Police gain new anti-terror search powers November 15, 2010

Police have been given new powers to enter a home without a warrant under new anti-terror laws.

Labor and the coalition voted together in the Senate on Monday to pass the legislation, and defeat a series of Green amendments.

Federal Attorney-General Robert McClelland said the legislation would give the Australian Federal Police and security agencies the tools they needed to fight terrorism, with appropriate safeguards.

Advertisement: Story continues below "Our national security and counter-terrorism laws will be exercised in a just and accountable way," he said in a statement.

Police have gained new powers to enter premises without a search warrant in emergency terror situations where there is material that may pose a risk to the health or safety of the public.

The time available for police to re-enter a premise under a search warrant has been extended from one hour to 12 in emergencies.

The legislation also disregards a seven-day detention limit for someone arrested on suspicion of terrorism.

There is also a presumption against bail, and an expansion of the "urging violence" offence so that it applies to individuals and groups who incite violence on the basis of race, religion, ethnicity, nationality or political opinion.

The National Security Information (Criminal and Civil Proceedings) Act 2004 has been amended to speed up national security and counter-terrorism court proceedings.

The legislation also establishes a joint parliamentary committee on law enforcement to monitor the Australian Federal Police and the Australian Crime Commission.

Speaking in support of the bill, opposition legal affairs spokesman George Brandis said terrorist activities needed to be defeated at their source.

"One of the most insidious ways in which terrorism may be promoted and almost glorified is for the conduct of terrorists to be characterised as martyrdom or some other glamorous form," he said.

"Terrorism is nothing but murder."

Australian Greens legal affairs spokesman Scott Ludlam later moved a series of amendments but was shot down by both the major parties.

He unsuccessfully sought to remove the word "indirectly" from terrorist acts.

Senator Ludlam also objected to the clause about material assistance, arguing peace activists blocking a naval ship heading to war could be charged.

But the government argued legitimate protests would not be criminalised.

I know that this article is about terrorism and not drugs. So if a mod chooses to close I'm okay with it, although I'd prefer it stays open at least a couple of days to hear some discussion.

This reminded me much of the police being able to search anyone on the street for weapons.


Whats stopping Police abusing this law to search anywhere any time. I dunno... leaves a very dirty taste in my mouth this law. At first I was skeptical, thinking this will only be reserved for VERY extreme situations. But having said that, I can't remember the last time Australia suffered a terrorist attack, not saying there hasn't been attempts. But proving that what we're doing without breaching peoples civil rights is working.

I'd like to see the exact wording of the new law, if anyone could hook me up would be most appreciated, even if this thread gets closed please PM me.
 
I find this rather dis-heartening.

Is anything sacred?

Now they can search our homes and our persons without us having any legal grounds to refuse them.

Do they still need a warrant/grounds for resonable suspicion to search a car? Or have we lost that to, possibly as part of these new laws?

While I havent heard of any one coming to grief over these new weapons laws, I'm sure the privilage has been abused on occassion and hope that this new addition will only be utilised in the extreme cases its supposedly designed for.

It is sad that there are no constiutionally protected individual freedoms in this country; other than
1. The right to elect a parliament from time to time
2. The right not to have a religion imposed upon you by the state.

That is it! Every other "freedom" you may think you have can be taken away by your ever loving Parliament and there's nothing you can do about it (except vote against them at the next election..but when the alternative is an Abbot liberal party that is ideologically just left of the Nazi's, why would you)

Australia needs a Federal Bill of Rights...Right Fucking Now!!

People are in for a rude shock. All these things are being prepared and by the time people wake up and decide they want to revolt, these laws are in place to handle anyone.

The bikie laws for example.. can be applied to like any large gathering that they don't approve of! WE ARE THE TERRORISTS! The laws are ALL designed for we the people... NOT some guy with a turban 10,000 miles away. That is a fucking joke.

And now we have these pathetic staged "Printer Cartrigdge Bombs" coming from YEMEN? Ha ha ha..

So "Al CIA Da" have gone from the most insane terror attack ever killing more then 3000 people using high jacked commercial airliners... to making underwear bombs and printer cartridge bombs!? COME ON! And they can't even get them to go off!?

People... the real terrorists are running this government and other governments. You want power, you abide by the rules and FOLLOW the agenda set down.

President gets elected and the first thing that happens is they sit him down in a room with a bunch of guys smoking cigars and a little screen comes down with a video player showing a new angle of the kennedy assasination, never before seen.

And he says "Alright guys.. what's my agenda!"

That was S.A ..they appealed it at the high courts and had it over turned cause its total BULLSHIT! Not letting certain people interact with others.. come on. Basic fucking human rights were being taken away!

I live in NSW and that didn't effect us at all...we still have this bullshit in place. Not that im a bikie..but its not about that.. you take away bikie's rights you take away ALL our rights..
 
Yes the S.A Bikie laws were struck down. But unfortunately all it takes is a differently composed High Court (e.g. one full of originalist/textualist Liberal party appointees) and bang, your bikie laws are suddenly perfectly fine.

Our constitution contains very few specifically enumerated rights and freedoms and relies heavily on implication. All it takes to over turn them is a different point of view or method of interpretation

these laws are rediculous. people dont get riled up about them is what really gets me. cant remember if i've siad this b4 but i'll say it again:
i'm from the states and i can remember when they passed some law after 911 allowing the government to check what library books you had checked out, people starting shitting themselves! there was serious uproar....america was founded on ideals of 'dont tread on me' and having a hands off government, so it seems that we get real ticked off by stuff like this. still you can't get pulled over for no reason in america (aka random breath test), cops have to have a reason to fuck with you. people seem to really care about this stuff (i know that'll start some arguments about america being worse etc....)

i used to think australia was pretty much the same shit as america, but this is a huge difference i've noticed. people get riled up about cops being able constantly harrass them for no reason, and the typical aussie response is 'ya dont like it? well fuck off...' no one cares, no one gets up in arms about anything...

we seriously need more tripppar's out there in oz....
 
and i personally have had a friend get done for trafficking because cops saw him and decided to search him with these new powers they love so much...

piggies found a quarter on him in one bag, so they searched his car (mind you he was walking) and found bags and a scale. slapped him with trafficking so they could get a warrant, and while they waited for it they chucked him in the interview room (not a cell) for the entire night 'waiting to be interviewed', untill they got a warrant for his house and busted down his parents door at 6am.
found nothing but a bong lol
needless to say they didn't find any knives (the supposed reason behind all this...)

But seriously, 'terrorists' hate us. Be nice to them they're going to kill you, be a dickhead to them and they're going to kill you. They're a minority of extremists that will keep doing what they do no matter what 'laws' we put in place, they don't give a fuck about laws of any kind. It's a mixture of hating the western world/capitalism and complete and utter blind faith in their religion.

Also there's terrorists in Australia, that are born and bred here. It's not just a middle-eastern thing. Timothy McVeigh anyone?

They also found 2 other bombs that failed to detonate inside. This was quickly squashed on the news. The cia had everything to do with that just like many other "terrorist" acts in history (and future). Its a convenient way of blaming things on your enemys and passing new laws..

Just look at the laws clinton passed after the bombing. His approval rating was way down, people were over it.. then boom. Ratings soar, his speeches are applauded and he is a general hero. They create problems, then offer us the terrible, pre planned solutions!

Look at bush's ratings pre 911 compared to post 911.. he was HATED! 20% ! Lowest in history.. then the towers fall. The people unite... war is waged.

And we are still in this illegal war (it was never sanctioned by congress, they MUST give the final word on going to war or not) and loosing Australians and other fellow human beings on a daily basis. Look at the disgusting trageties and horrific tragedies of war on vietnam and other places. Soldiers dis-embowling 6 year old children, massacres, agent orange!

These things (albeit even more sick) are occuring in Iraq/ Afghanistan on a daily basis...why do people not QUESTION this war!? Not many do, not enough anyways!

It all ties in with a general dumbing down of society. Fluoride in the water is a big part of the "OH THAT'S JUST THE WAY IT IS" or the "THERE'S NOTHING WE CAN DO ABOUT IT" mentality..the nazi's used to put fluoride in the water of the jews to keep them PLACID AND SO THEY DIDN'T FIGHT BACK! THEY LOST THERE SURVIVAL INSTINCT!

The same thing has occured with fluridation of societys water. TV and the government have made sure that anyone discussing THIS topic though, is labeled a "nut" or worse, the classic "Conspiracy Nut". When in reality all it takes is a few quick keystrokes and 5 minutes to discover some of the horrors fluoride and other poisons cause us daily..

"There's nothing we can do about it"... this is a lie ! There is PLEANTY you can do to stop it!

I use the analagy from "Bug's Life"... the grasshoppers are all sitting around fat and happy after they have used the ants to harvest there food for the season again. And one grasshopper says to the boss, "Hey boss, why we gotta keep hassling those ants now. We got more then enough food here!"

Argh man TripppAR is right.

This is complete bullshit, the Australian general public need to wake the fuck up and actually see that their own freedom is slowly being removed, it started with the police being able to search your bag without anything but suspicion and now they are allowed in your home without a warrant! When will it end! It'll be just like V for Vandetta soon we won't be able to leave the house at certain times.

We do need to stand up and push back.

Yeah, sorry my wording was a bit misleading, I'm fully aware he was American, and the bombing occurred in Oklahoma.

"Timothy McVeigh anyone?" should have been on a line below and it'd have made maybe a little more sense. But they were two seperate comments. Was just saying there's terrorists in Australia, then I guess trying to emphasise that point by referring to the Oklahoma city bombing by Timothy McVeigh, a white man in a country with a similar culture to ours.
