Laws For Weed

it varies from state to state. care to say what state your in (or is the paranoia too unbearable?)

compared to america its very lenient, and the laws are rarely enforced to their full extent unless its something really big.

its pretty much the polices call whether they arrest and chrage you, or just let you go. generally they will let someone they belive to be a simple pot smoker and not dealing go and tell them to leave it at home, at least in my state.

they will destroy your stash tho :( compared to being beated down and getting a permanent record we have it easy down under :)

Thats a pretty broad n00b question your asking there....

Depends which state/country your in, what you get caught with, what you get caught growing, what you get caught selling.......

WA laws... posesion of 30g or less, or two NON-HYDRO plants has been decriminalised. you will get a $200 fine OR attend a brainwashing session.

hyrdoponics or hash oil is up to the cops discretion.... they could techniaclly charge you if you had one hydro plant or a cap of hash oil. i think it depends entirely of their opinion, if you have scales and baggies lying around and lots of traffic through your house you might be in trouble.
however they can choose not to charge you with dealing if they think your just growing your own stash.

so throw away your old baggies and keep the scales in the kitchen if you want to grow your own hydro. and keep the whole plant intact for as long as possible. its kind of stupid that you could legally have 2 whole plants, weighing a pound each, but if its manicured etc and in a bag your screwed.

perhaps my understanding of the law is lacking a bit... i grew a single plant, ten ounces of primo bud. about 12 large colas. i cut each cola off the plant to hang and dry, but i kept the 'base' of the stem, in case i needed to prove that it all came from the same plant!!!

mind you it was technically illegal since it was hydro :) (and HOW..lol) but i started before the laws changed, and didnt want to rip out my baby.

if i was going to grow again (wish i could, im almost at the end of my 10 ounce smokefest :( :( ) i would definately switch to pots of soil. hyrdoponics is defined by the growing medium, not whether its grown inside or out... so you can grow nice indoor plants, just not in a hydro setup. make sense???

beyond this im not entirely sure, never intend to have large crops or pound bags lying around lol. but the new laws have actually tightened the upper end of the scale, with less plants or quantity of weed needed to get a BIG charge against you.

but yeah being able to grow 2 plants all year round should be enough to satisfy the consumption of most stoners i think. so i rather like the laws here. the hydro/hash oil thing is a pissoff, as hydros are more of a perfected and optimised grow, and what are you supposed to do with the trim???

if anyone know about the whole "when does a plant become a weight" thing id like to know... as the way i understand is you gotta basically keep the plants whole and not bag em, even if its all in one big bag/container.

I was trying to find you a nationwide summary, but it seems you need to go state by state. As an example - here's details on the NSW caution system. From here

NSW Scheme

The Cannabis Cautioning Scheme commenced on 3 April 2000 and is operated by NSW Police.

Under this scheme, adults detected by police using or in possession of not more than 15g of dried cannabis and/or equipment for using the cannabis may receive a formal police caution rather than face criminal charges and court proceedings.

The Scheme applies to adults only and allows police to exercise their discretion in appropriate cases and issue a caution. Police are still able to decide instead to formally charge offenders.

A person can only be cautioned twice and cannot be cautioned at all if they have prior convictions for drug offences or offences of violence or sexual assault.

The Scheme also does not apply to those caught supplying cannabis – drug dealers continue to be arrested and prosecuted under the Drug Misuse and Trafficking Act 1985.

The Caution

The formal Police caution warns of the health and legal consequences of cannabis use and provides each cautioned person with information about treatment and support services. In particular, the caution notice advises offenders that they can call the Alcohol and Drug Information Service (ADIS) for confidential help and information regarding their cannabis use.

Persons who receive a second, final, caution are required to contact ADIS for a mandatory education session about their cannabis use.

I wont post anymore, not sure what state you are from, but google is your friend... it's not too hard to find the info you want. A quick search of your state + cannabis laws will probably bring up the government sites in the first 10 hits =D

Thanks guys, I live in western australia....

btw im not paranoid i just want to know what i could get done with basicaly all they will find is a bong and a bag

QLD laws

For Queenslanders:

Drugs & the Law in the Sunshine State

Information Sheet - Queensland's Drugs Misuse Act

Police Diversion Program for Minor Drugs Offence - (Cannabis)

Toke on guys, I believe a lot of Queenslanders use drugs to forget the Queensland drug laws. =D

Hope helps for fellow Queenslanders, since the orginal thread poster is based in Western Australia.

Usually for other states, just check your state police websites or contact your nearest legal aid type of community centres, they usually will give you further more information.

Also you can check out your local court reports to give you rough idea of sentences that been handed out, it can be pretty interesting to read court reports from wide range of "crimes", not just drug related crimes, but others.

There's several Australian based cannabis forums and they can be easily found by using the google and some usually have legal information and reports from members that actually got busted and their outcome after going through their court appearances or when they got cautioned, etc etc...

Cheers, Urbie %)

Thanks for the info Urban..... although it's actually pretty scary.

Amphetamines, 2g or more
20 years
Amphetamines, less than 2g District Court 15 years
Magistrates Court 3 years

I assume this includes MDMA..... Some harsh penalties for a schedule 2 drug........ Be careful all who venture out in Brissy!

thankfully the aussie police are either down to earth enough to disregard casual drug users, or corrupt enough to steal their cash + stash and not formally charge them. or at least thats been my experience
