SADDLE RIVER (AP) — A man who overdosed on stolen drugs he ingested at a party in 2007 has settled his lawsuit with a pharmacy, several guests, the party's host and the host's mother for $4.1 million.

Scott Simon, then 17, said he took Xanax that was given to him by a former employee of a Ridgewood drug store and suffered permanent nerve damage as a result.

Simon's attorney John Schepisi told The Record of Bergen County that one party guest was a former pharmacy employee who stole Xanax from the drugstore and gave it to Simon. Simon took the drugs at the party and fell into a coma.

But instead of calling for help immediately, other guests waited for a while before driving him to the hospital, his lawyer said.

Simon suffered permanent nerve damage that impaired his ability to walk and talk, Schepisi said.

"He stays at home now, trying to recuperate," Schepisi said. "He can't walk without help. He has been declared incompetent."

If Simon had been taken to a hospital right away, the injuries likely wouldn't have been permanent, the lawyer said.

Simon sued the pharmacy for not taking proper precautions to avoid the theft of drugs. He also sued several guests, the party's host and the host's parents, who were away for the weekend.

I find this asinine.

He should have known better. Who takes drugs without A) researching interactions and possible complications and B) using moderation and good judgement?

I'm assuming he mixed alcohol with copious amounts of the pill. They don't mention the dosage in the article. Come to think of it, they don't mention hardly anything useful in that article. I can't believe someone actually received MONEY to write it.

How come we reward the ignorant and [typically] punish the intelligent (rhetorical question)? The whole thing is ass-backwards.

Nobody accepts responsibility for their actions in this country. I'm assuming this was in the U.S.

75% of the people on this planet, most likely. We have never even attempted to set up proper education for chemicals, instead of providing an intelligent message like "Chemicals are wrong and dangerous, thus should always be avoided but if you must use chemicals always research all aspects of its nature beforehand!" we provide "Chemicals are wrong and dangerous and so are you if you use them!". This is the fatal failure. I bet the figures would change drastically if we would just educate people, as users we all know how literally atrocious general chemical knowledge is even in a first world country like the US. A huge percentage of the populous literally believes outright crazy myths such as the, LSD/whatever ends up in spine/etc, etc. To me thats outright appalling that my country is so ignorant, really it only takes a slight medical/pharma knowledge to see that things like that make no sense, yet most adults will spew weird myths that can and will hurt people when it comes to chemicals. All this misinformation would be deadened if a large government body where to dispel the myths, I mean now a days were taught that the government is always right and whatever they say goes, so like always the people will follow their word over anything else, most likely. Lastly it makes me sick how we'll give special treatment to certain people yet condemn others to death for similar crimes(figuratively). It doesn't say he was charged with ingesting the drugs or anything like certain OD cases are at the hospitals and he gets 4.1 mil........? How great.

Only in America (which unfortunately extends its chancrous miserly tentacles worldwide).

I'll quote the late George Carlin here:

"We're [the species] just circling the drain. Plain and simple. CTD."

what an asshole, He made the choice of taking the drugs and he also made the choice of the setting of where he taken the drug.... It is his & only his fault for the issue at hand.... anything else is just pawning off the blame on someone else.... When things like this take place all it does it give even more of a reason not to bring the authorities involved when shit hits the fan....

^Jersey's trying to pass a Good Samaritan law now. If something like that passes, I guess the cops would have to ignore the drug situation when they respond to a medical 911 call. That might make their heads explode--which if you've ever seen a pig's head combust, it's a gruesome sight.

We shouldn't wait for the governments to do this, they won't, at least for now.
We should raise money and start an educational campaign of ads about drugs broadcasted on strategic TV channels with messages like "Test your pills!" and "Know what you're taking!"
It would do far greater good than what the governments are pushing in the ears of kids...

We could do it. And for the sake of harm reduction, we should do it!
Maybe we could even get support from Erowid or some non-profit healthcare organizations!

I would expect a major case of Roid Rage to show up; it is Nj police after all ;)

He isn't suing anyone. He has been declared incompetent. His parents want to believe that it couldn't possibly be their baby's own fault for ending up like this. They probably would believe it would make it their fault as his parents. No, this must be someone else's fault. Their darling should have never been exposed to the dangerous world out there. The world should have foam padding and someone should always be watching out for you so that you don't make a stupid mistake. Know your substance. Know your dose. Know your source. Don't get fucked up if there isn't someone around to drive you to the hospital. These are the consequences.

I agree this is complete bull shit, but this is why hes suing. They didnt call the ambulance, and now this guy has to sit home everyday like a retard for the rest of his life. After the hospital bills and all the other care hes going to need because he is "incompetent" Im sure the reward is MUCH less than 4 million.

But he shouldnt have sued the parents, he should get shot in the face for that.

it was his decision to take the pills..i know he shouldn be punished for the rest of his life for a bad decision like that but you damn sure shouldn get rewarded and ruin somebody elses life

This is really lame. He had responsibility for what he put in his body.
If he did not know that, he should have sued his parents.

I am unable to believe that they would ignore drugs.
I think that they would just come back the next day with a search warrant.

lordy i hate stupid people. Thats honestly why i dont get on bluelight as much. i get very tired of hearing "dumbass does something, something stupid happens to oposing side" Bluelight: proving to me how incredulously stupid humanity is since '04

I used to live in Ridgewood back in the mid 90's.

that being said, Fuck jersey, fuck jersey cops even harder, fuck retards who blame others for they're own incompetence(clearly this individual was so before the incident) and fuck the fuckers who didn't call 911 as well.

This whole article just makes me wanna say fuck..

This is total lawsuit abuse. I hope the judge who made the ruling loses his seat next term. He sounds like a complete crook, probably accepted a little bribe from the plaintiff's lawyer for a favorable ruling against the insurance company. Ridiculous. I remember reading about a judge who did this in a helicopter crash and the plaintiff got 13m, I think the judge was busted for a 100k kickback. This shit happens all the time, sounds like same thing here. 4m is ridiculous amount for this story. Judges are so crooked!

seriously...? 4 million? wow.. does anyone take responsibility for their own actions?

How much Xanax would one have to take to incur coma and permanent nerve damage?

Is the damage from respiratory failure and circulation loss? This article is frustratingly absent of details..
