FARGO – A federal judge on Monday sentenced Wesley Sweeney, 18, to 12 and a half years in prison for his confessed role in providing synthetic hallucinogens that led to the death of Christian Bjerk, also 18, and the hospitalization of a 15-year-old boy in Grand Forks in June.

One of 11 charged in a Grand Forks synthetic drug conspiracy, Sweeney is the first to be sentenced for causing death and bodily injury.

Sweeney admitted buying two hallucinogens on June 10 from Adam Budge, now 19, in East Grand Forks, Minn., and then providing the drugs to Bjerk and the 15-year-old, identified only as C.J., in an apartment in Grand Forks. Bjerk drove him to Budge’s home to buy the drugs and later to a party in Grand Forks, Sweeney said.

About 5:45 a.m., June 11, Bjerk was found dead on a nearby lawn. C.J. and Sweeney, who also took the drugs, were found nearby, disoriented and incoherent, and were hospitalized.

Facing a federal charge that carries a maximum sentence of life in prison and a 20-year mandatory minimum sentence, Sweeney took a plea deal in late August.

Assistant U.S. Attorney Chris Myers has identified Andrew Spofford, 22, as the “hobby chemist,” who ordered chemicals from Europe, Asia and Houston to make the hallucinogens in his rented home near the University of North Dakota. In less than a week, the drugs killed two and led to serious health issues for a handful of others, including juveniles, Myers said.

Bjerk died June 11. Elijah Stai, 17, died June 15 in Altru Hospital after taking the drug June 13 in East Grand Forks.

“I want to take this time to apologize to the family of Christian, and my family and the community,” said Sweeney before U.S. Judge Ralph Erickson imposed a sentence. “Christian was one of my best friends, and I never wanted any harm to come to him.”

He blamed years of addiction to drugs for clouding his judgment.

About 32 family members and friends of Sweeney, including two Catholic priests, filled one side of the courtroom. Several, including Sweeney’s parents, Mary Jo and Robert Sweeney, read prepared statements to Erickson emphasizing Sweeney’s problems with drug addiction. His father said his dream was that his son would finish high school and college and return to take over the family farm near Manvel, N.D.

About 10 family members and friends of Bjerk sat on the other side of the room. His parents, Keith and Debbie Bjerk, gave tearful statements about the impact of his death.

“I go to the cemetery every day and pray the rosary with my son,” Keith Bjerk said.

Sweeney’s attorney, David Dusek, told Erickson that Sweeney did not sell any drugs to Bjerk or C.J., but took the drugs himself, too, in a tragic “nightmare,” that started with three friends partying.

Sweeney put the powdered hallucinogen in “lines” on a table and offered it to anyone, ingesting some himself. “He didn’t encourage anyone else to take it,” Dusek said.

Either he had no idea what the substance was, or he didn't know anything about the substance's potency. But, if I remember correctly, the package was labeled 25I-NBOMe.

edit: yes: that infamous paragraph in one of the earlier stories:

Police recovered a small baggie containing chocolate from Stai’s pocket and Adam Budge gave police an empty baggie labeled “25iNBOMe,” which were sent to the Minnesota Bureau of Criminal Apprehension. Forensic scientist Amy Granlund identified that the psychedelic substance was indeed “25i-NBMOe,” otherwise known as 2C-I

It used to be the case there was only one handful of reports of insufflated hallucinogens - back in the late 70s I think when someone put a couple of grams of LSD flake out and people thought it was blow. There was a medical journal paper on it and everything, I think 5-7 people ended up getting very sick but they all survived. (can't blame em, a half dozen kids showing up at the hospital wilth multigram levels of LSD in them?!) i think it's in erowid somewhere... may be worth pulling it up

"Causing" is really ascribing too much responsibility to the guy, I would say.
He didn't cause anything.

C.J. and Sweeney, who also took the drugs, were found nearby, disoriented and incoherent, and were hospitalized.
But being disoriented and incoherent is part of tripping on strong psychedelics. They may have only been hospitalized because the cops lacked adequate drug education. The hospital probably didn't do anything for them, just checked their vital signs and restrained them. All guesses, and a massive overdose of a research chemical is nothing to sneeze at, but most people read "were hospitalized" and assume something different.

That federal charge is bullshit. The kids' parents should have faced a charge, if anyone, for not knowing where their kids were and not educating them about drugs. The guy who "provided" the drug, and also had a massive OD himself, should not be held responsible.

Assistant U.S. Attorney Chris Myers has identified Andrew Spofford, 22, as the “hobby chemist,”
There is no chemistry involved. You just buy things and snort them.

who ordered chemicals from Europe, Asia and Houston
My three favorite continents

to make the hallucinogens
he didn't make anything, right?

in his rented home
relevant?

In less than a week, the drugs killed two and led to serious health issues for a handful of others, including juveniles, Myers said.
Wait, I thought that the guy who ODed caused the boys' deaths! Now it says that the drugs killed people. Who, in reality, is responsible?? And, if it is not the 19-year old guy, why is he going to jail for 12 years?

“Christian was one of my best friends, and I never wanted any harm to come to him.”
I believe this. He himself also took too much.

He blamed years of addiction to drugs for clouding his judgment.
Blame it on the drugs again.
But I think he meant to say that experimenting with many drugs showed him that drug education in the US is ridiculously stupid, and so he became careless because it seemed like everything that the DARE program told him was a lie.
Again, I blame DARE.

^ Agree with the last 2 posts. what a load of shit. What's jailing him for 12 yrs going to achieve.

Facing a federal charge that carries a maximum sentence of life in prison and a 20-year mandatory minimum sentence, Sweeney took a plea deal in late August.

That seems incredible. And the substance was legal, and he didnt encourage anyone to take it? What if the drug was alcohol, would the same kind of sentences apply?

Hahaha! I'd love to read this article. Someone sold LSD crystals and people thought it was blow? lmao! That's unbelievably awesome. I'd love to do a tiny bump of LSD crystal powder.

Sweeney admitted buying two hallucinogens on June 10 from Adam Budge

And what the fuck happend to this guy?

Yeah they're both culpable in the kids death, but something tells me selling 25i powder to someone, and not giving dosage advice is just as criminal as racking up a line for your buddy to do.

Still, it was up to the person who ingested the substance to know what they were taking. No one made him take that line, and he could have said, i think i'll do a bit of googling about what the fuck this actually is before i snort an unknown amount of it. It doesn't sound like any of them knew what it was, and thats no ones fault but their own.

Murder in the third degree, second-degree manslaughter, selling a controlled substance to a juvenile and selling a controlled substance (see BL thread linked somewhere above).

Also note that even though 25I is not a controlled substance, all they had to do was scare him into copping a plea.

why blame dare for this dudes appalling stupidity? this is an appaling lack of common sense from a 19 year old

Not to mention that the substance is legal.

Once you cop a plea, though, all of that is moot.

Boy ain't that the case! ;) very often they push you so far into a corner that you have to cop. . .unless you are made of money.

This is why Bluelight exists FIRST and FOREMOST. Educate people so needless deaths like this don't happen due strictly to ignorance. Sad.

His lack of common sense caused his own OD
The 16-year old's (or whatever his age was) lack of common sense caused his death.
Each person was responsible for their own overdose.
Each person is responsible for what s/he chooses to put into his/her body.
Without solid, science-based information and a realistic approach and attitude towards drugs, people don't even know to do research before putting chemicals into their bodies.
