Legal Question about Oxycodone Theft...

sort of long, dunno if this is the right place to post this or not, forgive me if it's not

I went to Florida with my cousin to the Orange Bowl (Clemson vs West VA for those who care) and we were tailgating in a pickup truck and someone stole my prescription of oxycodone 10/650... I had about 100 pills (script was for 120, but I got it filled on the 29th of Dec) and now they were all gone...

That was on the 4th and I didn't know they were gone until I arrived back in SC...

I had them in a small suitcase and I always carry a few in my pocket just in case I need any (I have been taking them for a couple of years now, legitimate user)...

I took a few in my pocket just in case I had any back pain during the game (because I can't carry around my whole bottle, it's huge). Anyways, make a long story short, I got home Friday morning around 3 am and went straight to bed because I was so tired. I didn't know they were stolen until 11 am friday morning when I was unpacking my suitcase... I called my local sheriff's department and they told me since I thought they were stolen in FL, I would have to call the FL police department. So I called Florida and they told me I would have to call SC... So after talking to SC, they reassured me I would have to call Florida, since that's where I thought they were stolen. So I called Florida back (this was the 2nd phone call to them) and I told them I needed to file a police report. I heard an officer in the background yell "is that the guy from SC calling again? Tell him if he calls back here one more time, we will have him locked up!"

I couldn't believe it, I was simply just trying to file a legitimate report (and yes, I understand how bad the drug use is in FL) and I explained that SC told me I had to file it with them, anyways, they told me there was no way in hell they were going to file a police report for stolen "oxycontin."

I then spoke with the SC sheriff's department again and spoke with a nice deputy who told me to call a supervisor and talk to them. So that's what I did... I finally got ahold of a woman who took my report down and treated me like a scumbag... She was almost like a lawyer grilling a person on the stand. She was trying to trip me up, put words in my mouth, and didn't believe in my story at all. I told her the truth, exactly what I told you all and she told me in all of her 26 years of being in law enforcement, she has never heard of a person taking a few of their pills out and putting them in their pocket. She then told me that I was a criminal (she literally said that) and what I did was a crime. I had no idea that you had to carry the bottle with you at all times and it was illegal to carry a few of your pills in your pocket. She asked me why I took my bottle to florida and when i told her I wanted to keep the pills together, just in case anything happened to me, I wouldn't be questioned with having a few pain pills in my pocket without a bottle. She then told me I was smart enough to bring my bottle with me down to florida, but then dumb because I didn't keep them together. Anyways, the whole situation is super depressing and I hate that someone stole from me and then I am being threatened to be locked up for filing a police report.

I then called my doctor's office and spoke with a doctor who is in the same practice that my doctor is in (he was on call and it was in the early evening). I told him the whole story and even he said he wasn't sure if I had to carry the bottle with me at all times and it was illegal to carry just a few pills of your own prescription in your pocket...

So now I have to wait until Monday to get the police report faxed to me and hope my doctor writes me another prescription. The whole situation is unbelievable. And I've heard insurances won't pay for stolen meds.. So I know this is gonna end up costing me an arm and a leg...

So, is anyone familiar with the law about carrying your own prescription? I mean, it's absurd for me to put a huge bottle of 120 pain pills in my pocket... I just carry around about 4 and go to work and come back home (I lock my meds up in my house)...

Any insight or comments would be appreciated... Thanks...

You should carry around proof of prescription. I'm sorry to hear about your meds being stolen but we don't do legal advice here anymore.
