If its legal to sell needles OTC in your state, can pharmacists refuse?

I looked up the laws for syringes in New Hampshire, and it said that OTC sales of 10 or less syringes in pharmacies were legal (Prescription law excludes <11 syringes for adults). So I decided to see what would happen if I went to 3 different pharmacies to buy rigs.

At RiteAid, the first time I went, the male pharmacist sold me rigs after checking my ID and giving me a pamphlet on health and saftey. The next time I went to RiteAid, the female pharmacist got all mad when I asked and said she would not sell them over the counter (when I told her that her coworker sold them to me, she said "well I thought we were all on the same page about this but I will NOT sell them.")

At CVS, the woman said that they would not sell rigs OTC without a perscription, but referred me to Walgreens because they did.

At Walgreens, I got syringes with no questions asked, no ID needed.

Is it legal for pharmacists to refuse to sell rigs OTC if state laws say its legal? And is what happened in RiteAid, with one pharmacist selling them and one refusing to, legal also?

I think its just an individual business and they can do as they please? Kind of like they hold the right to refuse service to anyone

or no shirt no shoes no service in certain business others its no problem

kind of just depends on that business, and then even on the individual, i would say

They can refuse, but if its a law that they MUST provide them, you can get them fired. My friend did this to a pharmacist after they wouldn't sell him rigs. He came back with the state law printed out and presented it to the head pharmacist. The pharmacist who refused the sale was disciplined.

Ugh I hate buying rigs I always feel like its so obvious what I'm doing but at the same time I have a very innocent look about me so I'm not really sure if it is obvious. Whenever I gotta buy them (when I'm alone and out - otherwise whoever I'm w usually does it) I always pretend to be all confused and that I'm buying them 4 my grandma. Recently bout a mth ago at rite aid pharmacist asked 4 my gmas name and shit and said she can't sell without proof of a prescrip or w/e. Walgreens, kroger, kmart basically everywhere else is cool bout it but I have encountered those stuck up middle aged - menopausal women who look u up and down like ur a piece of shit tryin to eye contact intimidate u with their silent judgements. One time when I was already high as fuck and had broke my last needle I was experiencing a situation like this and I was the kind of high where u will tell anyone off if they push u / sometimes if they just have an annoying voice and u feel they should know bout it. Anyway this bitch was like these are for your "grandma" huh as she was ringing them up I was like yep she was like mmm hmmm its a shame ur so pretty and wasting it on this then I said look I don't think people give u their personal commentary when they're ringing u up at a store and I don't give a f if they do. I know this next part I said was stupid on my part n that she coulda called the cops or w/e but I was so high and aggrivated w her I didn't care at the time and felt the reaction on her face would b worth it as I was getting my change and she was handing me the bag like with the tips of her fingers as if there was dog shit in it I was like well u have a good day casting ur unwanted condescending opinions on strangers I have a vein and a needle that is waiting for me to draw blood and bang some dope. One more thing fuck you. I would never have said that had I not been high as hell but sometimes I have no filter on what I say. She looked horrified and I remember leaving feeling gratified sick. Was so dumb of me. Anyway most ppl will sell them if u look fairly normal n I say this bc whenever I try to buy them high I get the looks and all that eyebrow raises when I'm not they're nice as can be. I think if it was obv u were buying them 4 drugs like u had visible track marks or something like that and they refused they would be allowed to do that otherwise I agree with what everyone else has said. But its hard to argue that situation really in depth if it came down to it like I wouldn't wanna get into a legal dispute n have to take a drug test lol

It's definitely a gray area. On one hand, it is the law and they really are supposed to sell you them. But it's up to to the business (chain or private owned?) and the individual. I never had a problem buying them in NYC and there's a chain pharmacy on every other corner there anyway so I was always fine. And nobody gave a shit. When they legalized the sale in PA, I was refused syringes in Philly by a few places. I kind of got pissed and I told them it's the law, blah, blah. Some of them outright refused. Some didn't know the law had passed I'm guessing and were unsure. You'll have an easier time in places like CVS, Walgreens, Rite-Aid and other chain pharmacies than some Mom and Pop place. At least there's protocol and steps to take with a corporate place and if you bitch enough and you are right, you will get your way. Although, I was refused by Wal-Greens somewhere else in PA. They said you needed a prescription, yada, yada. I didn't feel like arguing so I just hit up another place, some pharmacy inside a supermarket. I made friendly with the head pharmacist and so whenever I needed rigs there I had no trouble at all. Even though it's 100% legal, people still act like dickheads, are uninformed about the laws or just straight up don't give a shit and won't sell them. They will make excuses. But I bet some 60 year old woman wouldn't have problems, ya know?

If anyone is having problems and they are legal in your state, try to hit up cities or more populated areas. Some states also have bigger drug problems then others, so it's kind like a new thing and a shock to some people. People don't blink an eye in NYC but like even if they are legal in New Hampshire, I'm sure some people make a big deal out of it. Drugs in the community, they know what you are up to, etc. Some places aren't as bad as others.

you should start trying any walmart, and also walgreens you can places in houston, i would imagine all of texas would rather see you catch aids than allow you to buy needles. im contemplating asking the places that do sell needles to exchange my old ones for new ones.

I didn't think it was that hard to get them. I thought krogers sold them. I know there are places that do bc they don't want u cathcing aids and they can't stop iv drug use so...

like i said before, everywhere is different sometimes separate establishments of the same chain wont sell you syringes.

for example a walgreens around the corner will but down the street a separate walgreens will not.

you need to be mature about it and hang your balls out there people understand what the consequences are.

I live in san antonio texas and i buy my needles at HEB. Allthough not all of them will sell them to me. You have to shop around and find out which stores will and which ones wont.
In then end youll find the right one and from then on you can just keep going back to that one.

Go into the drug store ,go to the counter and ask for example 10 1cc insulin syringes with a 29 or 30 guage needle, and don't act like your waitng to see what they say,do it like you were asking for anything like 10 packs of gum ..lol..don't act all nervous,if anything they don't give a shit what you are gonna do with them, but at least keep it on a buyer and business level,,you are the customer and they say the customer is always right..lol we all know thats often bullshit but go in and tell them what you want and don't take any shit from them...It's none of their fucking business if you have diabetes or if they are for your " grandmother, aunt, mother whatver lie you wanna tell them "IF they Ask" and like i said it's not there business unless you are a young kid or something so if they won't sell them to you complain to the manager(only if you are not holding any drugs!) and go somewhere else..

Around here tractor supply sells a larger variety but you can always say you give your pet snake baytril injections for resperatory infections

Best "excuse" I ever heard: "We use them to inject air into earthworms - it makes them float off the bottom and wiggle more. The fish like that." LOL.

just make sure you know what to ask for, don't go in there and not be prepared to ask for the right thing.

the walgreens here in Tucson that I go to apparently won't sell the walgreens brand 10 pcks to me without a script(in Illinois I had no problem getting the 10 pack), but they will sell me the leur lock BD ones, that have fucking 27G needles. while I prefer 28-29G, they sell them in singles. they even asked me one day "you got a script" and I said "no", so thats why I think you have to have a script for the "diabetic" ones as the lady called them.
