Man charged with making DMT has “regret”

So.. 1) he didnt even have any DMT? (excuse me, MRHB-extracted "Ecstasy")
2) he got arrested for Mimosa and similar ingredients
3) these are not illegal until they are used I thought?

You don't need the DMT to be found guilty of the production man. The idea is, if I have all the glassware and chemicals needed to synth methamphetamine, (I DO NOT, THEORETICAL SITUATION PEOPLE.... I AM NOT A CHEMIST, GOT A C IN CHEMISTRY IN HIGH SCHOOL LIKE YOU DID) even if I'm not GOING to synth the meth, maybe just planning on MDA, they can still charge me with planning to run a methlab!!! They just make the assumption that some no-good chemist with all of these chemistry lab pieces and chemicals wouldn't need it in theory unless they were doing production. And that is almost true except... what if it's Alexander Shulgin and clearly he's not interested in cooking meth, but making better RC's which improve on simply a meth lab...

the gov't can still call that that's what you're doing. You could then say "well then why do all of my documents show nothing like that". blah blah blah but that is essentially how law works in that sense. They'll try to make it seem like you'd do it and still had a guilty mind going into it. If you just had some schizophrenic fantasy where you needed all of these weird items set in place and not touched, you could theoretically claim insanity as you'd have no wherewithal to create meth but... as I said... the gov't can still just claim you were going to. They'll take any truthful thing you say and spin it against you (i.e. this is why you always say I'm going to talk to a lawyer, and not you hahaha) - etc.

I support Walmart for not putting every single item for cooking meth in the same isle.
I support Ace Hardware for not doing this for IEDs.

But what if you have your own hardware store and just happened to have everything necessary to build bombs but obviously you just own a fucking hardware store? They can still argue it. The gov't is so asinine like that!
 
^after reading about some people's experiences, it seems more like they'll charge you with manufacture of a controlled substance whether or not you made that controlled substance. Like, they'll charge you with manufacture of 2C-B even if you had no bromine and instead had a jug of chlorine. They'll charge you with manufacture of the more illegal substance and bet that you'll take a plea deal (versus having to pay a lawyer hundreds of thousands of dollars and hoping a jury will understand that there can be no 2C-B without bromine--which, chances are that they'll think you guilty as soon as they see your beakers and pipettes).
 
yes, prosecutors will always CHARGE the party with the harshest offense they can find because they hope to get away with it. unfortunately some people do not even know the difference between charged and convicted. not only that, but some people dont realize you have the right to remain silent for as long as you want. you dont have to speak to anyone at all until you at least have an attorney.

usually when you plea not guilty at the first hearing those insane charges start dwindling pretty quickly if you can present and defend yourself pretty well. when i go to court i always plea not guilty as soon as i am allowed to speak, those are usually my first words to any officer/judge/ref, i also always refuse a court appointed lawyer. lazy people with no knowledge of the law, no idea what they are doing, and with no confidence request these so called court appointed. educate yourself a bit and you dont need one, save some money. they usually drop the charges pretty quickly just in light of the fact that the man on defense has some god damn confidence. if youre all sweaty, stuttering words and saying " i dont know i dont know " repeatedly youre probably going to get slammed with whatever charges they can throw at you; praying on the weak is what our justice system does. i ALWAYS defend myself, it shows confidence, independence, and its financially smart. those court appointed lawyers are a complete waste of money and usually the prosecutors BFF.

If you believe that making and distributing DMT to your friends and family should be illegal or regulated ONLY because of the use of lye in production, then you should believe the same thing about lutefisk.

Seriously, people just shouldn't fuck with shit when they don't understand it completely. With that said, I think you would almost have to try to produce DMT that could cause lye poisoning (not so with the far more dangerous lutafisk). He may have been a perfectly good chemist, even if he is terrible at talking to the cops. We just don't know. He certainly should know better when to keep his mouth shut. I don't know what he was even thinking appearing in court without counsel.

Anyway, I think the really shocking thing about this story is definitely the journalism. Do we not fact check our stories anymore? I guess it is fair game to print any sensationalized bullshit these days. Here's a tip, media. Next time you run a story about drugs, read some info on erowid.org or any of the perfectly good drug information web sites before you publish something that makes you look this stupid again. Geeeeeez. I guess ignorance breeds ignorance.

Maybe it is illegal to make lutefisk yourself with lye, I guess not for personal consumption but I doubt I'd want to try some that someone had made with red-devil lye, or whatever. And where's the average person going to get food grade lye? The one recipe I found used lime.

Yeah totally, they could at least read a single search result on the subject before writing the article. Ideally, as the point should be to report the facts along with some unbiased information most readers probably wouldn't know, they'd read several different sources. Maybe they really don't have time to write a proper article, or they just don't care, I don't know.
