is it considered rape??

I think this is quite blatantly rape. How can you prove ongoing consent from somebody who is shitfaced drunk?

I don't think it is that hard - make sure you obtain explicit consent from somebody before you proceed with any sexual act and make sure they're comfortable as you go along. Unless I agreed to it beforehand explicitly, I definitely do not want to wake up with somebody's surprise dick in me.

If she consented, even drunk, then no it's not rape. It's pretty questionable (well, downright asshole-ish) on the guy's part, but rape implies a lack of consent and that's not what intoxication is automatically filed under.
 
hmm the whole intoxication thing is a big problem with regards to rape as when people drink they chose to have their sense of judgement go whereas being drugged without permission makes it rapier if that makes sense. if you were drunk it makes it hard to prove as with intoxication comes court doubts with your version of events and this happens in both scenarios.

basically the law and a moral sense of right and wrong are sometimes separate and intoxication can be to varying degrees but there is no way to prove how intoxicated someone was as one person can handle a drug (lets say alcohol) much better than the other as everyone is different...
 
^Yeah, it's kinda delicate...if you've been drugged without permission I think it's pretty obviously rape, but if you've just been drinking of your own accord all night and agree to have sex with someone you wouldn't have sex with were you not drunk and regret it in the morning, you've still consented...
I mean it's happened to me to wake up to some guy and be like 'holy shit, I should not have done this' because I was too high or whatever to make a good judgment call the night before, but I've never compared that to having been raped - my fault for not beign more careful.

Yes, it is technically rape. Did I file a suit? No, I never plan on doing that. It's not like I have a conscious memory about what happened, and I literally don't care and it didn't mentally effect me at all.

The only thing I know is that the situation can be kind of awkward if you at first think it's your girlfriend but then realize she's passed out beside you and the one 'doing the deed' is your ex that happened to be at the same party.
