Ok. So it has come to this.

I can't believe this nonsense. I was just growing accustomed to receiving your intelligent and insightful feedback ... now this garbage.

The charges you fall under, I don't get it, what about freedom of speech?

Ugh, I really don't understand the law here. I reside on LI as well and know of a woman who was caught driving without a license as well as with crack in her bra. This was well over a year ago. She is currently free and collecting from the state even though she has never paid a cent of child support for her 16 year old daughter whom she is trying to rip away from her father, the one person who did take care of her.

*Sigh* I just don't get it. I really, really don't. I truly wish you the best, and hope you can avoid any negative consequences they are trying to throw at you. You deserve none of this. As a female myself, I can't understand the cruelty they induce. Makes me physically ill.

Muvolution really gave the best advice - as hard as it is (heck, I'm angry enough for you that I'd have trouble dealing with the people involved in a positive way) try to stay positive and optimistic so that those defending you and trying you will see that kindness and gentleness that we all know.

It is really upsetting that she would press charges on you for mere words when you never hurt her, even after she damaged your property and you let her get away with it because you're so nice. It infuriates me how BLIND the law is to the crimes of so many women. And I'm a woman!

I've almost had to press charges on someone before, but that's because he -physically assaulted- me (not sent some emotionally charged and justifiable messages)...the fact that this woman is so weak that she cannot handle being told a thing or two and needs the -law- to back her up...it baffles me and infuriates me and I really wish there were something I could do for you, man.

But all hope is not lost. Just try to keep in steady contact with your lawyer; call him and ask him directly if he doesn't answer your questions in e-mails...try and stay positive. The judge lowered your bail, so he's definitely got to see some truth to your testimony. Just try not to show too much anger (even though it's completely understandable that you are angry and frustrated) and tell the whole story. Hopefully the jury will be people like us BLers who will understand.
 
^^ I second your advice and encouragement. And seriously, what is it with women? Devil's got a vagina I'll bet.

Jebus, I came late to this thread. I'm no lawyer, and even if I was I'm not in your jurisdiction so I wouldn't be able to help, but I just wanted to offer my sympathies, and to let you know that I'll be sending what good vibes I can your way. I can't believe that something classed as a misdemeanour carries a 1 year jail time... makes zero sense to me.

Any updates on the situation by the way?
 
I've been tediously busy packing and preparing for my move out of state.

Yeah try to get a new attorney. I know you do not have the money to get a new representative but honestly you're going to be fucked over if you keep this guy. My mother just went to court and this was a paid lawyer but he still sucked. So now she is trying to appeal the decision and blah blah blah. That does not matter but I really think you should try the hardest you can to get some money during this three month time period. I'm unsure of what drugs you've used in the past or what not...and if having this money will jeopardize your sobriety (are you still sober I don't know) or you think you would blow all the money before paying for a new representative...I think you should give the money to a well trusted family member or friend to hold on to so you will still have it when the time comes to pay up. You can find a much better person to represent you even on a low budget...Try anything you can to get the money (nothing that could send you to jail though). Even if you have to do it panhandle. It might seem like a bad thing to do but if it can keep you out of prison, I believe it would be worth it.

I'm definitely looking forward to your updates. You've been in my thoughts and I really wish there were something I could do to help you... I'm still hoping that your lawyer gets some sense soon and that things will work out.
 
prison?? prolly not ive had waaaay worse due to female trubble and got probation/ fine etc..a plea will be offered espec. if you ask for trial...plead not guilty ask for a deposition and ask to talk to the da he goes between judge and lawyer/pub def...a public def. works for those who seek to sentence you and they have a room temp iq at best.. im here in ny twin tears region pm me for help
 
If there was some way to legally let her know that ensuring your unemployed status does nothing but give you time to stew over what she has done to you, I would make sure to send that message along.
 
Man that really sucks and I know very well how fucked it is having enough income to survive and thats it. I got popped for dirty tests when on probation, hadnt used, was clean & facing 9 month sentence. What saved my ass was asking a well known fiend for a damn good lawyer, as she knew full well. That and because my Mom knew I was legit. Id of been fucked out of my license to work then just another loser/user blah blah. Anyway, I defo think doing the legal research is a damn good idea. Id be mortified, but have you thought about representing yourself? This way, YOU would have direct access to all the "evidence" the state has against you and put that bitch on the stand being able to question her yourself instead of some overworked PD do fuck all. This, my friend would "beat them at their own game." Dont know NYs laws, but maybe you could have as co counsel a paralegal I mean assuming this went to trial. Knowledge is power though, I cant stress that enough. Another option instead of jail/probation, might be anger managment? In Cali 1st offense you can and completing the program then no misdemeaners or felonies count against you, so on job apps you can answer NO to the question asking if youve ever been busted, blah blah. Hope everything works out dude. Peace. Oh yeah the fact she went and destroyed all butt load of your private property SHE should be charged and you should file complainst if its not too late, but you or your lawyer whoever defends you should put her on the stand and make her admit that SHE provoked that text. Too bad you didnt call the cops on her, but you can only do what you can for now. Good luck.

He's working with the D.A. to get it dropped down to a violation with no jailtime/record. Large fine, but whatever.

IF the bastard doesn't accept this proposal, then a jury trial awaits.

Fuck it. I can't wait to get on the stand. I could talk my way out anything, especially considering how ridicluous this nonsense is and they will be sure to see a counter suit for emotional damages ad nausea-um. We'll see how it goes. Hearing set for Sep 12 unless they insist on the Misdemeanor then we're going to trial baby one month later.

I love each and every one of you and just wanted to convey my utmost respect, love, and appreciation for not only the times you've taken to read through my gut-wrenching gibberish but also offer constructive advice, and a shoulder to lean on, so to speak. If the world consisted only of your ilk we wouldn't need these threads like these and we'd be off dancing somewhere. :)

Beating these fuckers to death with their own rules would be nice, but optimism isn't inherent in my current states.
