GULFPORT -- Miami rapper Mike "Magic Mike" Yuen has been sentenced to prison for two years and fined $12,500 for a telephone call that discussed a marijuana deal with someone in Biloxi three years ago.

Yuen, 32, was sentenced Tuesday in U.S. District Court on a guilty plea to using a communication facility in causing or facilitating the commission of a felony in violation of federal drug laws.

Court papers show he spoke with someone in Biloxi by telephone May 15, 2009, about a conspiracy involving more than 220 pounds of marijuana.

Yuen faced up to four years in prison and a $250,000 fine.

Yuen is a managing member of Magic City Records in Miami, where his music is especially popular in the Latin community.

^It's the veritable definition of cruel and unusual punishment. If I were a lawyer I'd file an 8th amendment challenge to this, and I'd win because this is beyond retarded. In fact, that would be my opening statement.

That's pretty crazy. Just for conspiring to traffic? It's not like he actually did it. Or even if he did, that's not what he is being charged with doing. It's a crazy world we live in. Goes to show you can never be too careful with what you say, or do.

Words fail me, though I guess 2 years now for talking about it beats the hell out of a life sentence or whatever over the top punishment he'd get for handling 220 lbs of bud..

In Norway, the maximum determinate prison sentence is 21 years, the prisons are resorts compared to the US, and the recidivism rate is around 20%.

In the US, you can do 2 years or more for things like tax evasion and conspiracy to traffic marijuana and the prisons are hell holes. And the recidivism rate is over 50%.

I wonder if we're doinrite?

Of course...the world is a much safer place without those 220 pounds of marijuana and now nobody will be able to smoke in southern florida.

If only the above were true...and yet, the world would do fine with marijuana along with this man being free. Putting him in prison literally accomplishes nothing.

Having recently been released from federal prison I can tell you that this is not rare at all. The conviction rate in most federal courts is above 98%. In other words if you get charged you are almost certainly going to be convicted. The only choice is to plea out. I met many people who had ceased their drug activity for several years only to be informed on and wind up being indicted years after quitting distribution. Its an extremely fucked up situation.

^IIRC, the vast majority of people in prison or jail were put there on plea bargains, most cases never see a jury trial. I bargained out of a charge once, or at least bargained for a heavy reduction (no snitching involved, I took probation etc.). I recall reading or watching something that proposed that if everyone charged with a crime demanded a jury trial, the court system would be clogged potentially for years.

A lot of times people get convicted on charges they could have beat if they went to court on it, but they would have been risked twice as harsh of a sentence if they had just accepted a plea bargain and confessed.

The whole plea bargain system is fucked, they throw absurd sentences at you and then offer to reduce it to something slightly less insane if you do x y or z, it's fucking extortion is what it is, plain and simple. No one has ever been more coercive or disrespectful and dehumanizing to me than the police, my experience with cops has been consistently very negative, to the point where I don't call them if I get robbed or jumped. Fuck em', I can handle myself.

The entire "justice" system needs a total reworking, it is currently tearing a lot of this country apart and doing much more harm than good. American prisons are unacceptable, this country has become a police state.

That pisses me off! Its a fucking plant, its not hurting anyone! Weed doesnt ruin lives, but the laws against it do. OBAMA PLEASE LEGALIZE BUD! If he gets elected for a second term, i believe he would consider it since hes admitted to toking up in the past. He has ignored the issue up til now but I think hes smart enough to realize that the laws against it are ruining lives
