[newbies] can we get arrested for being 'high' ?

hi guys.. just a quick updated... went to court already, got section 10 with good bond behaviour (12months-- too long!!! but what can i do).. no fines, just need to pay court fees etc..
so, yeah, no crim record whatsoever. hearing was only 5-10mins. for the record, i submitted 2 chararcter references and 1 essay about ecstasy.
thats the end of my (unlucky) story....
 
I am fairly sure being intoxicated in a public place is illegal. If you aren't intoxicated but admit to doing Ecstasy before I don't think they can arrest you but if you are then they will of course say that you are "posing a threat" to others safety. if you get stopped by any cops just try to act as sober as possible.
 
if u arnt a public nuisance or dont have possesion or untensils used for the smoking or administering a drug (apart from needle without any traces of illegall substances) then u are fine . but thats just for where i come from. (australia) my friends have got charged for having bowl and scissors in their bag but not bong or illegal substance.
 
well, the lawyer said the essay REALLY help - but maybe its just he want to make good impression on me.. honestly, no need to pay for private lawyer in this kind of case - (unless you have previous records, a bag of ex pills, punch the cop, etc)
anyway, yeah, that the best advise : try to look as sober as possible. means stop dancing or jumping around.. but sometimes you can not see when the cops are coming, rit ?

Hey i got "arrested" and strip searched at a pub one time. We were with 2 chicks and 1 of them had her bf there. The other was my gf..

He was dealing heaps of dingers in the pub and 1 of the bouncers caught on! Anyways we were all rolling pretty hard and the bouncer came up asking us where our mate was. Apparently there had been a chase when he "went to the toilet"...anyways we all got put into a room and held there until the police came (yes they can do this..didnt know that at the time..i was only 18-19 and not as knowlegeble on law, drugs etc as i am now)

So now the police are here and they pat me down. I say to the officer patting me down "aren't you at least gonna buy me a drink first!" Well he doesn't like this very much because his fellow officers have a chuckle at this little joke. So he says "We better strip this one boys.."

So lucky i was off my head because they made me bend over, squat..lift my nuts etc...not pleasent. And if i hadnt of been fucked up i probably would have saiid HELL NO!

So MY POINT OF THIS STORY is that WHILE i was being stripped, questioned etc...i happened to ask a few questions myself in my loved up state. "Havent you ever had drugs man?" "Dont you understand?" "Its not that bad..." etc etc...

And 1 of the questions was "Can i get in trouble for being ON drugs.."

The answer was "No..only if your doing something that is illegal"

So to answer your question. NO!
 
^ it kinda depends. In Victoria, you can be charged with being drunk, for example, under the Summary Offences Act. This typically means being locked up for 4 hours, then released. There is a court date set, but you don't have to turn up and nothing happens.

I can't see why the same Act couldn't be applied to being intoxicated under other drugs...
 
1 pill? How pathetic, good luck with that.

Whens the last time we saw a guy on some pills king-hit people, glass people and the numerous deaths from heads knocked on concrete.

I'm sick to death of this negligence on behalf of the government, if they are going to label ecstasy as 'inherently dangerous', then get a big fucking microscope and have a look at what alcohol does.

It's an absolute joke 8)
 
agree... the only problem e can have is to ourself... cop only need to speak to us and when we can answer correctly then its mean we are responsible enuf of what we have been taken/eaten (not od, drink enuf water, etc) . they better concentrate on those ppl with alcohol on their hand
