Criminals OK to do runner from cops

CRIMINALS have been given the green light to run from police in a decision that has stunned the force.

A magistrate found that a drunk who sparked a police chase through city streets did not resist police.

The lawyer who helped beat the charges said the landmark ruling - which makes it clear suspected criminals cannot be punished for running from police - could now make the police's job of arresting suspects even harder.

The Police Association fears the decision will encourage more criminals to try to escape arrest, putting the safety of the public at risk.

Mr Hamilton's lawyer, Thomas Bevan, relied on cases from Britain and New Zealand. He said the outcome was "surprising" but made sense.

"The ruling is clear in that if you haven't been arrested then you don't have to stop," he said.

For it to be effective you don't want to be charged afterwards. Best make the most of that dash and discretely dump anything incriminating before they catch up.

They are just saying you can't be charged with resisting arrest if you have done nothing to be arrested for in the first instance. Time to organise a sacrificial runner who scoots and drags the coppers away at the first sign of trouble. Kind of like a stinky pot smoker who drags the dogs away and volunteers for a strip search at festivals. ;)
 
Oh no, I understand it I mean it doesn't seem consistent with the logic usually used in such matters (i.e. to quote Chamillionaire "If you are not guilty of anything, then why did you run?")

I think it's good though.

I love this! Especially considering that I've been off cigarettes for a couple of months and exercising for nearly as long. Time to up the cardio'!
 
Ive been in that situations but at the time, had 4 criminal charges gonna be laid against me.. until they found out I was 17 at the time and I just so happened to catch them at the end of their shift ;) (fuck paper work!)

I don't understand if the guy they're talking about was on foot or in a car, but sure he ran, and eventually got caught up to and then the pigs got him for SOMETHING. Like public intoxication, or disorderly conduct. Only now they won't list "resisted arrest" on his charges? The charges all go to the same court system, where the phony descriptions get reduced down to a number. And that number is how much you owe for being naughty. So I don't see what they did here, unless I'm seeing it wrong.
Unless it was implying that the law used to be that people who refuse to cooperate with the cops, even after being discovered is doing nothing illegal can still be arrested?
Or is it saying he drove or got to a place out of the cops jurisdiction?
Confusing the shit at me but I'm trying to wrap my mind around it..

Does it really matter that the description was dropped from being used? It seems like you'll still be in trouble if you're bad and have to pay for it.
 
My read on this decision is that you dont have to stop when asked by the cops and they can only effectively stop you if they arrest you. So if they ask you something and dont want to answer you can just leave (most know this, but the court has confirmed it)
 
Best to run, they'd stop at the first sign of doughnuts anyway... Though now that all those Krispy Kremes shut down, it might be a bit more evenly matched.

I am pretty sure they do that on The Wire atleast once, if not more, have a clean dude book it soon as the cops pull up so they all chase him and give everyone else extra oppurtunity to ditch their shit and/or disappear.

This is pretty damn funny, I am really surprised the magistrate would not side with the police on this one but I am definately not upset about it.

That is a very strange story.

I've never had any run ins with the police (minus some stupid low point in my life), but I imagine that will make for some quality/amusing news headlines in the future.

I think he was on foot, if it was a car chase with a drunk driver I don't think the magistrate would have made this decision. Even if he was sober and started a car chase, that is putting the public at risk and be considered very serious.

It sounds as though he was drunk, walking around and the cops decided to stop him and have a chat and he decided that he didn't want to talk to them and so ran away.

I still chuckle when I think about this thread, like I said before normally the police have way too much power and I'm glad someone has decided that they can't just do what they want. When I was in Melbourne last year I saw signs saying that now they can stop anyone at anytime to search them for weapons, which I thought was fucked up. The police are on a power trip and it seems as though judges and politicians allow them to keep on that trip a lot of the time.
 
Yes we all like to bash the police at times. I do from time to time. But. If you were a victim of a serious crime you would want the police to catch the person and not want them running.

I'm no lover of the law but this sounds a little crazy.
