if the DA accepts the offer, would you be on probation also or just the fine and it's over with? i know it's frustrating having to deal with this if you feel you did nothing wrong but that would still be a great result for you if you simply have to cut your losses and pay the fine but don't have to deal with the whirlwind of bullshit that is probation and/or the penal system.

No probation. A violation would be considered something frivolous, not unlike a traffic ticket.

Jumping through hoops regardless of intent, however, is not my idea of spending quality time with the justice system.

Just thought I'd give everyone an update on this seeing how it's been a long while.

It panned out exactly as I would have assumed it to have, had I not been such a defeatist/pessimist and paranoiac.

What it boiled down to was that their case had no water. If I had had the money or the time to risk the consequences should my defensive trial turn for the worst, I would have fought it full bore and had the charges dismissed, possibly filing a countersuit for wrongful arrest and defamation of character. But alas, I'm of humble means and simple fiduciary stock.

It resulted in a conditional adjournment in contemplation of dismissal, meaning if I stay out of trouble for 6 months-1 year the charges will be dropped. Whether this means they are stricken from my record and I am found innocent, I've not a clue as my lawyer doesn't return my calls or answer my admittedly long-winded questions when he does. I do know however that as a result of this and until the adjournment (1 year) I am unable to work in my current field (healthcare) which means I'm left to find less desirable work at half the pay I'd normally receive. Looks like I'll be heading back to college.

I believe a Class a Misdemeanor in NY holds a sentence of up to 1 year. It's very possible you may get a suspended sentence with probation. Even if you have to do time you'll only be in for a few months. Good luck to you.
 
It's already been settled as I've mentioned, conditional discharge (6 months) and anger management they require and as long as I remain a 'law-abiding citizen' the charges are dropped.

I don't know whether I'll ever be able to work with medical patients ever again though, because I know that even if the case was expunged the NYS dept. of health refuses to let you work in the industry for the most meager of offenses. If it's dropped I'm assuming I can resume work in that field, but I'm starting a new job with a company I worked for years ago and I'm psyched because it was a great job.

To hell with wiping ass and dealing with disgruntled, bitter, heartless nurses.

And as for the 'State of NY' and their slimy District Attorney, Fuck them. I was innocent in the first place.

They had no case. We beat them like dogs.
