih-American war and we ended up with such cool possessions as Guam, Peurto Rico, the Phillipeans, and Guantanamo Bay (which was only supposed to be a 100 year lease.)

This sort of court ruling has happened before where weed becomes a quasi legal thing. But then they close the loopholes.

Alaska is a great example, but it was quasi legal for atleast 15 years- still kinda is I think just not like before. As a result probably the most potent strain I ever smoked, Matanuska Valley Thunderfuck was wiped out (it was reputed to be a clone- though the genetics apparently live on to some extent.)

Also- I believe that a Federal Judge ruled in the 70s that medical MJ was legal and a small group of people received it from a government farm at the University of Mississippi in the form of pre rolled joints. I think that program went away but that group of people were grandfathered in- kinda like the small group of remaining people in the UK that get HMT Rxs from the NHS. I remember a girl I grew up with in San jose who claimed her dad got buds from the feds for glaucoma or something like this- i never got to try it though so i don't know if she was full of shit or not- but that rulling seems like a prcedence should be set for medical MJ in the US states were its legality has been voted for by initiative or legislative process to be upheld regardless of whether certain administrations decide to selectively prosecute the CSA.

I know that schedule I drugs are sometimes allowed to be used in human research- like MDMA for PTSD sufferers if there is a special FDA permit or something like this (don't know specifics). GHB, I think is a schedule I drug were a medical preparation of it called Xrem or something like this used for narcolepsy treatment. Or marinol in the treatment of chemo nausea.

R. v. Parker 2000 Ontario Court of Appeal
R. v. Parker was the landmark decision that first invalidated the marijuana prohibition. However the declaration of invalidity was suspended for one year. It concerned the case of an epileptic who could only alleviate his suffering by recourse to marijuana. The Court found that the prohibition on marijuana was unconstitutional as it did not contain any exemption for medical use.[17]

This is the relevant example.

thanks for the fascinating read!

Matanuska Valley Thunderfuck is definitely among the most potent that I have ever smoked as well, if not the champion. I got it a few times in 2007-2008, so I may have been even luckier than I thought I was, given its rarity at that point.
I remember taking one hit of it my first time, and before I could even contemplate taking a second, I was unable to function enough to manage the lighter. =D

^^^^^^

Ive had weed like that back in 1990, dont know the name of it tho.

I'm pretty interested to see what may come out of this, I must say, however, my hopes are not very high at all.

Also, for the record, nobody in Canada says "aboot" except for people on the east coast as far as I know.

Ive heard people from some parts of central Canada kinda pronounce it that way. Other then that they just pronounce it in the usual boring bland way they pronounce everything ;) . Ive never heard anyone from any part of the rock pronounce about that way but then again there's so many goddamn accents on this island that it's hard to keep track of. When i say there it generally comes out sounding like "dare". As in "dat crowd up dare are a bunch of cunts right me b'y"

A Lot of people in Ontario thought i was from Ireland or some part of the UK and depending on how mischievous i felt id tell them a load of shit %) . So yup not all Canadian accents are the same by a long shot.

^ And it was ratified by a moose, a regional hockey team and a French whore.

That moose was bought off man I'm telling ya he's as corrupt as fuck :!

I know in alberta if your caught with anything under an oz (has to be in 1 bag) then its just taken away no tickets, charges nothing. If its in numerous bags or more then an oz its trafficking however. Hopefully Alberta does what ontario has done. I can't even begin to imagine weed being legal!

Where I'm from, you're fucked if its any weed. A friend of mine recently spent over 1000$ on a paraphernalia charge and a possession (of a gram) charge.

HAHAHAHAHA! I'm sorry but that reminded me of one time we were smoking weed out behind an appartment building, cop walks up, see's our pipe, asks if we have any weed. We each pull out a gram (4 grams in total) the the cop literally laughed, said "You boys just head home now" and walked away. Oh Canada :D
