So why am I allowed to drive with a BAC <0.08%, but not >0.08%?

Drunk driving and buzzed driving very different. Just because one's the precursor to another doesn't mean a thing in this situation.

Legal alcohol limits are pretty arbitrary. One person's .08 BAC can be very different from another's. At .08 your walking, talking, and balance are visibly affected. Your reaction times are most certainly slower.

Also, in many states, you can be arrested at a .06 if you appear intoxicated. The state needs more evidence than just your BAC to prosecute you, but it happens all the time.

Legal limit should be a .02 like in many European/Asian countries. Sweden's is a .02 and they also have an alcohol tax that is 1%/proof point. They only had 30 drunk driving deaths in their country in 2002.

i never submit to a BAC.....admittance of guilt, no way you can fight it in court BUT if you are shit faced and refuse field and BAC test they can only go on your speech...also if you refuse these tests there are sooooooo many things that can go wrong for the cops that can make it difficult or impossible to convict you but if any of those things go wrong a court can easily ride and convict souly off BAC and field test

for instance: say you go to court but the arresting officer doesnt show up for whatever reason, if you took the BAC test and failed the DA can use that evidence to convict you. If you did not take the BAC test most of the evidence is going to have to com from the arresting officer.

just one of many instances that can result in Nolle Prosequi

and im not bragging by any means but this is coming from a guy that has been arrested for dui 4 times (SHUT UP I KNOW) and convicted (Of 1st DUI) twice. yes i have two first time offender DUIs on my record, its called a good lawyer.

that about sums it up though

The only time I've ever had a BAC breathalyzer test, I was a passenger. The driver got arrested, and the cops were trying to see if one of us could drive the car. I blew like, .09, and all I had was maybe 5 beers over 3 hrs or less.

I was definitely capable of driving, and wouldn't have thought twice about driving home from a bar in that condition. Hell, I probably drive better like that than I do sober.

IMO, the laws are too strict. We should do it like they did in the 60's and 70's.

I honestly don't give a fuck about the numbers, that was just a reference tool.

Buzzed driving is not the same as drunk driving. I don't care what anyone else says, I (and everybody I know too) can drive safely after drinking one beer. Up it to around a dozen and it's a different story. It's hard to deny this observation, and if anyone does I'll politely call him or her a fucking 'tard. :)

I have one dui on my record which shows a BAL of 0.0. I shit you not. But, I was smoking pot and they popped me just the same as alcohol for whatever reason. Jail, fines up the arse and alcohol classes for one year every week. Man I'm glad that's over with. But I do agree with xxkcxx, in that .08 does actually affect your driving pretty severely.

its called a good lawyer.
this is very true, and i didn't realize it till much later.

Germany keeps 1/3 of your yearly salary if you are convicted of dui. A friend was into the Tour De France when Lance Armstron was competing with a Gearman, Jan Ullrich, for first place. I remember the announcers saying that if Jans would have won that Germany would keep 1/3 of his winnings because of a dui conviction earlier in the year. That is one of the harshest dui laws I have ever heard of. I would definitely think twice before driving drunk in Germany.

true story guise

so my lil brother (HS age) has a friend that apparently doesn't have the best home life (he hates his mom, and "society" - his words). i live in indiana, and his grandparents live in georgia

here is the plan he thought up (and implemented): steal mom's money, steal mom's van, load up with supplies, and head to georgia!

unfortunately, he got pulled over in carolina 10 hours from his destination for going too slow on the highway. having some marijuana on his position, he now has four months probation and is stuck with his mom again

i lol'd

p.s. he isn't old enough for a driver's license yet lol

I wasn't the one making a big deal over nothing. There were 3 posts commenting on something and it was done. If it's a social thread, then people can post about whatever, there isn't a specific topic. Besides who is this Memphis guy and why are people putting this guy on a pedistal? I didn't see "Moderator" under his name..if he is a mod of this thread, well then I guess he can make the rules. Other than that, there are plenty of things I don't fee like reading and I just skip over it, because that's the logical thing to do, NOT acting like you own the place and if there are a couple of posts about something he isn't interested in, he can just tell people to "take that shit to the proper forum" I was minding my own business til he started that crap.

You're STILL making a big deal over nothing. People bust balls here. Memphis wasn't attacking you, let you let it get to you personally and now you're all offended and pissy. We're adults here we can say what we want. Memphis has been here a hell of a lot longer than you have+ people like him more than you =pedestal. (Memphis is sort of a staple of the social, true social OG to be specific.) And if you skip things or not, that's fine. Same way if memphis says something you don't like, just skip it instead of getting all huffy puffy about it.

AAAANNNNNNDDDDDD, technically if you read the social rules there's no drug discussion, so you're just wrong again.

so basically what I'm saying is STFU, stop whining. twat.

I don't care what anyone else says, I (and everybody I know too) can drive safely after drinking one beer.
So, if one beer is not enough to impair your ability to drive, you can safely drive after one beer.

If one beer is not enough to impair your ability to drive, and you can safely drive after one beer, you can safely drive after two beers.

If one beer is not enough to impair your ability to drive, and you can safely drive after two beers, you can safely drive after three beers.

And if we keep applying this logic, it is obvious that no amount of beer is sufficient to impair your ability to drive. Next time you get pulled over drunk, just explain this to the officer and go merrily on your way.
