Jan 6 Attack on the Capitol and the aftermath

more accusations (with audio) of trump and other gop operatives interfering with the election process: Detroit News: Trump recorded pressuring Michigan canvassers not to certify 2020 vote

"(CNN) — The Detroit News reviewed a recording of a call former President Donald Trump made to two Michigan county officials in 2020, urging them not to certify the election results from Detroit.

The call was previously known and reported by CNN – and condemned at the time by election experts and Michigan Democrats, who said it was a stunning attempt by a sitting president to pressure local officials to interfere with an election.
...
RNC chairwoman Ronna McDaniel, who was also on the call told the officials, regarding the certification: “Do not sign it. … We will get you attorneys.”

Then, Trump added, “We’ll take care of that.”

would make sense to not certify fraudulent voting.

So I guess trump got some bad news. He just posted this and I somehow saw it. He is a delight. He did not do the blasphemous quote of doing it for "us" as if he is the savior.

CROOKED JOE BIDEN and the Radical Left Democrats, together with their minions in the DOJ, are coming after me, that moron’s Political Opponent, like never before in the history of the USA. Crooked Joe is a Threat to Democracy!!! They are setting a horrible precedent for the future of our Country. Deranged Jack and Lisa, is it a 6 year Statute of Limitations, or just 5 years? Ask your slimeball Boss, Andrew Weissmann, what your next move

Do we all agree now that Jan6 was a setup by the Feds and not an insurrection?

Or are we still believing fantasy tales spun by propagandists?
Man that notion has been spoken by every malisha and malcontent for years and years. Like JG, for sure you have some insight and can see the maneuvers that trump is doing. Surely you have vision of who is a con man and who is falsely spoken as a con man. It is easy to see. Regardless of political gripes, this is easy to see. Truth does exist. A person can jump up and down all they want and say the world is flat, but the truth is it is round. Truth is almost like a natural law. And it survives the test of time.

absolutely.

trump's act is great for whipping up the base but he and his lawyers are in over their heads where it counts - in the courts.

Why the fuck does Trump always capitalize the weirdest phrases in sentences, like “political opponent”? Just why

Oh yes it counts. Watch the next few months.

Ha ha just saw a twilight zone that dealt with living under a dome. And then people living in dungeon stocked with food, and everything they need in case of nuclear war.

The dude is under a lot of pressure. All self-inflicted. It’s funny most of us growing up know how to stay out of the system. We were all intuitively smart enough to walk that walk. Yet this dude, pokes at it and tests it, and when it comes back to get him, he types in caps because he’s freaking out. Who would not freak out with all those counts?.

The video footage has been released and people like the Shaman guy were exonerated. We see authorities escorting protesters into the building. We know that there were many FBI informants in the crowd. It's funny when people talking about denying reality while doing just that.

Judges skeptical of Trump's immunity claim in election subversion case

"WASHINGTON, Jan 9 (Reuters) - A Washington appeals court on Tuesday questioned Donald Trump's claims that he is immune from criminal charges for trying to overturn the 2020 election, as the former U.S. president warned he could prosecute Joe Biden if he returns to the White House.

Trump looked on as his legal team sought to convince a panel of three judges that former presidents should not be prosecuted for actions they took in office. Trump is due to go to trial in March on federal charges of election subversion.
...
The judges reacted skeptically to that argument.

"You're saying a president could sell pardons, could sell military secrets, could tell SEAL Team Six to assassinate a political rival?" Judge Florence Pan asked Trump lawyer D. John Sauer.

Sauer said that a former president could be charged for such conduct only if they were first impeached by the House of Representatives and convicted in the Senate.
"

check out this incredible moment from the hearing: US president could have a rival assassinated and not be criminally prosecuted, Trump’s lawyer argues

"One of the judges asked Sauer: “Could a president who ordered SEAL Team 6 to assassinate a political rival, and is not impeached, would he be subject to criminal prosecution?”

Sauer responded: “If he were impeached and convicted first... there is a political process that would have to occur.”

The court is considering an appeal in Trump’s election obstruction case after the trial judge already rejected these same arguments about the scope of presidential immunity.

Assistant special counsel James Pearce urged the panels of judges to reject Trump’s argument. “Never in our nation’s history until this case has a president claimed that immunity from criminal prosecution extends beyond his time in office,” he told the court. All three of the judges expressed skepticism about Trump’s legal argument, repeatedly grilling his lawyer on the immunity claims.

specific presidents aside, does anybody here believe that the potus has - or should have - absolute presidential immunity?

Don't we describe nations with that sort of government 'dictatorships'? Absolute power in the hands on one person.

"I could stand in the middle of Fifth Avenue and shoot somebody, and I wouldn't lose any voters, OK?" Trump remarked at a campaign stop at Dordt College in Sioux Center, Iowa. "It's, like, incredible."

the argument the trump team is making is insane.

they say that, absent the president being impeached by the house and found guilty by the senate, he would not be criminally liable for, say, ordering the u.s. military to execute a political opponent.

be careful what you wish for.

“Could a president order SEAL Team Six to assassinate a political rival? That’s an official act, an order to SEAL Team Six?” Judge Florence Pan asked.

Trump lawyer John Sauer dithered, invoking the founding fathers and what they would intend in such a situation.

“I asked you a yes or no question,” Pan interrupted. “Could a president who ordered SEAL Team Six to assassinate a political rival who was not impeached, would he be subject to criminal prosecution?”

“My answer is qualified yes. There is a political process that would have to occur under the structure of our Constitution which would require impeachment and conviction by the Senate.”

Well, since a member of the Senate could be that 'political rival', that's not a QUALIFIED 'yes', it's simply a 'yes'.

trump's claim that, at the time he was pushing state election officials and the vice president to overturn election results, the election was "long over" is so unbelievably transparent.

he must think the american people are absolutely stupid.

it's so obviously not going to work and it's hard to see how it doesn't create problems for him elsewhere.

that was the frustrating thing about listening to this... the "qualification" part was already set aside, so clearly there was no "qualified yes" to that question.

the dc court of appeals just issued its decision: Trump is not immune from prosecution for bid to subvert the 2020 election, appeals court rules

"Former President Donald Trump — and indeed any other former president — may be prosecuted for alleged crimes they committed while in office, a federal appeals court panel ruled Tuesday.

The unanimous 57-page decision from a three-judge panel of the D.C. Circuit Court of Appeals is a major win for special counsel Jack Smith, who is seeking to put Trump on trial this year on federal felony charges stemming from his efforts to overturn the 2020 election.

...
The ruling affirms U.S. District Judge Tanya Chutkan’s historic conclusion that former presidents may be prosecuted for crimes they committed in office, even if those alleged crimes arguably related to their official duties. Trump had argued that former presidents could not be prosecuted for such actions without first being impeached and convicted by Congress.
...
“We conclude that the interest in criminal accountability, held by both the public and the Executive Branch, outweighs the potential risks of chilling Presidential action and permitting vexatious litigation,” the panel concluded." (my emphasis)

tl;dr trump loses

he'll surely appeal.

If Trump was taken to court for swearing the sky was green - 100% after losing he would double-down with the claim.

Must take a special kind of person to involve themselves with the Trump camp. I mean, the attrition rate is brutal - he does something dumb and it's someone else's fault. ALWAYS.

You know, it some ways it's a pity the only way to read the innermost thoughts of Donald Trump is to download Truth Social.

I, for one, do not place a huge amount of faith behind the authors of that application. I do not imagine Trump would pay for the best. Their have been a number of occasions where hackers were able to gain unauthorized access and manipulate the site. So the reported cases are the floor... I wonder how many more were quietly patched and users not made aware?

If one were able to hijack the platform for just a few hours.. well, it could be unfortunate.

BTW I spent over two decades as a software engineer and the sophistication and long-term planning involved in, say, a supply chain attack was amazing. When Solar Winds (a software security company) finally discovered the attack (and subsequent infection of 33,000 systems), someone had added a tiny stub of code over two years before.

At the end of the day, software is only as secure as it's weakest link. If three languages were used, that's three compilers and how secure is the supply-chain of the compilers?

I do appreciate that this is reductio ad absurdum but we are now seeing hackers reading through stolen source-code to find zero-day exploits. The number of ZDEs an attack uses is an indication of how much time and effort went into it.
