"LUCASVILLE, Ohio (AP) — A condemned Ohio inmate appeared to gasp several times and took more than 15 minutes to die Thursday as he was executed with a combination of drugs never before tried in the U.S.

Dennis McGuire's attorney, federal public defender Allen Bohnert, called his client's death "a failed, agonizing experiment by the state of Ohio."

McGuire's attorneys had attempted to halt his execution last week, arguing the untried method put him at substantial risk of "agony and terror" while straining to catch his breath as he experienced a medical phenomenon known as air hunger.

McGuire made loud snorting noises during one of the longest executions since Ohio resumed capital punishment in 1999.

The state used intravenous doses of two drugs, the sedative midazolam and the painkiller hydromorphone, to put McGuire to death for the 1989 rape and fatal stabbing of a pregnant woman, Joy Stewart. The method was adopted after supplies of a previously used execution drug dried up because the manufacturer put it off limits for capital punishment.

Executions with the former method were typically much shorter and did not include the types sounds McGuire uttered.

A few minutes before McGuire was put to death, state prison director Gary Mohr said he was confident the execution would be carried out in a humane and dignified manner. As is common practice, prison officials did not immediately comment after the execution except to release the time of death.

Strapped to a gurney in the execution chamber, McGuire thanked Stewart's family for their "kind words" in a letter he apparently received from them.

"I'm going to heaven, I'll see you there when you come," he said through a microphone held by the warden.

As his adult children sobbed a few feet away in a witness room, McGuire opened and shut his left hand as if waving to his daughter, son and daughter-in-law.

More than a minute later he raised himself up, looked in the direction of his family and said, "I love you. I love you" — his words audible even though the microphone had been removed.

McGuire was still for almost five minutes, then emitted a loud snort, as if snoring, and continued to make that sound over the next several minutes. He also soundlessly opened and shut his mouth several times as his stomach rose and fell.

"Oh my God," his daughter, Amber McGuire, said as she observed her father's final moments.

A coughing sound was Dennis McGuire's last apparent movement, at 10:43 a.m. He was pronounced dead 10 minutes later.

Attorneys for the state called McGuire's bid to halt his execution with the untried method an "eleventh hour" appeal based on claims that should have been raised years ago, because the process had been in place as a backup method.

And although the U.S. Constitution bans executions that constitute cruel and unusual punishment, that doesn't mean procedures are entirely comfortable, the state argued.

"You're not entitled to a pain-free execution," Assistant Attorney General Thomas Madden told federal Judge Gregory Frost.

Frost sided with the state but acknowledged the new method was an experiment. At the request of McGuire's lawyers, he ordered the state to photograph and then preserve the drugs' packaging boxes and vials and the syringes used in the execution.

Bohnert, McGuire's attorney, said the court's concerns over the method had been confirmed.

"And more importantly, the people of the state of Ohio should be appalled at what was done here today in their names," said Bohnert, who did not witness the execution.

McGuire, 53, was executed for killing Stewart, a newlywed who was eight months pregnant at the time of her death, in western Ohio's Preble County.

"We have forgiven him, but that does not negate the need for him to pay for his actions," said a statement released by Carol Avery, Stewart's sister, after McGuire's death.

Stewart's slaying went unsolved for 10 months until McGuire, jailed on an unrelated assault and hoping to improve his legal situation, told investigators he had information about the woman's Feb. 12, 1989, death. His attempts to blame the crime on his brother-in-law quickly unraveled and soon he was accused of being Stewart's killer, according to prosecutors.

More than a decade later, DNA evidence confirmed McGuire's guilt, and he acknowledged that he was responsible in a letter to Gov. John Kasich last month.

"One can scarcely conceive of a sequence of crimes more shocking to the conscience or to moral sensibilities than the senseless kidnapping and rape of a young, pregnant woman followed by her murder," Preble County prosecutors said in a filing with the state parole board last month.

His attorneys argued McGuire was mentally, physically and sexually abused as a child and has impaired brain function that made him prone to act impulsively.

"Dennis was at risk from the moment he was born," the lawyers told the parole board. "The lack of proper nutrition, chaotic home environment, abuse, lack of positive supervision and lack of positive role models all affected Dennis' brain development."

Documents obtained by The Associated Press show McGuire unsuccessfully sought a reprieve in recent weeks to try to become an organ donor. In November, Kasich granted a death row inmate an eight-month reprieve to let the prison system study his request to donate a kidney to his sister and his heart to his mother.

Kasich said McGuire couldn't identify a family member who would receive his organs, as required under prison policy."

I am sure the family of the person he killed is horribly pained by his suffering in death. Our society is so fucked that this piece of walking garbage has any advocacy. Hopefully he suffered, but the dead don't talk.

Just got to remember to tell them to ramp the dosage up for any addicts who are being put down like this, sounds like the dose they used to off this dude might only give a decent buzz for the habits the people can build up. I think I'd choose this method over the standard lethal injection, at least one good hoorah to go out on.

AN OHIO killer gasped several times during his prolonged execution with the first use of a lethal injection process never before tried in the US.

Dennis McGuire was still for almost five minutes, then emitted a loud snort, as if snoring, and continued to make that sound over the next several minutes. He also opened and shut his mouth several times without making a sound as his stomach rose and fell.

"Oh my God,'' his daughter, Amber McGuire, said as she observed her father's final moments. His adult children sobbed in a witness room as they watched him die.

In trying to stop his execution, McGuire's lawyers had argued that he was at substantial risk of a medical phenomenon known as air hunger, which would cause him to experience terror as he strains to catch his breath.

McGuire, 53, was sentenced to die for the 1989 rape and fatal stabbing of a young pregnant woman. He acknowledged that he was responsible in a letter to Governor John Kasich last month.

Ohio's never-tried lethal injection method was adopted after the maker of the state's previous drug put it off limits for capital punishment.

Some states that still carry out executions have struggled to find drug supplies for lethal injections after companies refused to supply the drugs for that purpose.

Capital punishment continues to be a much-debated subject in the United States. In all, 39 executions were carried out last year, according to the Death Penalty Information Centre.

"I'm going to heaven, I'll see you there when you come,'' McGuire said shortly before his execution. He opened and shut his left hand several times before the drugs took effect, appearing to wave to his children.

Previous executions with the former execution drugs took much less time, and typically did not include the types of snorts and gasps that McGuire uttered.

State attorneys had disputed claims that McGuire would experience terror as he was put to death with the new method. A federal judge sided with the state but acknowledged the new method was an experiment.

Ohio officials used intravenous doses of two drugs, the sedative midazolam and the painkiller hydromorphone, to put McGuire to death.

Prison officials said McGuire was awake all night talking on the phone and writing letters. He also had emotional final visits with family members, including his son and daughter.

The US Supreme Court on Wednesday rejected a last-minute request to delay his execution after his legal team argued that a jury never got to hear the full extent of his chaotic and abusive childhood.

Documents show McGuire unsuccessfully sought a reprieve in recent weeks to try to become an organ donor.

In November, the governor granted a death row inmate an eight-month reprieve to let the prison system study his request to donate a kidney to his sister and his heart to his mother.

But the governor said McGuire couldn't identify a family member who would receive his organs, as required under prison policy.

I remember reading about this when they decided on the new combination. It's interesting that we've gotten to the point of giving executions that are basically a recreational drug overdose, because other countries/manufacturers refuse to sell the deadly drugs that have been traditionally used for executions because of moral objections to capital punishment.

I'm very curious the dosage they gave him, as a large dosage IV injection of these 2 drugs should be pretty much guaranteed death (and relatively painless I would think). By simply increasing the dose they should be able to reduce issues, right?
And even so, he was unconscious so that final labored breathing wouldn't have been felt anyway, correct?

Even though he sounds like an asshole, the SA is right, people aren't entitled to a pain-free execution (moral questions of capital punishment aside). And executions are a lot less painful/barbaric now than they used to be. Hell, IV'd HM/midazolam kinda sounds like fun.

Sounds like they need to ramp up the dosages.
Other then that what do you expect when you rape or murder anyone let alone a pregnant women.

I'm not a fan of the death penalty but this guy worried about a painful death is outragous. Think of the pain you caused some one else and their family.

Wow, they're actually using opiates to "put people down" now...? Hydromorphone sounds a hell of a lot more painless than potassium chloride and pancuronium bromide, for sure. Tbh I doubt they're using this drug combo out of humanitarian concern, but if I was on death row, an opiate overdose wouldn't seem too bad, especially if I had an opiate habit in the past. The traditional combo was a crap shoot; will they give me enough pento-barbital to knock me out properly? If not, potassium and pancuronium bromide does not sound like a pleasant way to die: complete paralysis of the lungs and body, followed by a massive heart attack; it sounds pretty horrific, and I understand the procedure takes around 15 minutes on average.

Doctors aren't even allowed to administer the drugs because of the hypocritical oath. They get bottom of the barrel unionized corrections officers, some of whom have convictions for offences committed on duty but keep their jobs due to the union, to do it. There was a study in southern states that showed the majority purposely didn't give the convicts enough sedation for it to be painless.

It's called automatic spellcheck, but go on fisting yourself while masterbating with tweezers to your own false sense of satisfaction.

Why dont they just add diprovan (propofol) to the mix and ramp up the other two drugs? Call it the michael jackson. Does sound like it might be kinda nasty tho, gasping for air, the da is right, there is no right to a totally pain free execution.

I'd rather just skip the midazolam aperitif, and go out with a bang.

I guess the condemned guy really was allergic to one of the drugs; gasping for 15 minutes before dying does not sound like an opiate overdose, especially one under general anaesthesia.

What were there, 34 executions last year? It's time for a re-evaluation of the death penalty IMO. The wait to be executed is cruel and unusual, if not the method.
I would make an exception for that baby raping murderer. His number is about up though.

Because when one state anounced they would use it for lethal injection the german manufacturer of propofol refuses to sell it to the whole of USA. This freaked out more than a few people.

It's called dying of respiratory depression.

That guy was probaly gasping at how orgasmic that rush was. Lucky fuck should have been castrated then beaten to death cuz he didnt deserve that good of a death. piece of shit.

If we allow our government to violently execute offenders, one day they'll violently execute political dissenters. Better to keep it humane.

meh, midazolam + hydromorphone sure doesn't sound like a bad way to go, and it "sure beats Ryker's"...

I'm an Ohioan, so I've seen this bit on the media a fair amount, lately. this guy raped a pregnant woman, then decided to slit her throat. not to sound harsh, but I feel like he did get off a little easy here?
