^It fucking figures!I was passenger in the car today and got pulled over in a really nice area (one of those rich villages with their own police) for putting flyers out and sure enough ended up getting a full search. The cop had us waiting forever and I knew he was doing a background check on us, and sure enough he asked me if I was ever arrested before. I told him yea, and when he asked what for I told him "possession of hydrocodone or something" and he came at me bitching that I said "or something" saying that I knew what I was arrested for and not to play games with him. I told him I didn't see the relevance and that it was so long ago that I wasn't sure what the charge ended up being, so that's why I answered like that.
Then he asked if I had any drugs in the car, illegal or prescription, and that threw me off since I've got a few scripts so I told him I didn't know what he meant and asked him to clarify, and sure enough he asked me to step out of the vehicle. He brought me to the back of the car, had me put my hands on the trunk, then proceeded to pull my pants up tight so he could get a good feel around my cock-n-ballz, asking if I had anything that would stick him, and I was clean so had nothing to worry about. I had left my bud at home (only had about 0.5 and a one-hitter anyway) for the first time since getting the car, so I lucked out there.
After not finding anything on me he had me sit on the hood of the car while he went to work on my friend. The cop was saying that he smelt marijuana, and I told him that it was probably the corona that smelt like it, but he laughed that off saying he never heard of beer smelling like weed (I wasn't about to argue and incriminate myself further) and he kept on pressing us to admit to having weed in the car.
He finally found my scripts in my bag but they are both legit so he couldn't say anything about them especially since I wasn't driving, but he did make a comment about if my doctor knew I drank on my meds or not. After coming up empty-handed after the thorough search he seemed to feel bad for putting us though all of that since we were explaining that we were down on our luck and just started a business from scratch and were trying to do the right thing (my friend had some priors from way back too, so it didn't look good for us at first) so weren't doing anything illegal.
The cop explained how from his POV we were two people out of place that had priors, so he was just doing his job to make sure we weren't causing trouble in the neighborhood. He didn't give us any tickets, and he didn't mention anything about the 22oz Corona that had been opened, although it was still full and I had put the cap back on it.
So after letting us go we stopped at the store a few towns over for something, and I was going through my wallet to find a business card that I had written something on, and upon noticing two metro cards out of place I saw that I had a bag of heroin in there the whole time. The bag was just half full, but that would have been the end of me. I had gotten so high on Easter that I didn't even finish the bag so stashed it in my wallet only to forget about it. I guess that since I had completely forgotten about it and knew I had nothing else on me that I was calm enough where the officer didn't suspect me, although I still got searched.
If I knew it was on me and was bugging then he might have been able to tell and probably would have brought me in for a strip search, but even then they wouldn't have found the bag the way it was sandwiched in there. If I knew about it I would have eaten it though, since it was just 1 bag that was half full and had the top half ripped off, making for easy swallowing.

That's why, I couldn't even imagine driving around dropping off heroin to people all day long, it would send me over the edge and probably make me permanently crazy because of the paranoia!
Possession of ANY amount is a felony, and if you're a dealer, one slip most likely means jail time, a LOT of jail time depending on the circumstances.....
You might not have gotten jail time, but I'm sure you would've had to go through some long-term bullshit drug court, urine test, counseling, probabtion type of thing.....I hate being on probation, I was on probation for 6 1/2 years and got lucky that I managed not to violate....After a year of clean urines, they just left me alone...
Actually, on second thought, I guess I kind of did drop of dope all day long! Of course, it was always the same people and I was just middle-manning for them, but legally it would be just as bad.....I guess being any bigger than that and constantly having bagged up drugs on hand is what would really scare me more!^ It depends on where you are. In NYC simple possession of heroin is a misdemeanor, and sale is obviously a felony. When I got busted in the city for paraphernalia and they threw a possession charge on top after "finding a bag in the back seat that contained heroin residue" it was still just a misdemeanor. In the city it gets knocked down to a violation and you pay the fine and move on (considering you don't have too many priors) but in the suburbs you aren't getting that charge dropped without doing the whole treatment court thing which usually consists of a year or so of meetings and piss tests before getting it dropped down to a violation.
The initial charge is criminal possession of a controlled substance in the 7th degree and it's a class A misdemeanor. It gets tricky where/when it becomes a felony possession charge because one source says anything over 1/8 oz is a felony, and another source says that anything over 1/4 oz is a felony.
Not only is that a pretty big difference in quantity considering it's heroin, but it's also tricky since most dope in NY is already bagged up so I would imagine that there is a set amount of bags you can possess before it becomes a felony. Also, I don't know how reputable those sources are, and I can't take the first one seriously after seeing the picture they use at the top of the page. It looks like Elmer's glue in a spoon next to a huge steroid needle.

I dont carry a wallet for a number of reasons but that is a new one I can add to the list I guess
and yeah most cops are gung ho but thats just their job like I blame the system and laws more than the cops. the more money they earn the better they look so from their shoes like I get the aggressiveness, and he was half right in that you did have drugs on you, but thats the beauty of ignorance, you really didnt think you had anything on you and thats half the battle, just your body language and words like just be clear and somewhat pissed off because if you were just like on the way to somewhere id be pretty pissed I got pulled over but idk why im saying all this its pretty common knowledge.
they try to fuck with you by asking loaded questions so you just gotta think out everything your about to say and say as little as possible. If they back you into a corner about something you can always plead the fifth but if they have like hard evidence on you its not going to get you much anywhere. And its fucking demeaning as shit but like you gotta kiss their ass sometimes, some cops like get a boner over that shit and act way cooler when they think you actually respect what theyre doing.

damn thats some shit, just a violation ticket for heroin in the city? i know NYC is different n has bigger fish to fry but it dont matter how little, Heroin is a felony in Texas. n even in downtown dallas the cops get their rocks off harassing junkies
that just blows my mind you could get a violation ticket for heroin, they passed a law in texas saying the cops have the option to give you a violation ticket for weed possesion under 2 Oz but both times i got arrested for bud i asked the cops if i could just get a ticket n a summons to court n they said they had never heard of such law (tho i confirmed in on NORML.org) the cops either hadnt heard of it or woulda rather locked me up

1st time i got arrested for weed the cop asked WHEN the last time i had weed in the car, n that shit threw me for a loop cuz i was thinkin the "do you have drugs in the car" question was comin but when he said WHEN i didnt know what to say, so i said high school n he told me later on the drive to county thats when he knew i was BS'in him, but what are you gonna do i was on the spot n i cant say yesterday or this morning or RIGHT FUCKIN NOW so yea they got me that time. fuckin state trooper too so i had to go to county n not city, some bullshit cuz atleast in city you get a bed n a blanket right away, gotta wait to get housed in county for that shit
Well the initial charge is an A misdemeanor, but I got it dropped down to a violation during my arraignment with a public defender, so it must be common practice.

Good thing about NYC is that there is so much going on and so much serious shit for the cops to worry about, a lot of the times they won't even bother going through with an arrest for a little H for personal use.
Even though the laws are the same, the way it's handled varies depending on what borough you are in, and varies even more when you venture out to the suburbs. I had 1 prior misdemeanor charge of poss of a controlled substance when I got arrested again in the city, and they still let me walk after knocking it down to a violation. My boy had 2 poss charges pending and they wanted to give him 7 days in rikers but he got to walk too. Everyone with a misdemeanor charge got ROR'd and most just plead down to a violation and got it over with on the spot. Ahh, good old Queens County Criminal Court.

You can get more if you have a prescription, but if you are just buying them through the Expanded Syringe Access Program then you are limited to a 10 pack. That's what I figured and I was telling my friend that so he didn't argue with the pharmacist, especially since we were still able to get the 2 different 10 packs, but just had to buy them separately.
Anyway, I originally brought this up because I was talking to my friend about how when I got caught with 2 syringes back in October that the detectives were asking me to snitch, and I basically laughed in their face saying I would never talk, especially over a paraphernalia charge that wasn't even going to stick. My boy was surprised they even gave me a hard time over rigs and said that he has gotten caught with syringes and even his kit with syringes, cottons, cookers, tourniquets, and the police would actually just give it back to him. This was when he was homeless, so I'm sure that worked in his favor for once since they knew that the system wasn't about to make any money off of him compared to a rich kid getting caught with that who would hire an expensive attorney and go through treatment court and pay all sorts of fines for it to be dropped, whereas homeless junkies will just take a few days in jail if it comes down to it.
What The Law Says
- Licensed pharmacies, health care facilities, and health care practitioners who can otherwise prescribe hypodermic needles or syringes may register with the New York State Department of Health to sell or furnish up to 10 hypodermic needles or syringes to persons 18 years of age or older.
- Persons who are age 18 years or older may legally obtain and possess hypodermic needles and syringes through ESAP- without a medical prescription.
This makes it seem like you can only get a paraphernalia charge with syringes if they are used or if you have over 10 on you. I know that was supposed to be the case if you were registered with a needle exchange program and had a card, but it appears as though they expanded it to include any pharmacy registered with the ESAP. Usually when I buy syringes from CVS they give me this pamphlet.
While doing research on needle exchange programs in NYC the data showed that most people with needle exchange cards still get arrested for paraphernalia charges, but the charges gets dropped once you see the judge. The exchanges are few and far between in the suburbs which is probably why they started the ESAP which basically turns participating pharmacies into exchanges, although you have to pay for the syringes still. One of the women that was administering HIV testing at the homeless shelter told me that she though that the program she worked for would give you a voucher for a 10 pack of syringes either once a week or once a month, but it wasn't worth it for me to look into. She said they would mail you the voucher and you could bring it to Walgreens pharmacy for a free 10-pack but I just called the number and they were busy and said to call back in 15 mins, so if I get through to them and get an answer I will post it here.Last edited:

Man, in Providence....in the shitty areas where I copped, it seemed like all those pharmacies always told me that theyd only sell me 100....I usually said fuck it and just drove back to the outskirts to a pharmacy that had 10 packs, but a handful of times, I just bit the bullet and bought the hundred! It was usually Walgreens that pulled that shit on me, gave me 5/16th points when I asked for 1/2s too! CVS has never even batted an eye at me....Maybe the laws differ from state to state, maybe my corrupt little mob-run state doesnt give a fuck, IDK, but you can buy 100 packs there...

Anyway, about 2 years ago, I was going to cop.....driving my 1990 Oldsmobile Cutlass Ciera, which was a fuckin tank! Anyway, I was goin to cop in Providence in a pretty dense dope area.....I got off 95, saw these staties hangin out at a gas station, drove past 'em and went and parked on one of those streets in Prov...It's all triple and quadruple decker hundred year old, run down tenements...I call my guy, and he tells me to take a drive for a half-hour and come back....Fuck!
anyway, I drive back to the highway the same way I came in and I get pulled over by this rookie-ass skinny 19 year old blonde-girl statie, I couldn't believe this girl got on the state police! Most of them are huge! I swear, She was like a 110 pound twig who looked like she belonged living on a fuckin farm in Kansas or something.....
Anyway, she had another statie parked next to her in the gas station parking lot I was pulled over in(rookie in training) and she told me to step out of the car.....I warned her that I had used rigs in my center console, but I had absolutely no drugs! I'm not that stupid! She found the rigs and went and talked to the other cop, comes back and tells me that I'm being charged with possession for the residue in the rigs! I couldn't believe it! There's so many junkies and rockheads driving up that road....I told her..."You're gonna bust me for residue, why don't you wait five minutes, pull someone else over and you'll probably actually find a bag of drugs!"....But nope, they insisted!
So, just about when they're ready to put the cuffs on me, they tell me, "Or you could help us out and we'll let you go!"...Ha, Ive heard that one before! And it's a friday night, so I know I'll probably be held until court on monday, and I'm half dope-sick already....
Long story short....They wanted me to make a buy for them, of course! They wanted me to set up a deal and buy shit, they were gonna swoop in and grab the dealer....their usual bullshit!
but I told them, "I don't have any phone connects, I only buy on the street!"(meanwhile dope dealers are blowing up my phone)......So, they demanded I give them the address and street where one of these "guys" is.....I gave 'em some street and house where I used to get high but NEVER bought any dope, and the person I knew that lived there moved out like a year before! I had no idea who was living there now!....Poor bastards probably have the state police harassing them now...lol
they wanted me to go there right then and make a buy at this house, but I came up with some bullshit and eventually they let me drive away! I copped dope at the original spot 20 minutes later! ha!
But for a week after that, I kept getting calls on my cell-phone from the staties saying they were gonna charge me if I didn't set someone up for them! After the third time, I just ignored their calls and nothing ever came of it! fuckin asshole!
But the funny thing is, then next time I got pulled over by the staties, they said...."Oh youve helped us out before!" and I was just like....."Yeah, yeah okay!"....so it must come up in their system that Im a CI or something just from giving them a phony drug house address!.....It's fuckin ridiculous!....I usually never get anything for having syringes! It just depends on the cop who pulls you over sometimes....$tack bundle$
